    Guys,

I submitted I-130 for my wife and daughter (separately)  in Sept 12 (receipt date) 2016 as LPR to CSC (california service center). I became naturalized US citizen in feb 24th of 2017. The same day (Feb 24th) called USCIS to upgrade both petitions from F2A to Immediate relative of USC. The lady in USCIS opened two cases for my petitions. USCIS sent me an e-mail on March 7th asking to send my naturalization certificate for my wife's case and the same day i send my certificate. I didn't hear anything from USCIS for my daughter's case so i kept calling until March 20th when i met a nice lady who told me that the request to send Naturalization certificate was sent out (via e-mail) on March 10th. I never received that e-mail so l wrote a cover letter and faxed the naturalization letter in March 20th for my daughter's case as well.

March 21st, i called USCIS again to confirm if they have received my naturalization certificate for both cases and if both my cases were upgraded to F2A to Immediate relative of USC. USCIS confirmed that both the cases were upgraded to Immediate relative of USC.

Now the most frustrating part is, i hear conflicting information while i call USCIS for the receipt date of my petitions.

One lady at USCIS told me that the Receipt date for both of my cases will change to Feb 24th since i upgrade my petitions from F2A to immediate relative to the date when i naturalized. Other lady at the same institution said it takes 4-6 weeks to action on your petition after the petitions were upgraded. Not sure which one to Believe.

I am wondering if anyone has similar experience in the past? I am trying to figure out if indeed my wife's and daughter's receipt date will change to the date when i naturalize after they are upgraded and the petitions go back to queue? California Service center as of Jan 31st is processing october 15th 2016 cases, if upgrading the petitions reset the receipt date, mine will pushed few months back at least by 3-4 months and i am really worried if this is the case. Otherwise CSC has already processed petitions way beyond my wife's and dauther's receipt date so how long does it take them to action on my cases?

I'm following your case, have you had news ???

    Maitte28,

I had submitted two I-130 in sept, one for wife and another for daughter at the same day. Also i submitted upgrade  request for both applications same day with same immigration officer. USCIS asked to fax naturalization certificate for wife's application but i am yet to get the request for daughter's application. Very frustrating.

When are you going to be naturalized? Call them same day you naturalize and ask them to open case to upgrade I-130 from LPR to USC immediate relative.

Do you have same situation as mine?

If I have the same situation. But my husband only sent a request for both.
In December began his naturalization process now just waiting for the interview.

Then I have to send a 130 for my daughter and another for the daughter of the ?????
Another question my daughter is not my husband's daughter. But he has a daughter.
Someone told me that if they are the naturalized's own children you do not need to send 130 just that you have to go with your birth certificate and apply for your passport ... have you heard this ????

    Maitte28,

Mine was sent to CSC, i called the 1 800 375 5283 and asked customer service representative to upgrade the I-130. She raised ticket and i was told that within two weeks USCIS will contact me via e-mail or in letter. So i got the response for my wife's case via e-mail but my daughter's is yet to receive.

As of today's update CSC is processing oct 15th cases for immediate relative of USC. Mine was sent in Sept so i am assuming as soon as the upgrade is complete they will approve I-130 for both of my cases.

You sent two requests (one for your wife and one for your daughter) I-130 or one ??????

    Guys quick questions,

I had submitted request about couple weeks ago to upgrade my spouse I-130 from F2A category to USC immediate relative and recently got following e-mail. I have faxed my naturalization certificate to the indicated number with cover letter with my information and workstation number as indicated below.

How long does it take USCIS to upgrade my wife's I-130 to immediate family of USC?

On February xx, 2017, you contacted USCIS concerning your Form I-130, Petition for Alien Relative, to notify us that you have naturalized and are requesting an upgrade in the status of your petition. Below is a summary of what we found and how the issue has been or may be resolved.

To update your relative petition to reflect that you are now a U.S. citizen, you will need to submit or fax the  certificate of naturalization to (xxx) xxx-xxxx, workstation xxxx. So your petition will be moved to a new visa category for an immediate relative of a U.S. citizen. This category does not have numerical restrictions, and a visa is immediately available from the U.S. Department of State.

    Hi

I will soon be in the same situation of yours. Could you tell me when you sent the I130 and in which center?

How did you make the change ??

There are now updated processing charts on the Califronia Center.

Interesting is that first time to my knowlage, I-130s of LPR and I-130s of Americans are not treated the same and have different processing timelines!

    Hi Michael

My husband call the last week to USCIS and they said that We expect news about my case after March 16.

  6. Hi,

I am anyhow planning to open a company in USA and invest in it, together with my wife. Now I learned that with this investment and with the jobs created I could actually qualify for an E2 Visa. I am a bit worried to apply also for the E2 as it would make me look that I want a visa this or that way. It would cut my wait substantially if granted. Any thoughts?

    Hello Michael2017

Any news about the visa E2?????

    Did you find the information????

  7. So what do you all think (or maybe know from people who've already gone through this), which approval step is really the most important? Is it really going to be the interview; or is it like, if you steered right through the previous steps with no issues whatsoever, the interview is mostly a formality?

I think the interview is to confirm everything they have investigated each of us.

sometimes we do things we think no one will know.

  8. Today we got an email stating we were sent to California Service Center. I think this is faster than Nebraska?

    So my dates:

    Received by USCIS: 19th October

Email notification: 24th October - California Service Center

    Great!!!!

We are at the same service center.

  9. Onek seems to have been actively updating the spreadshet so seems like everything's up to date.

Inspired by Onek, I have added "Petitioner status" column to indicate Petitioner's citizenship.

Please let me know if you'd like yours updated so we can all benefit from referencing the timelines relevant to us :)

Per the Case Tracker, for the 500 records following LIN1690685000, cases were received around May 23, 2016 and include the following I-130 stats:

    • 3 Approved
    • 8 Rejected
    • 15 RFE
    • 176 Pending
    • A lot of these show "Case was transferred and a New Office has Jurisdiction" on October 12th

Per the Case Tracker, for the 500 records following LIN1690750000, cases were received June 15, 2016 and include the following I-130 stats:

    • 0 Approved :crying:
    • 3 Rejected
    • 1 RFE
    • 50 Pending

Seems like the offices are sludging through May submissions now. Checked May 12th records and a large number of them had been approved.

Hi JessieABC, where you see this information?????
