  1. You have too many versions of your story, plus you post and ask the same question numberous times since September, if you cannot be honest to illicit real help, seek a lawyer.

    I am honest, just keep in your mind that life is full of mysterious. I do not want to write an essay on here. I just asked for some advise for the three options out there for us. So if you do not have anything good to offer then thanks for not saying something negative.

  2. Hello everyone

    I am currently in the U.S on my B1B2 visa visiting my Fiancé. We filed for the K1 visa last year and I came here in August but we did not get married and I left the country. We are now together and happy to stay together. We are asking for some advise that lets us be together ligaly.
    We did some research and based on what we found we have three options which are;
    1- Re filing for the second K1 visa while I am in the state and go back to my country for the Medical exam and the interview..etc.
    2- Getting married here and filing for the CR1 Suppose married visa. Which we think this is much more longer than K1 visa.
    3- Getting married and applying for AOS which is not our favorite one because we do not want to do anything seems illegal.

  3. My fiance wants to visit for Christmas. He would stay from December to sometime 3 months after that. Is it ok to file during this time? Or should I wait until he leaves? We want to file right now but I have some things going on for the next month or 2 that will make that difficult to do so we don't want to delay it any longer than we have to, but I would hate to get denied over something so preventable.

    Just be aware about denying him or her to enter the U.S.

    I am also thinking of the same thing visiting my fiance.

  4. I've seen quite a few people who also had no stamp and were never told it was canceled yet found out the sad truth when they tried to fly. But if you think this info is irrelevant... :reading:

  5. How do you know that it didn't get cancelled?! I have a B visa as well, even in a different passport than my K1 and was told that it can't be used anymore as it is cancelled. They seem to probably cancel it in their system.

    It is simple. No stamp and never told that is canceled..

  6. You have shown intent to immigrate. A k-1 visa, although technically a non-immigrant visa, the end result will likely be a green card if the process is seen all the way through. So by applying for a K-1 visa, you have stated that you would like to move to the U.S. and obtain permanent residency status.

    Why would that change now? You are visiting the same girl right?

    Thanks for your comment and thought. We just both agreed to re consider our decision. I do have time and we miss one another. She does not have vocation so I thought It can be practical to me to go there for a week.

    In March while we were about to get my K1 visa, I got this B2 B1 visa my work and went there for 2 weeks she come to meet me in D.C. I could have stayed there but I came back.

    I am also going to D.C cause of my work sometimes in December and I can show them my work contract. I do not have tent to stay there at all at this point for sure. We are still working on our relationships.

  8. This is the third time you have posted this question. 1st - giving my fiance a second chance can I use B1/B2 to come back. 2nd - surprising your fiance with a visit. 3rd - now you want to visit for Thanksgiving.

    Your visitor's visa was cancelled when they issued your K-1 visa. Yes you will be denied as you have already established intent to immigrate, did not comply with K-1 directives, and left the country.

    Thanks for your comment, My visa is still valid and did not revoked or canceled. If we wanted to get married we could have gotten married but we decided to postpone it. Why should be a problem ?

  9. You're not supposed to have two valid visas at a time, so your B visa should be cancelled once your K visa is issued. If someone else got in on a B visa, they got lucky! I would recommend that you not chance it. I hope your interview goes well!

    I got my K1 visa and my B2 B1 visa was still valid. I did not see any stamp to revoked

    I am not sure if you can do that but you can ask an immigrant lawyer.

    You also can postpone the interview. I did and it was not problem at all.

  10. Someone might chime in if I am wrong but I read somewhere before that you could ask your consulate where you got your K1 visa issued whether they can reactivate it. Explain what family emergency you had (maybe submit proof). I read that sometimes they actually do that

    You will be denied entry, your visitors visa was cancelled and you already entered on your K-1. Since u did not get married, you have to file K-1 all over again.

    The B2 B1 visa is still valid and did not cancelled

  11. Well, in life "life happens". Any chance the two of you getting married in your country?

    whatever she is okay and fine with it, I do not think I have a problem with this idea. I am even okay to do everything to not loose her and our lives together but she is very down now and barley even texting me.

    It is fine, She is just so very unhappy because we were planning on getting married and never happened and now she is not sure if she want to do it anymore. She really worked hard in the last two years on our relationships.

  13. Even if they forgot to cross it out in your passport the b1 will be cancelled as you obtained a fiancé visa which overrides it. Applying for and using the k1 showed immigration intent.

    Is it still within 90 days of you using the k1 visa to enter the us?

    yes, we have still one month left for the 90 days. but as I said she is very unhappy and mad at me now. I want to make her sure she is my propriety She is even not ready to talk to me. I am just going to fix what happen not to stay there at all.

  14. Yes, it is likely they may not let you enter. Did you check your B1/B2 visa to see if it was stamped "cancelled" on it? Since K-1 is a one entry visa and you left the USA, you have to go through the whole process again.

  15. I am planning on going to surprise my fiance in U.S but I am scared if they denied me to enter the U.S I have a valid B2 B1 visa. I was in U.S 2 weeks ago on my K1 visa but due to my family emergency I had to come back. Now my fiance is really super mad at me and want her to know I love her and care about her. The B2 B1 visa I have I got it before I get my K1 visa.

    Is there any chance to not let me to enter? this cause a real problem for me to go there in the future?

  16. No, the consulate did not ask for any documentation, just my fiancee's passport. Here is the content of their email reply:

    Dear Mr. XXXXXXX,

    Please send us back the passport of your fiancée and we will proceed with the visa reissuance. Please note that the whole process (Reenter in the United States, Marriage and the conclusion of the adjustment of status) will have to be completed within 90 days of the date of the first entry in the United States, Which occurred in January 17th 2015.

    By the way, I think the CO was incorrect in stating that the conclusion of the adjustment of status had to occur within 90 days of the first entry into the U.S. I believe only re-entry and marriage would have needed to occur in the original time frame.

  17. I am the U.S. citizen. My (now) husband entered the U.S. on a K-1 visa but had to leave for a family emergency before we married. I contacted the consulate in Rio de Janeiro, and they were willing to reissue his K-1 visa as long as he returned to the U.S within the time time allotted by his original I-94. That was 90 days from the date of his original entry. That ended up not being practical, and I needed to apply for a second K-1 for him when he was finally able to return. That also required an IMBRA waiver,and I am attaching a copy of the letter I sent along with the second I-129F.

    If you are able to get your original K-1 visa issued and you do return, you will still be required to marry before the original I-94 expires. USCIS does not allow for an additional 90-day period to marry.

  18. It doesn't matter the tourist visa is not cancelled, if you travel, they have you on the computer as a K1 visa too and it's very possible they don't let you in.

    Try your local embassy, maybe they do extent your visa for the 2nd entrance, very sometimes they do. If they don't, the only one option is to go to do the K1 visa again or to marry abroad and to do the marriage visa. Your tourist visa it will be always not good as you showed the intention to immigrate applying for the fiance visa.
