Also, consular officers can cast doubt about a bona fide relationship between finance and fiancée but they can't stop you from getting married and can't say your marriage is fake especially having already been through the I-129 process and having had a child with your fiance. So you will have enough evidence to show proof your relationship. Just have to pray and hope the waiver gets approved as you proof hardship. Raising a kid without the father is already hard and they should know that. I wish you the best in whatever choice you take. I would try to get started ASAP.  God bless your effort. 

    yes thank you for all the support. We've decided to get married in Australia while I'm visiting and file an I130 along with the waiver. We're going to go ahead and do it with a lawyer this time just to make sure we do everything we possibly can. I really hope you are right about the wait time but I guess we are just going to have to be prepared for the long wait.

  2. Well I spoke to a lawyer. It's looking like my best option is to get married, withdraw the I-129 and reapply with an I-130. And yes I would still have to file the waiver anyway, but getting the waiver approved is apparently unlikely if we're unmarried as I now have to prove hardship for myself and our daughter without him here. So I'll be starting the process again from zero :( this is so defeating. We've already waited so long. 

  3. My fiancé was denied. He was given something called a refusal worksheet and denied because he was arrested once almost 10 years ago. They said that he is eligible for a waiver, but I don't know what that means. Now we need to see a lawyer and figure out what's the best move. Spend a ton more money that neither of us have on a waiver. Or get married and spend a ton more money on a new application. Which it seems could still be denied if we don't file the waiver anyway. So now we have to start all over again and have an indefinite wait time. There are millions of fathers who have the ability to raise their children and choose not to do so. My daughter is an American citizen with a father who wants nothing more than to be with her, and her government won't allow that to happen. I can't understand it. 

  4. My fiancé is flying to Sydney tonight for his interview on Tuesday.... I'm sure a lot of people are following the trump immigration ban. I'm wondering if it will have a wide spread effect. I know it's banning people from majority Muslim countries but it seems like this might make immigration tighten up its borders all around. I hope this doesn't effect him. I'm so worried now... idk if we can go through this process again if he gets denied.

     

    is there anyone else still waiting for the interview? Or worrying about this? I can't really find any info on how it will effect K1 visas. I know many of you are already together in America. Hopefully that will be us soon too.

  5. I haven't checked in for a while but I'm so glad to see all the progress on here! It seems like things are really moving forward finally. Congrats to all of the newly weds and the newly approved visas. And for those of us still waiting, good luck! Unfortunately my fiancé has his interview on January 31. Hopefully this will be the last Christmas we spend apart and the only Christmas our daughter won't be spending with her daddy. Im sure everyone is looking forward to 2017 :)

  6. They said we MUST submit all documents.. wedding invitations... etc.. pictures with the kids.. as of know their decision is a denial. unless we submit all documents. I don't have all documents... i don't have pictures with the kids.. i don't have wedding invitations because we were just getting married just the two of us.. this is not my first marriage and we are not doing it with other people..... i have other items on the list (wedding ring pictures and receipts) wedding outfit, reservation at the place that we will marry, etc.... but i don't have everything... :(

    Oh no! So sorry to hear this :( I wish I had some advice to give you. But I'm sure someone on here can give you better advice on a different thread. I know how difficult it must seem right now but it's not the end, just another speed bump on a very long and bumpy road unfortunately :( there is always a solution. You are clearly in a real relationship, it sucks that it just depends on one outsiders perspective to determine that or not... This is probably the last thing you want to hear right now but try to stay positive.

    Thank you! I have no idea what I was looking at but it wasn't that page... but we finally received the email. Interview was scheduled for January 31st! Ugh I just feel so useless being so far away from him and trying to help him prepare from over here. Luckily he's got most of his documents ready so I just need to send my affidavit of support and revalidation letter. This website has been so helpful and everyone has been so supportive. I just want to thank everyone on here, it's nice to have other people who know what you're going through. Hopefully this waiting will be over with soon for us all.

    In the meantime, I'm trying to get some information about how the consulate stage of this process works. My fiancé already responded to an email from the consulate requesting the following:

    My question is, what's next? we paid the fee already, scheduled the medical for next week. Is this the packet 3? What is a packet 3 and 4? Is the next email they send going to inform us of his interview date? When do they provide him with instructions about what documents he needs to bring? We are so confused at this point. He hasn't heard anything else and I don't know what else I need to send him along with the affidavit of support documents.... I don't want to spend the money to send him that alone if there are other documents I might need to send him....

    I know this is all country specific but I don't know where else to ask and all the info I find online is just confusing me more....

  9. If you're talking about your account on https://cgifederal.secure.force.com you can go to 'Update Profile' on the left sidebar and you should be able to change the DS160 number there up to 2 days before the interview date.

    Then you can re-print the interview confirmation letter.

    Yes that's the website. I checked the "update profile" tab but it doesn't show any DS 160 number.. only the case number we received from NVC. I had updated that already but the payment receipt bar code has the DS160 confirmation number from the visitor visa that was denied....

  10. I would just try to contact them if the confirmation number is EXACTLY the same one you received before.. mine was different. We got the confirmation letter with the interview appointment details and the number on it is different than any previous numbers we had received (we tried for many travel visas - all denied).

    Oh ok! Well that makes me feel a little better. I'll definitely give them a call to double check though. Thanks a lot!

  11. Hi, We had the same issue in that my fiance already had a profile. When you go into travel docs you have to click "new application" at the very top of the list on the left side so enter in the new DS-160 number. I think you might be able to cancel that one out and redo it under a new application.

    I clicked on new application and most of the info was entered already from before, the only thing we added was the case number from NVC and the priority date. There was no section asking for a DS160 confirmation number at any point :( I went ahead and sent a message using the "provide feedback" tab but not really sure what else can be done at this point. Thanks anyway!

  12. Ok update, my fiancé had a profile on travel docs already from when he applied for a visitor visa. The system wouldn't allow him to make a new profile, so he used the one he had already. He chose "new appointment" K1 and entered his SYD case number and paid the fee. The form never asked for the DS160 confirmation number. But after the fee was paid, it provided him with a receipt that had the DS160 confirmation number from his visitor visa that was denied 6 months ago! It's a different number from the one we just completed this week. Ugh, idk if anyone else had issues with this website. I really hope this doesn't somehow delay our process, not sure what to do now

  13. Has anyone else had trouble paying for the visa fee online? I'm trying to pay online with a credit card but it keeps taking me back to the message about non refundable fees. When I click the confirm button it tells me to choose between Australia post or a credit card to pay. Clicking on either option only takes me back to the nonrefundable fees message! It's on a loop... I can't figure it out. Any ideas on what's going on?

  14. Hi! I hope everyone is having a smooth process so far. We are trying to get the DS 160 filled out while we wait for the case to arrive at the embassy. If I am not mistaken we do this on usatraveldocs.com right? He already has a profile with a lot of the info filled in already but the first page is asking for a priority date... can anyone tell me what this is? I checked the NOA 2 letter and it has an empty box for priority date.... not sure what I should enter and I don't wanna put the wrong thing

  15. I can't believe my guy's interview day is here. It'is 1 hour and 10 minutes...?

    He booked a ticket for November 16. We're hoping he can enter with a K1. Fingers crossed!!!!

    Good luck today! I hope we start hearing about a lot more approvals soon from everyone.

    Our NOA2 is dated October 12 so it's probably still a bit too early for NVC to have it, but I've called a few times today and gotten an automated response that all of the representatives are busy :( guess I'll just have to try a bit earlier in the day tomorrow haha.

    We're planning on doing a small courthouse wedding and then just a small celebration with family and close friends at home. Down the road my fiancé want's to plan a bigger ceremony but for now we're happy to just make it official :)
