    This one they set it up. So unlike K-1, with this one, you have to submit a lot of documents at the NVC. After you receive your case number, the first thing you will do is to log into CEAC and fill in form Ds-261, which is to choose the beneficiary’s representative, which 99% of people will choose the petitioner (you). That way, you get everything they will get. Then you pay 1 fee. Then you wait a few days or week, then you pay another fee, and then fill in the DS-260 which is the main form. The NVC will have to review all that and when they say everything is good, then they will schedule the interview in Saigon. The other thing is try to send everything in and not miss something, because if you miss something, they will ask you to submit or resubmit, then it will take them another 4-8 weeks to review.     So the police report " Ly Lich Tu Phap # 2 ", once they're done with it in VN, then they send a copy over here so we can submit that to the NVC over here as well rather than submitting it to the consulate in VN?  Also, even right now they can start the process of getting the police report already?  I'm not sure if there's an expiration date of that police report or if you have to get it within a certain time frame or not.  

     

    So what are the things that they need to do in VN?  I'm asking because i'm wondering if it's even worth it to hire someone to help with the process in VN or not.  Thank you so much for your help.  Your information is very detail and informative.  This is a lot different from K1 process.

    I did it for my mom last year also from VN. I-130 was approved Mar 1st. It was transferred to NVC within 2 weeks but NVC took until April 24th to input the data and create the case. You will receive an email from NVC with a case number and invoice number to start the NVC process and pay a fee. At this stage, all you can do is wait untik NVC assign you a case number. You can start gathering (if you haven’t already) all the civil documents from your parents such as their birth certificates, their police clearances (Lý Lịch Tư Pháp số 2), ... and your documents related to the I-864 (you can start filling this now) such as tax transcripts, returns, W2s,.... ) Do not do the medical until the interview is scheduled. Her timeline is below just for reference:

    April 24: case created and NVC welcome letter

    Around late July, early August: case documentarity qualified and sent to HCMC.

    Sep 5th: Interview scheduled for Oct 2nd

    Oct 2nd: Interview

    Oct 16th: visa issued

    Nov 11th: entered the US and became a LPR

    Very informative.  Thank you very much for this information.  Now I have a range of time of what I can expect.  This seems like it's a lot longer than the K1 Visa but given that they're getting the GC at POE, it make sense that they needed a little more time to process the paperworks.

    I believe my paperwork is pretty detailed so i think it should be ok.  Hopefully.  But I was just wondering on average how long on average it'll be in NVC assuming they do not need anything else.

    I submitted the paperwork to USCIS since July 6, 2018.  But my paperwork take a little longer outside of normal time.  

  7. Hi all, i'm filing a I-130 petition for my parents in Vietnam and the file was just approved and we received a letter that it will be moved to NVC.  I check the status on NVC website but still no record of it yet so i'm assuming that it hasn't gotten there yet.

     

    Can you guys let me know on average how long for I-130, petition for parents, to be process in NVC before sending the file back to the consulate in VN in Saigon?

    Thank you.  Do you know with the IR5, will the consulate in VN issue an interview date and time for my parents or do we set up the interview date and time by ourself like the K1?

    By the way, do you know the types of information and/or documents that they generally ask for a the time of interview for parents?   I'm very familiar with K1 process but unfortunately i'm not as knowledgeable for the Parent's petition.

    I am currently filing a petition I-130 for my parents.  It's probably another 2-3 months out until they make a decision and then will send to NVC.  

     

    Can anyone let me know about the interview in Vietnam, whether they will let me or my sister (not on the petition application) in the consulate for the interview?  Or it has to be only the person on the application can be allow in the consulate. 

     

    Please let me know because I do need it to plan a few things in Vietnam.

    My fiance came here in in March, 2018 and I just received a notice for our interview here in the US.  

     

    For those that went through this interview, can you guys please share your experiences about what goes on in there and/or the questions that they've asked?

     

    I'm trying to prepare for this interview and bring as much paperwork as possible as stated in the interview letter.

    I've submitted the AOS paperwork and the latest update says this

     

    "As of August 8, 2018, we are ready to schedule your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number .............., for an interview. We will schedule your interview and send you a notice. Please follow any instructions in the notice"

     

    Does this mean that they will need to interview us again or is this just a standard formality notice and there might not be an interview?  Please help.

    Yes.  When we were at the DMV, he verified the visa and me as the petitioner and then verified my info regarding my Texas residency with a few documents and then she's good to get the permit.

    It sounds like Proof of Texas residency has already been met.  I think you are out of options until her EAD arrives.  I wish I could offer a better option, but I just don't think you have any......Texas is very strict on proof of legal presence in the US.  Unfortunately, this is one of the downsides of a K-1 vs CR-1.....good luck to you and your wife.

    The above brochure lists the documents which suffice.

    1.  Proof of Texas residency

    2.  Proof of legal status in the US-  Work Authorization is one of the ways listed.

    3.  Proof of Social Security #

    4.  Proof of Identity

     

    My wife got her Texas DL after a few months in the US.  The DPS was very strict on the requirements..

     

    Yes I am in Texas actually.  

     

    1.  Proof of Texas residency - can you help specifying this?  She currently have a driving permit card but expire on June 8th, 2018.  Not sure what else can proof this.

    2.  Legal status in US - waiting on this one.

    3.  SS - we have the number, just with a note of not able to work and until we get the EAD

    4.  Proof of identity - I guess her passport will work.

    There is so many questions like this lately and all people should do is just check with their state..  I swear this is like 3rd time I'm answering this question this week. 

    I check with the local DMV already and they say that they have to go by the travel document.  I'm at a dead end i'm wasn't sure if there's any other way so turning my help to our fellow VJers. :)

    Yes we did and we're waiting for it to process as we speak.  But most likely there's no way of going at it until she get at least the EAD/AP right?

  18. Hello,

     

    My fiance is here already and we've file for the AOS pending the application to be processed.  We have not received the receipt # yet.  Her visa states says that the expire date is June, 8th 2018 and that's what the driver license place is going by to issue her the temporary license.  They cannot issue something past that date.  

     

    My question is, is there something that I can do to get her the ID so she can drive while waiting for her green card?  Average time to get a green card is 12 months but that's too long for her not to be able to drive.

     

    Please help

    I'm helping my sister in-law filing a petition for her parents in VN, The form i'm using is i-130.

     

    per the instruction, we are supposed to file a separate form for each eligible relative.  I wanted to check with all the experts here to see if that's the case.  Anyways, to sum it up, i'm supposed to file 2 separate application for both her mom and her dad right?

     

    Your help is much appreciated it.

    I have a few questions regarding the information on the form.  Can you guys please help me out as I am preparing for this form on behalf of my fiance, now wife.

     

    1.  Part 2 - Application type or filing category

    Do I need to fill out questions # 3 (receipt number of underlying petition)  # 4 (priority date from underlying petition).  

     

    2.  Part 5 - Information about your marital history

    question # 10 (is your current spouse applying with you?) - I'm assuming that the answer to this question is "no"?

     

    3. Part 6 - Information about your children

    question # 1 - this include stepchild.  I (petitioner) have a child of my own, do I need to put my child's info on here as well?  My child is considered my wife's stepchild right now.  

     

    4.  Part 10 or Part 11 or Part 12? - Of course I help her file this application so i'm assuming that I fill out part 12 which is the person preparing for this application.

    What did you guys do or what do you suggest?

    I am in the process of submitting my I-485 form along with the EAD and Advance paroled.

     

    I wanted some suggestion to see if there are any additional information/evidences that I should submit along with my I-485?  Or is it just the standard form that I should send in.

     

    Please help, I really appreciate it. 

  22. I did already. :( I wish I posted this question earlier before I went and get the Social Security card.  I didn't realize that you can be able to call customs and have them change the name without having to be at one of the offices in person.

    We change when we apply her social security number without any problem 

    I went to the SS office and apply already but they say that they can't change it.  It has to match with immigration so the name is still the same.
