    Does this mean her green card has been approved? Or at which stage of the AOS has been approved? If you are in the middle of the process, I would not risk going back to Mexico, until she has her green card. I'm not very familiar with DACA, but does she have a document that allows her to leave and enter the country legally under DACA?

    I heard that with the Trump administration, many immigration petitions have been submitted, so the offices are backed up. (NOA1 - Oct 4, no news yet).

    But, I am hoping this is a good sign, not only for my wife and I, but as people get moved out of NSC, hopefully, NSC will speed up for everyone!

    We are hoping the same thing. Our NoA1 is Oct 4 and were transferred to Texas Service Center on Feb. 22. No news yet.

    The fingerprints and photo are taken at the CAS office in Cd. Juarez. This is regular procedure and I have been through this for other visas procedures as well (F-1 student visa and B1/B2 tourist visa). The photo taken as the CAS is the one that will appear on your immigrant visa I-551 stamp and green card.

    Correct. Everything is filed here in the U.S. and then handled by NVC. You will receive all your notifications to the address here in the U.S. It is the interview, medical exam and finger print scan, etc which takes place in Cd. Juarez. They later send the passports to the DHL office you select in Mexico. 

     

    For the DCF, I meant it is handled in Mexico city and not Cd. Juarez.

    The steps you described are correct. But it would be Consular processing for your step children. DCF is an expedited process that would not apply to your case and I even believe it is filed at the U.S. Embassy in Mexico city.

     

    Best of luck to you in your process and do not stress about it. We all feel the same, but the key is to be patient and it all works out at the end.

    If I understood correctly, it also applies to emergencies, for example if the child is left with out a caregiver. And this process would not apply to her step children, correct?

     

    You were suggesting for her to file the I-130's for the stepchildren before her husband's Adjustment of Status process is complete and this would speed up the I-130 approval? However, she is still looking at 2 different routes. AOS for her husband and regular Consular Process for her stepchildren? Because her children are in Mexico, they would go to the interview in Cd. Juarez for their immigrant visa.

     

    I hope I am not confusing everyone.

    So, i was right about the petition being approved within the year, i thought that was me just being too optimistic. 

     

    SO, I think what I'm going to really look into is to file for their i130 and then do DCF and if they get their visa approved, we'll just remove conditions here. Unless our 2 year anniversary is within the visa validity then they'll just have t wait until then. 

     

    Visa is valid for 6 months after it's been approved, right? so, if we file the petition by may 2018 and get approved after October 2018, we'll just make sure that they enter after feb 2019 so they get the 10 year visa. 

    Correct, the I-551 visa stamp is valid for 6 months. After they enter the U.S. the GC arrives 3-6 weeks after.

    I agree, I don't think the process for your stepchildren as a USC would go further than 1 year. The age limit is 21, so your stepchildren are with in a good age range.

     

  10. Well it depends on your timeline. If you want the kids to come to the U.S. sooner and speed up your process, I would do as Lenchick suggested. Or else you will have a long wait, like the one we are going through. If you would like to avoid the extra step of removing the conditional status, then you can have them wait in Mexico. If you file for them later on and your husband's conditional status has been removed, their petition will be IR-2, instead of CR-2, and they would receive a 10-year GC.

    My kids were assigned first CR2 when their i-130 petitions were approved, but at the interview as the marriage got over 2 year term, they were granted IRs.

    I agree with Lenchick and follow his/her advice. We are currently going through an IR-2 process for a stepchild in Mexico and the wait times are very long. Our I-130 was sitting in Nebraska Service Center for 4 months and it was transferred to another office 'to speed up processing'. It's been 5 months and the I-130 has not been approved yet. For some reason Mexico can take even longer, these days. I have seen people from other countries who sent their I-130 later than us and they have already been approved. We began the IR-2 process after mine as an IR-1 was completed. So we basically started from scratch again. In my case, the I-130 was approved after 6 months and the rest of the process took an extra 8 months.

     

    Indeed, the kids will receive a conditional GC, if the father receives a conditional GC.

     

    I will emphasize on having the mother's permission.

    Congratulations!!! ... So, how long was the wait for your daughters (IR-2) at the Texas Service Center? (NOA1 to NOA2). I also entered the U.S. as an IR-1 in August 2016, then my husband petitioned for our son (step child) the following month, but it went to Nebraska and then was transferred to Texas Service Center a couple of weeks ago. So at the moment, we have no reference of the wait time. At least in Nebraska I was expecting some time in April.

    Our case was also transferred from Nebraska to Texas Service Center last week (Feb 22). Our NOA1 is 10-04-16, so had been sitting in Nebraska for over 4 months. The petition is also for a stepchild of a USC (IR-2). Will keep you posted on any updates.

    Our case was transferred from Nebraska to Texas Service Center last week. We did not request the transfer, but the Notice states it is to 'speed up processing'. I was told that when an office is backed up, they transfer the cases to another office. Our NOA1 is 10-04-16

    I received an I-797C Notice of Action today that my case has been transferred to Texas Service Center. The reason is 'to speed up processing'. My NOA1 is October 4,2016. Did you receive your NOA2 sooner at Texas Service Center? 

     

    O anyone else receive their NOA2 sooner at TSC?
