  1. Hey Visajourney team,

    We are a bit confused about when my wife can apply for citizenship.  

    - I'm a USC, she received her Green Card on 8/3/19 (and expires 8/3/21)

    - Due to the pandemic and surgery, she was out of the US for more than 1 year and was approved for Returning Resident Visa

    - We came back into the US on 6/15/21

    - We applied for I751/CR removal and NOA was received 7/23/21

     

    Question: Exactly when can we apply for Citizenship N-400 - a) AFTER 2years and 9 month (AFTER returning from to the US on 6/15/21)

    or b) 2 years 9 months After she received her Green Card 8/3/19 (even though she was Out of the US for more than 12 months)

    or c) is it actually only After 2 years 1 day after either return to the US or receipt of GC?

    Of course it will expire. ROC processing takes 1-2 years on average. When you file you get a NOA extension letter. You can show your expired card +NOA and it is proof of status for work and travel for 18 months. If your ROC is not approved when that expires you can get a 551 stamp for proof of status.

    None of that is part of the ROC process. You should browse the ROC subforum for more information about ROC in general as it seems you are unaware of what is and isnt required. 

    Affidavits are considered secondary evidence. You can include them if you like but they should not be your main evidences. Here is a somewhat recent post about how to assemble ROC evidences with less then traditional evidences.  It is not a problem to not have a joint bank account. You need to show shared finances not a shared account.

    Yes, I was a bit confused about ROC - since it has to be done within 90days but I didn't realize that the GC card will expire for everyone before the ROC will expire...

     

    We will try to show shared finances though we don't have a joint bank account in the US yet (without a SSN)

    Your profile timeline gives an approved immigration visa a couple of years ago .. did your wife enter the US using that visa and become an LPR with a conditional green card ? What date did she enter? Did she apply for and receive a SSN after entering ? When did she leave the US  after that ? When was the Returning resident permit issued .. when did she reenter the US?

     

    SSN are issued by the SSA .. totally separate to the USCIS… being issued a SSN requires evidence of lawful residency .. ie. a valid GC. 

    Thanks for your Fast reply!  Maybe just the answers for question 2-4 would suffice.

     

    But to answer your questions:

    -Yes, we married on Oct 31, 2017 in the US and then left the country. 

    -Both of us returned on 8/3/19 where her immigrant visa was approved and we returned back to her country on 9/15/19.  We did NOT apply/receive a SSN for her at that time. Due to the pandemic, we stayed outside of the US for more than 12 months (plus USCIS had to correct and send her a new Green card which we only received in late Jan 2021). 

    - She applied (which included physical, blood test, biometrics) and was approved for a Returning Resident Visa on 5/14/2021 and entered the US on 6/14/21. At this time, we were informed to wait a few weeks for the SSN to arrive and if it did not, to call SSN.  If did NOT come after 3 weeks, so we just scheduled a SSN appointment for late July 2021 (though her LPR says CR1 expiring 8/3/21).  

     

    So what would happen if we turned in the I751 tomorrow (7/14/21) and we didn't hear back from USCIS before her CR1 visa expires?

    We have an interesting case - how does the I751 and SSN relate?  My wife (who is a permanent resident with a CR1 expiring 8/3/21 and immigrant visa expires 11/10/21) and I just returned to the US in June.  We would have came earlier but she received the wrong USCIS # so we had to wait for them to send another card with the correct number.  It arrived earlier this year where we had to get approved for the Returning Resident Visa (which included a physical, blood test and biometrics) since we were out of the US for more than 12months. 

     

    When we arrived in June, we were informed both by USCIS and SSN to wait if her SSN card was going to arrive in a few weeks. Her SSN never came so we needed to request an appointment with the SSN office - its appointment is NOT until the end of July (1 week before her CR1 expires).  And without a SSN, we can NOT have a joint bank account.  We are turning in the I751 tomorrow

     

    A few questions:

    1) Are the I751 (to remove CR1 conditions) and SSN processed by different departments?

    2) What happens if her CR1 expires before USCIS gets back to us?

    3) She JUST had a biometrics, physical and blood test just to get back to the States for the Returning Resident Visa - does she need to do it again/pay for it again?

    4) Do we really need an affidavit - that includes signatures and is notarized by 2 people?  (Especially when we JUST completed all the docs and exams for the Returning Resident visa)?

  5. Hello VisaJourney crew,

    My wife recently received a new green card (as the government informed us that her old card had the incorrect numbers).

     

    I'm a USC and my wife's new/correct green card does not expire until August 2021. 

     

    She has been out of the US for more than 12 months due to COVID19 (international travel restrictions and Seattle/home town was one of the worst hit in the US for awhile - so we were waiting until the pandemic to improve before returning).  

     

    Do you have any tips for applying for SB1 visa for her case?

    Does anyone know who we could contact?  My wife is a Greencard holder (she just received a new greencard which does NOT expire until August 2021) but with the pandemic/travel restrictions/lockdowns, we were NOT able to return to the US within 12 months. 

     

    Do anyone have experience working with the Returning Resident Visa (SB-1) and if she needs that visa due to the pandemic/travel restrictions and being out of the US for more than 12 months?

    My wife just received her New Green Card (the previous Green card had the wrong number so she was issued a new Green card that doesn't expire until August 2021).  

    - We were supposed to return to the US last April 2020 but then the pandemic/lockdowns/travel restrictions came - so this would be MORE than 1 year since she has been out of the country

    - Since her brand new Green card does NOT expire until August 2021, does that mean she can return to the US without any problems (even though we have been out of the country for more than 1 year)?  

    - We can NOT get past the computer voicemail at USCIS

  9. Hypothetically, if we marry in US while my fiancé has tourist visa (and obtain marriage license and civil wedding in US) and then wife returns to her country and we have religious ceremony over there, 

    1) Can I apply for CR1 immediately after wife returns to her country while I am still in the US?

    2) how long does it take before the I-864 forms arrive? I'm thinking about eventually quitting my US job after we marry in the US to live with her in her country temporarily  (while showing I have enough assets to support her)

  10. Hi, I'm a USC who will marry and live abroad with my wife after we marry.

    Several questions from the I-130:

    1) Part 1 Relationship (you are the petitioner) - if the question does NOT apply (i.e. Part 1 Relationship #3 "if beneficiary is brother/sister". . .) since I'm apply for the spouse, do I just leave these types of questions blank?  or date marriage ended?  (and this is my first marriage - do I just say N/A)

    2) Part 2 Information about you (Petitioner) - Information about your parents - what if one of my parents died?  Do I leave it blank?\

    3) Names of All your spouses - Since this is our first marriage, do we just put N/V for "when date marriage ended" and for "spouse 2"? 

    4) Additional Information about you (Petitioner) - I acquired my US citizenship through my parents (Certificate of Citizenship), can I skip the questions about lawful permanent resident 40-41?

    5) if we are married and living together, do we simply put the same address for the beneficiary's address?

  11. Hello, I'm a USC who will be quitting my job and moving abroad to marry.  

    I understand if I just use assets - the I864 requires 3x poverty limits

    Is there any requirements of how long you have to have that amount?  Or how long you have to have that bank account?

    Citizenship thru parents is when a child (under age 18) becomes a US citizen automatically when one or both of their parents are or become the US citizen. No need to apply for citizenship in this case. Your certificate of citizenship is for the proof that you are a citizen. 

     

     

  13. I'm a USC who was born in Taiwan.  They didn't have a birth certificate at the time of my birth - they had a registration - which was their legal document at the time.  

     

    Now as (as a USC), I am getting ready to marry a latina in latin america, should I also include my naturalization paperwork since Taiwan only had a registration document (instead of a birth certificate)?  

    Also, do I need the original documents for the registration and the naturalization or can photocopies suffice?

  14. A few questions about if we marry abroad and live abroad together while applying/waiting for the CR1 (and I stop working in the US):

    - Since I would leave the job in the US to marry her and live with her abroad, would that mean my income is 0 (or would they examine my previous 3 years of taxes)?

    - If I'm just petitioning for her, would that mean I would have to show 3x the poverty guidelines in assets?  or is it 5x the poverty guidelines? 

     

    My intent is to marry her abroad and live with her afterwards until her CR1 gets approved. And I will have no problems working again in the US afterwards

    Any idea how long it takes to to obtain a resident status in Dominican Republic (Cedula) and Peru (Carnet de Extranjeria) before I apply for DCF?
