  1. OK, to my understanding.

    When they at the PoE officer they need to let hin know where they will be staying and who is responsible for them when they are here. I want to be able to have an introduction letter that explains the circumstances and requests the officer to let them stay for six months. I know that the officer has the right to say how long they can stay but They usually ask how long do you want to stay.

    My wife is due Oct 23rd. and they plan to stay for six months to help my wife after the baby is born.

  2. My wife's mother and sister are coming to America for my wife's birth of her first child.

    Question, is there a standard form letter (explaining they're reason of visit and length of stay) that they can hand to the entry officer? as they can't speak American.

    They are coming from China and will be staying for six months.

  3. Thanks for your responses. Looks like we'll need to go to New York. We live in Ohio and OH reports to NY. We might as well make a little vacation out of it. Neither me nor Lisa have ever been to NY. Have to gobble up some good food while were there. I guess i should check to see if we need to make an appointment or if we can just walk in.

  4. My wife is from China and has been in America since April 15 2007 and her passport expires June 6th 2011. What steps do i need to take to get this renewed? Can I do it via a mail process or do we need to go to a federal facility. our closest large city venue would be either Detroit, MI (120 miles) or Chicago, IL (180 miles).

  5. I don't remember how I fastened my check for the fees to my I-485 packet that was made up with the ACCO fasteners. My I-751 is also bound with the ACCO fasteners at the top. I seem to recollect having the check inside a plastic sandwich baggie but not sure or how i would've fastened that either. I did fasten two sandwich baggies to the back cover with staples that include 2 passport style pictures and pictures of evidence of ongoing relationship.

When I filed my I-485 and I-765 I had a heavy cover page which had a table of contents depicting all inclusions, all bound with an ACCO 2 3/4" Prong Fasteners at the top of the submission packet. Should I do the same thing for the I-751? I've already got it dona and ready for mailing tomorrow but thought it would be a good idea to inquire to see if anybody else binds the I-751 like the recommendations for the I-485.

  7. Could somebody please elaborate on the dual passports. First off I think you have to be an American citizen to even apply for an American passport.

    If Staashi is correct and she needs an American passport along with her Chinese passport then her flight ticket for China will be no good. She leaves for China, Shanghai on July 9th. At $1350 for the ticket and no refund available this would be a disaster.

  8. Ah-ha, that was easier than expected. Here's what I found. while reading the "Now That You Are A Permanent Resident" on the USCIS web site.

    International Travel

    A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

    So we keep our $305 after all. Lisa will be happy. That'll give her more shopping money while in China. I'm sure she'll do plenty of that, to the tune of about $1500 to $2000 US

  9. woa, i was just ready to file the I-131 form for re-entry. She doesn't need it?

    Our details;

    She arrived in USA April 15th 2007 on her K-1 visa. We married June 6th 2007 and she received her 2 year permanant residence card (green card) on Oct 16th 2007. Where can I read that she can travel to and from her home land (China) only with her green card ? I hope you're right, i wasn't too happy with the $305 charge. This is her first trip to China and it will be for 20 days.

    I do kind of vaguely remember this. I remember that when I filed the I-485 AOS form that I could have filed for the work permit and I-131 advance parole (re-entry permit) if she was going to travel home prior to receiving her green card. I didn't file the I-131 as I figured she'd have her green card prior to a return visit to China. So if my memory serves correctly Staashi is correct. i would like to read it though. i'll google it.

    Me and Lisa have now been married for just over one year now. Life is great, we're both very happy. My wife now has her green card. She's going back to China to visit with her family. Will she need anything besides her green card to return to America? i don't believe she needs a visa or anything to return to China as she's still a Chinese citizen.

  11. Since I posted this back in December I've received multiple questions concerning my progress. Everybody sends me a PM. This is nice but it doesn't keep this thread updated on our progress. This answer was a reply that I feel should be here to help answer questions that members have.

    If she's an orphan it's no problem, but if she's a niece and has parents or even parent it can't be done. You can't even get to first base, on adopting a child that has parent(s). There are only two options that we can come up with. First you can go to China and live with her for two years while in China and you can adopt her. At this point that is out of the question for us. The option that we are choosing is to bring her to America with an I-20 visa. This is an educational visa. You won't be able to send her to a public school as she won't be a citizen. It appears the only way to do it is to send her to a parochial school where you pay the whole tuition. You'll need to provide all of her support as the government won't help in any way. Remember she's not a citizen and doesn't qualify for anything from the government. We don't care, we've got our I-20 filled out from a qualifying school but we want her to come to America first and spend a couple months to see if she likes it here. This is such a large decision for her we want her to be certain before she commits herself in either direction.

    Good luck, you'll need it. We had a lawyer search for over two months for any way to adopt her and it can't be done. Only some medical reasons would be considered. Example the parents are terminally ill with no chance of recovery. Good luck proving that.
