  1. Hi, I am a US Citizen (Derivative) already with a US Passport. I just need a Certificate of Citizenship because some processes like obtaining a Dual Citizenship from the Philippines requires a Certificate of Citizenship. I was wondering if I still have to submit my birth certificate and parents along with their marriage certificate.

     

    A bit of background about me: My parents and I were not born in the US. I automatically became a US Citizen when my mother naturalized. My dad was already US Citizen before my mother and siblings arrived in the US. 

     

    Would sending them my US passport and parents Certificate of Naturalization suffice?

  2. I received a N-797C Rejection Notice for my N-400 (Application for Naturalization) stating that my payment was incorrect or has not been provided. I submitted I-912 (Request for Fee Waiver) along with my N-400 and no box was checked “For USCIS Use Only” whether fee waiver was approved or denied. No mention on N-797C as well, why I-912 was denied or if lacking documents. I believe the USCIS agent overlooked my I-912 which I even listed in my cover as being attached. As of now, I too am qualified for the means-tested benefit, not just my wife which she was only listed on the old form. Can I resubmit my N-400 with my old I-912 and a new one along with a check just in case it doesn’t get approved. I’m strongly confident I-912 will get approved since I have all the supporting documents. I’m just afraid to pay the new fee which is $1,170 since October is just around the corner so I can’t afford to mess this resubmission up for it to be rejected again. I will then end up paying the new fee. Thanks in advance for your input.

    Also hoping for the interview to be waived, as I really think that we submitted more than enough evidence, both times. 

    Wondering if the case will move from NBC to local office or how does that work... 😕 ?

    I’m in the same situation. Filed October 2019, case ready for interview June 2020. I doubt your interview will be waived that is why your case is ready for interview instead of card in production which is the status you receive if your case was approved without interview.

    Here’s the story:

     

    My husband has his conditional greencard, we had been living in California where I am from. We moved for one year to Las Vegas to be close to my mom during pregnancy and infant time and because in Nevada we could afford for me to take a year off of work with the baby.

     

    We are happily married but of course have gone through struggles and arguments. We had our worst fight ever about 7 months ago and I stupidly (so freaking stupid) called police. I found some messages I didn’t like, flipped out, got in his face, he got in my face, I called Police, it was a very emotionally charged event and I thought the police would come and help to deescalate the situation and ask one of us to leave for a while. That’s what happened to friends who had been in similar situations. But what I didn’t know was that in Nevada if police get called for a potential DV situation someone HAS to go to jail. So my husband was arrested. They asked me to give a statement and I basically said what I’m telling you. Never said he was the aggressor, said I initiated the fight, etc. he was held for a day until he could appear before the judge (I think it was Sunday that’s why it took so long). I submitted an updated statement emphasizing my previous statement that he was not the aggressor, that he is not violent and that I am not in any danger. 
     

    The judge gave him a standard first time offense pre-trial intervention with no contest plea for misdemeanor domestic battery. He paid a fee of $300 and does online classes. Once he’s done the case will be dismissed. We will get certified court copies of everything and then seal the case. 
     

    We have to file I-751 by the end of February which is before the classes will be done and the dismissal complete. I know that we still have to file on time and that the case will be pending until we can submit the certified case info with final ruling.
     

    I’m just terrified that he will be denied because of this. We are very happy together despite having had this low point. We own businesses here, we are planning for a second child, we’re saving to buy a house next year. It would be absolutely devastating.
     

    Has anyone had a similar situation and been approved? Or been denied and sent to immigration court and won there? How long does it take to get a court date for immigration court? Has anyone been denied at immigration court and then successfully won by filing a financial hardship waiver? 
     

    Some other info:

    - we are back living in California

    - no contest and the dismissal will still be considered conviction in the eyes of immigration as far as I understand 

    - the max penalty for his charge is 6 months in jail (not that he was given that). I mention this because I’ve read that deportable crimes are ones with a max penalty of 1+ years. 
     

    Anyone gone through this? Thanks in advance. 
     

     

    My friend had a similar situation but she was the victim and her husband , US Citizen, was the perpetrator. There was still an open case against him. They went to the interview with their four children. Th officer first talked to their lawyer and without even initiating an interview, they were told to go home. They didn’t know what their status was and the lawyer said she needs find a way to drop the charges. She tried but it couldn’t be reversed. While waiting months, she finally got a her 10 year green card in the mail. Having children together is big proof that your marriage is bona fide. My other friend, he was awaiting Naturalization and with a criminal record of theft and he is now a US Citizen. I really advise you to hire a lawyer since your situation is complex.

    I’m not sure if we’ll get an interview, but I was just basing it on what JessieABC said. But I guess it’s a good thing if we do, because those who were scheduled for an interview right away received their 10 year green card in approximately 6 months.

    Our receipt number starts with MSC so that means we’ll need an interview 😕 Anyone here who sent in their I-751 to a Dallas, TX whose receipt number starts with something else other than MSC?

    As for your other questions, you will send the evidence with your package. If you’re filing July 2019, you should have your 2 years of taxes to include 2018. What did your spouse file for 2017? Your spouse still could’ve file married filing jointly even though you weren’t working. At any rate, you can only send what you have🤷🏽‍♀️

    My wife and I both arrived from the Philippines on October 19, 2017 since she petitioned me through Direct Consular Filing. We came late in the year of 2017 and did not work right away so we didn't file a tax return for 2017.

  11. Anyone here who filed Form I-751 online? I will be filing jointly with my wife within the 90 day window prior to the expiration of my conditional residence. What is the procedure? How do you send payment or evidence, is it done online as well? I will also only have 1 year of tax return by that time, is that fine since I arrived on October 19, 2017 and only started working February 2018 and will file July 16, 2019. Thanks in advance for your replies :)

If you didn't request to have your SSN sent to your US Address when you submitted D260 then you can visit a local Social Security Office.  You will need your foreign passport with the immigrant visa stamp.  They will ask you to fill up a form then you will receive your social security card a week after.  I opted to have it sent to my address so when I arrived in the US on October 19, 2017, they had mailed me an ss card printed on October 24, 2017.

    If I understand correctly, I need the green card in order to request the SSN, and I need the SSN in order to file my taxes!!

     

    Now what?  Not sure what in the world to do next!

    You don't need to wait for the green card.  If you did not opt for the SSN to be sent to your US address when you submitted DS260 then you can visit any local Social Security Office to obtain a social security card.  Bring your foreign passport with the immigrant visa stamp.  They will ask you to fill up a form then it will take about a week to receive it by mail.

We have to complete the DS160. When will I received the information needed/notification. I keep reading about package 3 and 4.     If you receive a case number, you can proceed in submitting your DS160 so you can schedule an interview date afterwards.  As for the Philippines, you can't schedule a medical exam without an interview date and it should be done a week or two prior to your interview.  You can obtain a police report without prior interview date and mention it is for Visa Purposes.  I don't know if it differs in your country.

    LoL, I was born in the Philippines so I went for a visit 12 years ago so I don't just go to the Philippines for my husband's sake.  Besides I didn't know him them, we just got married this May 5, 2017.  So my purpose for my temporary stay in the Philippines was to plan a wedding, meet the in-laws, and petition him through direct consular filing (fastest route, but need to show 6 months stay) that is why I am here for 8 months.

    Some Consulates are easier than others, I know none of that would fly in Canada for example. Check what others doing DCF have been able to get away with in PI.

     

     

    I've only been here in the Philippines for 8 months and the last time I visited was May 2005.  Serioiusly, do they think I would petition my husband and pay all those expensive fees if I don't intend to leave from here.  I'd be an illegal citizen in a third world country when I am a Citizen of the US.  Plus, with border patrol officers, they won't let my husband enter without me being in the States first...LoL!
