  1. I got the email. My greencard is being produced!! I am soo happy and excited. The LIN number ahead of me changed on Friday (card is being produced) and I was feeling a bit low because of that. Lo and behold, my status changed today!

     

    I filed 26th Dec 2018. They received it 31st December 2019.

    I got a RFE in Oct, which I replied within a day or two, and they received it on 28th October.

  2. I wanted to start a new topic to see how the post RFE USCIS progress is going for people who filed in November or December 2018.

     

    USCIS received my I-751 on 31st December 2018. On Oct 17 an RFE was issued to me. I sent it back on Oct 23, and USCIS received on on Oct 24 2019. My case status hasn't updated yet to show RFE RESPONSE RECEIVED. Hoping to get approved soon.

    Anyone else here (November/December 2018 Filers) that has responded to the RFE and has heard back from USCIS and/or gotten approved?

     

    My service center is Nebraska.

    How long after receiving RFE did USCIS update its page?

    I received and RFE on Oct 21, and USCIS received my response on Oct 24, 2019. The old case update website for me still says RFE sent, while the new myaccount.uscis website says they don't need anything from me. The new website never update for me ever.

    Background:  we got the notice late.     Looking  across several sites, the common theme was people went to the nearest ASC with their original notice.  They just got their fingerprints taken as usual.  It’s quick and done rather informally.  

     

    Same with us-we went in, notice 8 days late.  You’d never know it.  everyone just looked to see that we had a notice of appointment at all.  The ASC has a no-walk-in policy by the way. But no one asked why we were late. We were just given a form, asked for ID, and then the prints/photos.

     

    I stressed a bit fir two days as we all do with any detail not taken care of.  I also wished I hadn’t seen so many things written on the subject by people with no clue.  

    Just out of curiosity: Did you let USCIS level 2 rep know that you received the notice late? Or filed an official inquiry/complaint? I'm just wondering if this will be an issue down the road.

We have pictures with people at the wedding we will send that, and we had sent affidavits before but we can add more. I don’t have the letter right now is at home and I’m at work, but one paragraph talked about children that we don’t have, and the other one said lease bank accounts will etc... and we Can write a detailed letter as well...I just need to breathe through this!

    Your current goal is to provide sufficient proof to USCIS that your marriage was entered in good faith and that you have remained in a bona fide marriage for the entire 3 years or so. What exactly does the RFE ask for? This is your chance to provide USCIS evidence that your marriage is real and genuine. Go line by line on your RFE. Provide EVERYTHING they ask for unless you don't have it (Child for e.g.). Then write a letter explaining why you are unable to provide what they ask for (Don't have a child, dont have 401k from employer, was not on an official lease but affidavit from landlord attached, etc.)

     

    You have to provide proof of cohabitation. How did the rent get paid? Did you both pay your friend rent, or just you/your husband? Did you write a check to your friend? You could include proof of payment(from your bank statements) that rent was actually paid.

     

    You recently went to a wedding. Do you have pictures with other people there? Can the bride/groom write an affidavit. Mind you, affidavits are nowhere near as good a proof as financials/comingling (lease,mortgage,bank accounts,401k,life insurance, health insurance).

    I sent our joint car insurance, joint health insurance, 2016 and 2017 taxes, my health insurance showing him as a beneficiary, we sent copy of our drivers licenses with same address on it, I also sent 2 affidavits from friends and pictures. 

     

    Now they are requesting more on the financial side, they want lease joint accounts a will etc...and we don’t have that! We don’t have much money we don’t travel we camped this summer and we went to a wedding together out of town I have pictures to send not a plane tocket

    we have taxes for 2018, we changed car insurance companies we got that as well, my friend will write a letter that we were living with him, my husband has worked under the table for the last year and we just bought a home that only under my name since he didn’t look good on paper, he just got a new job and we are waiting on his credit to recover to add him to the deed and the mortgage, should I send a letter explaining that? 
    I’m so frustrated they can come over and join us for dinner if they want I have nothing to hide but now I don’t know what to send!

    my friend said to join accounts at the bank add both names to utilities and send that  with the rest of the stuff we have and hope for the best?  but I want to cry 
    We are planing on going on a trip next may but of course I have no tickets yet to anywhere 😫😫😫😫

    You can't go back in time and create what you don't have. Just worry about what you do have, and provide all of it. We all freak out every-time we have to interact with USCIS. I too am freaking out what they'll do with my RFE response that was delivered 6 days ago.

     

    If he's not on the home mortgage, is he on the insurance for the house? You could send that document, along with a letter explaining why his name isn't on the house mortgage.

    Explain how your finances work in the letter you write. Include checking account showing transactions of you paying rent/mortgage/bills.

    You could add his name to your utilities. My spouse and I don't have both our names on any utilities, although she gets the water/trash/sewer bill in her name, and I get electric and internet. Do you have any bills like that?

    You could add each other as authorized users on credit cards.

    Did you you both get an invite to the wedding? You could include copy of that invitation.

    Do you guys have a 401k or something? If you do, you could show documentation that you are each others beneficiary.

    Did you send health insurance for all the years you were married?

    State/Federal tax transcripts from IRS and state tax authority?

    Children as a result of marriage

    • Copies of their birth certificates bla bla bla. We don't have any kids

    Evidence you and your spouse have resided together and share responsibility for a common residence such as:

    • Leases in both names showing joint residency Sent
    • Deeds and mortgages in both names We have none
    • Auto finance, title or registration No auto loan. Title in my name only. Sent 3 years auto insurance documents.

    Evidence you and your spouse have combined financial resources or joint ownership of assets and responsibilities for liabilities such as:

    • Checking, savings or investments accounts showing transaction pages Sent only joint account statements for 3 years (Savings account. Not much activity. Usually just incoming deposits)
    • Property., life insurance documents Sent
    • Federal and State tax returns Sent IRS returns for 2016, 2017, 2018. Forgot to send MN State returns.
    • Utility bills; or Sent
    • Loan or credit car account statements We have no joint loan (She only has student debt. I have none)

    Evidence you and your spouse made estate, health and financial planning arrangements with each other such as a will etc. We're each others life/disability insurance and 401k beneficiaries. Sent.

    Any other relevant documents not already mentioned. Pictures of travel/ with family, Certificate of Rent Paid 2016, 2017, 2018. Travel tickets, visa, hotel bills. Spouse's sister marriage certificate (I was one of the witnesses). Also slipped in a $100 to "thank" the officer for his/her time.

We dont mind doing it at all we just dont want it to look worst if you know what i mean? I also have tons of pictures from this summer weddings we attended etc that im planning on sending but i think we dont have enough of what they want and I want to get this moving asap since its already taking sooo long. Any advice is much appreciated 😃

    Did you send them proof of car/health/life/renters insurance all the way back to your marriage? You don't need to send them every month's statement, but every other or once a quarter should be enough.

    Do you have any proof of travel together? (tickets, hotels, airbnb, uber, visa etc)

    Have your friend write a letter stating you were renting from him and the dates.

    Send 2018 W-2, tax returns from IRS. Did you send the IRS tax statement for 2016, 2017?

    Do you have medical bills or any other stuff being delivered to the same address for the past 3 years? Send some proof of that.

    Does your drivers license have the same address? send a copy of it for both of you.

     

    I'm in the same boat as you. We got a RFE a couple of days ago and I sent them additional info. We don't share joint checking accounts or phone either.

    Yeah, I suppose at this point I am just looking to see if this is enough evidence. We do share the same residence, plan our life together, and share life experiences. The only thing is that our finances are perhaps a bit unorthodox. Most couple's (I think) use one account and pay for things from there. We don't do that, so that's what I was mostly concerned about. She pays some of the bills (which come in her name) and I pay the others.

    I am hoping for a reply from USCIS soon. Hopefully they won't deny the petition and deport me.

    I applied for my i-751 on Dec 31, 2018. I had my biometrics done in June 2019. On Oct 21, 2019 I received a RFE stating that " the documentation submitted is insufficient because it is not enough to demonstrate that you and your spouse have remained in a bone fide relationship since your marriage.." We had submitted the following with the initial application

    • Lease agreement from July 2018 - July 2019
    • Auto insurance
    • Wells Fargo Bank statement from our Joint saving account (very little activity here, less than 15 transactions a year. It's our "rainy day" fund)
    • Health Insurance (2016, 2017, 2018)
    • Joint Income Tax Returns (TurboTax copy, not IRS) 2016 and 2017. Plus W-2 for 2016 and 2017
    • Energy Bills (water, sewer, trash in my spouse's name)
    • Internet Bills (in my name)
    • Travel (several flight tickets and visa)
    • Photos (starting from when we started dating in 2012 to December 2018. About 25 pictures)

     

    We do not share a joint checking account. We've been dating since college, and it just works best for us to keep our finances that way. I pay for rent and some utilities, spouse pays for food, and insurance.

    We don't own any property. We don't have phone bills together (I use the company phone). We don't have any memberships anywhere (I'm sure Netflix, hulu, and HBOnow don't count). We don't have any kids. We don't have any loans/debt either jointly or otherwise.

    We've been together for 7+ years, married for 3.5 years. Met in college. My case number is LIN19901727XX

     

    I replied to the RFE in a day with the following:

     

    • Signed letter from the apartment management company stating he has us as residents since Jan 2016 (couple of months before our marriage) to August 2019. We lost our copy of the lease, and apartment management company didn't want to dig through their paper records in their offsite storage location (lazy), but agreed to send a signed letter on company letterhead.
    • Apartment lease acceptance letter, signed by property manager, stating our lease has been signed, accepted, and executed, and what our move in date is for 2016 and 2017. (2 letters; one for 2016, one for 2017 when we renewed our lease)
    • Complete lease from 2018 - 2019.
    • Certificate of Rent Paid received from MN state for 2016, 2017, and 2018. (showing both our names)
    • New lease signed from August 2019 - July 2020.
    • Water/Trash bills in spouse name for 2 years (24 total. Website doesn't have statements older than 2 years)
    • Internet bills in my name (24 total. Website doesn't have statements older than 2 years)
    • Auto Insurance letters from the company going back to 2016.
    • Letter from employer stating we are each other's beneficiary for Life/Disability Insurance and 401K.
    • Letter from life insurance company showing joint coverage and limits.
    • Joint Health Coverage documentation for 2016, 2017, and 2018.
    • Joint eye/dental insurance documentation for 2016, 2017, 2018
    • Joint Tax Returns from IRS website for 2016, 2017, and 2018.
    • We have two cars in my name. They were purchased before our marriage in 2016. I sent copy of title and explained why they aren't jointly owned.
    • Pictures with friends/family/travel for last 3 years. (30 total)
    • Copy of sister-inlaw marriage certificate (I was one of the 2 witnesses).
    • Travel stuff for 2019 (tickets, hotel bills, pictures)
    • Random assortment of medical bills received at our address for the last 2 years (about 12)
    • Letter, signed by both, explaining why we don't have phone bills together, car ownership together, and why we don't share a CC or checking account. It works for our family.
       

    I did not send any affidavit from friends/family. Personally I think they are worth less than the paper they are printed on.

    I am thinking this is plenty of stuff. I honestly don't even know what else I could send. I don't think we even have anything else. Now, for some reason, I am freaking out that they will deny the petition of send me another RFE asking for something we don't have. I hope they accept the reply to RFE and not waste our time scheduling an interview. I got the letter on Oct 21. I sent the evidence back on Oct 23, and it was delivered to USCIS Nebraska on Oct 24 (and signed by L.Miller, the same guys who's name was on the RFE letter).

    I had my interview in Bloomington MN at 2pm.  I got the approval email next day at 830am.

  15. If you haven't received your EAD card you cannot work. What you are doing is illegal and if you are caught, it can land you in some serious trouble. My suggestion is that you quit your job immediately and wait to receive your EAD card. It takes about 90 days (not including days lost due to RFE) for you to receive work authorization.

  16. I have filed for AOS from F-1(OPT-EXT). I travelled to Karachi, Pakistan for three weeks. At Karachi airport everyone knew what AP is and I boarded the flight to Istanbul, Turkey. At IST, I got an E-Visa through the kiosk and immigration took 10 seconds. When I landed at Chicago O'hare, I went with my wife to the US Citizens line. The officer took my card and passport and took me to secondary inspection and asked me to wait. 2minutes later, they called my name and handed me my passport. There were 30 other people in Secondary so I am sure it takes longer for some people. I am so happy it was an easy process for me.
