I 134form (Multiple Merged threads)
HandmadeTurnip replied to Thecorkman's topic in K-1 Fiance(e) Visa Process & Procedures
Once the I-129F is approved and forwarded to the NVC, USCIS has no further part in the process. Not until you get married and file for Adjustment of Status anyway. -
There's a lot of contradictory information here. What visa did she last use to enter the US? And has she overstayed her current visa or not? Regardless, I don't see a way for her to get a green card unless you marry her. She'll have to return to Colombia, either now or at the end of her studies, depending on the conditions of her visa.

This is the second time you've posted a vague request for information about a visa category while providing no context whatsoever. You'll need to ask more specific questions if you want people to actually help you.

I-129F K-1 Visa Pakistan
HandmadeTurnip replied to MohammadBHussain's topic in K-1 Fiance(e) Visa Process & Procedures
It's your state of residence that matters, not the state where the marriage took place. From the USCIS policy manual: USCIS does not recognize the following relationships as marriages, even if valid in the place of celebration: Certain marriages that violate the strong public policy of the state of residence of the couple -

From their post history, it looks like it was for a DUI. -
Abandon K1, marry & AOS
HandmadeTurnip replied to Nbc16's topic in Adjustment of Status from Work, Student, & Tourist Visas
That won't be an issue, your intent was established at the border and you had no plan to stay and adjust status at that time. -
Abandon K1, marry & AOS
HandmadeTurnip replied to Nbc16's topic in Adjustment of Status from Work, Student, & Tourist Visas
Yes, you can go ahead and file for adjustment of status if you want to. Presumably you're also aware that you won't be able to work or leave the US for several months? -
USCIS
HandmadeTurnip replied to Vanessa akowe's topic in IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports
"Hope for approval sometime soon" is not the same as "you will be approved soon". No one can tell you for sure when you will be approved, they're just saying not to pay too much attention to that generic USCIS message and to be patient. -
B1/B2 visa approved but my partner got denied.
HandmadeTurnip replied to SJSC81923's topic in Tourist Visas
I think it has had the opposite effect. -
Well that would be a lot easier than going through with the visa interview, it only takes a few minutes to find out if you're approved. You didn't answer Boiler's question on what your other citizenship is though.

Have you tried applying for an ESTA since becoming a Swedish citizen?

I'm honestly surprised that in the 2+ years you've been preparing to file the I-130, you haven't come across the differences between CR-1 and IR-1. Also, there are some discrepancies in your post history as you previously said you got married in October 2020, not November. Make sure your husband knows the correct date when it comes time for his interview. But to answer your question (and as others have already said), you don't choose which one to apply for, it's automatic. Your husband will be issued an IR-1 visa as you've already been married for two years.

Well there's a very easy and obvious way for them to avoid it.
