She trusted the local VISA experts and paid a lot of money for their "help." We're both sad about the result, and are considering our options. Thanks for thinking of one option for us.

That's inaccurate. The night before her interview, when she was talking with me about the interview, was that first time that I learned that part of her work history was fake, and that she included it on her documents. As I mentioned in first post, I tried to encourage her to tell the truth about this misrepresentation.

Working as a pilot in the USA I've been able to visit her nearly monthly, for 10-15 days at a time--so we're living together part time. . Thank you for your help! I'm still shocked about this denial. . Can you recommend a good lawyer?

Yes, her story details were apparently inconsistent with her Tourist interview story, also that she asked the in the Tourist interview if a Tourist or K1 Visa is faster, and the interviewer we said that she knew that my fiancee never worked in the fake job, that she could not trust any of her statements and that VISA fraud had occured because of her statements.
Lesson: don't hire "experts" who promise to procure a Tourist VISA with a fake work history. :-0

Today my fiancee had her K1 interview in Moscow. She was denied a VISA under Section212(a)(6)©(1). The "eligible to apply for a waiver" box was not checked.
Background: last year she hired someone to make her first ever tourist visa application. This guy invented a four year job in Moscow for her, and put it on her application. She was denied for insufficient resources/ties to Russia.
When she wrote forms for our K1 Visa she used the same fake work history, thinking that consistency was more important than the truth, despite our conversation the night before about it.
Is there any was forward for us in the USA? Get married in Russia, and apply again? I-601 waiver? Some other process?

Thank you for all who have replied! We don't want to cause any problems; we are only trying to find a way to be together as a family, and to create an environment that is good for her child. It sounds like I'll have to move to Russia, find work and we''ll continue trying to establish a friendly relationship with her angry and sometimes violent ex husband.

My fiancee and I thank everyone who has taken time to write these thoughtful replies!
Update: The ex is providing child support only through coercion (money taken out of his paycheck by employer), visits the child occasionally for a few hours on some weekends for fun time at a playground or for pizza, and has yelled loudly at and hit both the child and ex within the past couple months. My fiancee was told by a lawyer that this level of domestic violence is not sufficient to argue for full custody.
My fiancee has spoken with the ex several times recently about signing for travel permission to USA, but to no avail. Despite our offers to pay for flights to/from Russia for the child, so that he could spend summers with her--and also relieving him of financial responsibly--he still refuses. He's happy with the current arrangement of short visits, and no serious parenting when he's in the mood.
We are proceeding with the Fiancee Visa despite that he's made a travel ban (outside of Russia) for the child.
My fiancee wants to interview in Moscow with her 5 year old child, get the Fiancee Visa and K2 visa for her child, then travel to another country with which Russia has a visa-free travel agreement. Then, she would get on a flight with her child from that intermediary country and fly to the USA on the Fiancee and K2 Visas, thereby circuventing the travel ban.
Does anyone see a problem with this strategy such that she would not be able to fly from the intermediary country, or to be admitted into the USA?

K-1approval requires that you met your fiancee within the past two years, and have no problems (legal, criminal, etc) that could disqualify your application. I have had two previous Russian wives, my Russian fiancée has been married twice too, and she was 30 and I was 53 when I filed our K-1. Along with the forms I included only copies of two emails, one bad black and white Photocopied photo, airplane ticket stubs and a few Russian receipts, and a few sentences describing my previous two marriages, and requesting a third attempt. Our application was quickly approved.

You have filed the K1, so what is the plan if the child can not come, go to the Father?
Our plan is for me to commute to work from Russia each month, spending a week or two there each month. We'll see how things look with permission in six months, when our Visa is nearing approval.

Thank you to everyone who has replied. I appreciated your comments, speculation and opinions on ancillary topics, but my question remains: "What permission is needed for her to take their child with her, on our Fiancée Visa?"

Joint custody. She called the police when he hit her and the police came, took a statement, and advised her to file a complaint. She will file a complant tomorrow.

They are divorced, live separately, share custody and have a 4 year old child. When he learned last week that I am returning for a second visit soon, and that she wants to move to USA and marry me, he went to their apartment and hit her and yelled at their child. He is upset that she divorced him, has become incrasingly angry, and talks about getting custody and refusing to let their child leave Russia. What permission is needed for her to take their child with her, on our fiancée Visa?
