  1. Don't know if this has been covered before....

My fiancee's passport is set to expire in April 2007. We were expecting the K-1 process to be finished soon, but the IMBRA delay has put us in a situation where her passport will expire sometime around the consular interview or entry into the US. We don't want to cut it that close.

We contacted the German embassy and found that they cannot renew the same passport number. They must issue a new passport number. So, we really need to renew her passport now to avoid trouble early next year.

Our case is currently with NVC and will soon be passed to the Guangzhou consulate. Once we get the new passport, how do we get the passport number officially changed in the K-1 process?? Is it as easy as calling the consulate, or is there paperwork involved? Is there any advantage to changing it before packet 3?

When you need answers, ask the VJ experts!

  2. As others have stated, it depends on your circumstances. It doesn't have to be long if you have a typical case. Ours was a big longer though, because we had a lot to explain. We met and lived together in a neutral country (New Zealand) before moving to another neutral country (China), where we got engaged and have lived ever since. We used this question as an opportunity to explain our somewhat unusual situation, which may have otherwise confused them.

  3. I cannot attest to what everyone else is stating (the Philippines not liking co-sponsors). But, something else to think about....

If you are planning on working there and being the I-134 sponsor, keep in mind that wages are most likely lower than the US requirement, and official salary documentation may be hard to come by. You will probably need a co-sponsor if you are planning on doing that. I work for a US company that pays enough for me to be the sponsor. Just something for you to chew on.

  4. We are living in China and we are doing the entire K-1 process from China, even though my fiancee is German. Haven't had any problems so far.

You will need to have a mailing address in the US where CSC and NVC can send you mail. The mailing address won't be needed once it is moves to Manila though. The address of your family or a reliable friend will work just fine.

That's a nice opportunity. Go for it!

  5. All you can do now is wait unless you receive a request for additional information. Hard to say how long it will take for CSC to approve it. Some people have been waiting 6 months, but they are working on releaving the backlog so it could be less time. As kitkat says, plan on waiting 5-6 months that way you are prepared for the worst.

After CSC approves it, be prepared to wait another few months while it gets processed in Manila. You will be required to provide additional paperwork once it gets to Manila, but all you can do now is wait.

  6. They should recognize the mistake and forward it automatically. You should call them and make sure that they are aware of the situation, and see if they have already forwarded it.

Don't worry. These situations have a tendancy to work themselves out. But, call them to be sure it gets into the right hands.

  7. What consulate did you specify on your I-129F application?

If you said SA, it will go to the SA consulate. If you specified UK, transfer will depend on when you will leave the UK and head back to SA.

If you will head back to SA before the case even gets to the consulate, you should contact either the CSC or NVC (whereever the case is when you get ready to leave the UK) and have them formally change your address and your specified consulate. If the case is at the UK consulate, you need to contact them and have them transfer it to the SA consulate.

I don't think you should have a problem changing consulates, but it may result in a delay.

  8. In answer to your above question.... If you are free to travel to the US as a visitor (i.e. if you able to get a vistor visa somehow), you can go to the US during the K-1 process, HOWEVER....

1.) You cannot permanently change your address to the US. You must maintain your residence in SA. You will also receive your consular interview packet in the mail at your SA address, so you need to be able to check your mail in SA (or have a friend check it for you).

2.) You will have to return to SA for your medical and consular interview after your I-129F petition is approved.

It may be hard for you to get a visitor visa to the US while you have a K-1 filed. As Mew says, you will have to show substantial proof that you will leave the US after the visitor visa expires.
