    You really need to educate yourself on the difference between waiting for a petition to become current and filing for an adjustment of status.

    The entire process used to take that long. Only reason I know was because my relative did it few years back for their husband.

    Visa availability, AoS filing - TERMINOLOGY. I'm talking about the length of the ENTIRE PROCESS.

    I believe when people generally ask - how long does it take to blah blah, they mean the whole thing. From the moment they file to when they receive a green card.

    It takes 2 years for a green card holder to petition for a spouse and for that spouse to become a green card holder. Look at the Visa Bulletin.

    You do not know the difference between waiting for the PD to become current and filing for AOS.

    You're right, It used to be way longer. I guess their changes in 2013 really helped.

    Please make the distinction between waiting for an available visa and actually adjusting status. You are not making that distinction.

    It takes 2 years for a green card holder to petition for a spouse.

    It takes longer for a green card holder to petition for an unmarried child over age 21.

    AOS is a different matter. AOS only happens when the petition is current. AOS does not take 10 years.

    For the lack of a better terminology, allow me to speak in simple words:

    if I have a green card and get married, it will take around 10 years for my spouse to receive the said green card themselves.

    There is no limit to green cards issued to immediate relatives of USC.

    However, there is a limit to green cards issued for immediate relatives of permanent residents (the number is different for each category). And there is a big line of cases.

    Last I checked, in NYC it was close to 10 years for green card holders' relatives.

  5. Everybody is talking about hopefully getting the EAD around oct-nov. But, what about the AP? I really want to go home for Christmas to see family and friends and tickets are like $1000 now and will go up in a couple months so I don't know if I should risk it or not... Can we make an inquiry for the AP too?

    I strongly recommend you speak to a lawyer first.

    As far as I understand, the value index of AP is close to 0, because it is still highly unlikely they will let you back in the country before you receive a physical green card. However, it all depends on individual's circumstances, hence why I suggest you speak to a lawyer before booking any flights.

  6. yeah. i can't blame you on that. it's really stressful preparing the documents and we can't stop thinking of our documents once we mailed it - what went wrong what not.. but hey, relax. give yourself a break from the stress and celebrate even the small things like being able to submit it. :) ElliePro is from New York City too if I'm not mistaken. And it took about 5 days after their check was cashed. you can check it on their signature.

    Another August filer here.

    Sent our package Friday, 19th via UPS to Chicago. It was received Tuesday, August, 22nd.

    Still nothing, of course. Check wasn't cashed either.

    I know, it's very early still, but my panic mode is on (I'm freaking out that I forgot to sign something or to include an important evidence or that they lost my package altogether :crying: ). Hopefully, I'm wrong!

    Is anyone here from NYC (sorry, I didn't read the entire thread)? If so, how long did it take them to clear your check?

  8. Second best option : FIle in NY, move to Denver, File 865 and AR11. Its not a big deal - After you receive the address change confirmation mail at your new address, schedule an infopass appointment at the Denver field office and check if they got all the updates correctly. You need to verify if the jurisdiction on the application has moved from NY to Denver. You are most likely safe this being so early in the application process.

    Edited to note that if you're planning to move within the next month or two, I would just wait to file until you move, since there's a chance that you mightn't even receive a receipt number for your application by that time, which makes the Change of Address a lot trickier.

    I thought NOA's arrive pretty quickly?

    Anyway, even if we move, there will most likely be somebody we know living in the apartment, so, hopefully, he'll forward us any important mail.

  9. You can certainly do that, but I wouldn't recommend it.

    All it takes is one notice of action that isn't forwarded in a timely manner (e.g. biometrics appointment letter, interview letter or RFE), to have you possibly forfeit a decent amount of money and potentially months of wasted time. It could be something as simple as your tenant taking a 2 week holiday, or forgetting they'd placed your letter under a pile of junk mail they'd also received during that time.

    I can guarantee you USCIS will have zero sympathy for you if this were to happen, and you would have to re-file from scratch.

    We'll probably file from here and then change the address by filing AR11.

    My husband and I currently live in New York. But he may get a job offer in Denver, and we would really like to move. We recently got married, and almost have all necessary documents ready to file for AOS.

    However, we have some concerns:

    As far as I know, the wait time is few months longer in Denver USCIS office versus NYC USCIS office.

    Can we keep our NYC address on file during our application, have new tenant (we plan to sublet our NYC apartment) mail us all official correspondence and fly in when needed (for biomerics first then for an interview)?

    Or is it not a good idea, and we should either file everything from Denver or go through the change of address process once we file everything from NYC then move?
