Yes, I'm sure they do. I was there a couple of weeks ago. I purchased a two hole puncher and some folders. I was originally thinking of sending each exhibit in separate folders. But after reading USCIS' instructions and your advice, I've decided to send them in as one using a fastener and page tabs to be safe. So I'll head back there and get myself some fasteners, and instead of page dividers, I'm thinking of just using page tabs that you can stick to the bottom of the paper. Will be easier and cheaper that way..lol

That's great then! Lots if luck

  7. 2 minutes ago, cablewyres said:

Oh, I see on your application, you also attached the G-1145. Did that work for you? I heard that it's only for submission to lockboxes and I believe the ROC submission isn't to a lock box. I was wondering if it still works anyway. It would be convenient to get e-notification from the get go of the application.

I don't think it worked🙄 I haven't gotten any response from them yet and they have my application since July 26th...

  8. 1 minute ago, cablewyres said:

Got it! Tanks for the tip. I did read another couple's post whose application was approved and they punched holes into the their I-751 form. So I think I'll just go ahead and do that as well to ensure that the form doesn't get separated from the rest of our application. Thanks again!

Yup! That was my idea too...not to have the form separated;also the package looked much better without the plastic cover that was sticking out a bit.

One more thing, do you know for sure that home depot has fasteners and tab divider pages?

  9. 2 hours ago, cablewyres said:

Thank you so much for the response. It truly helps. I can just run to Office Depot and get fasteners and pag tabs then! Wohoo!

I do have another question, did you submit your documents by punching a two hole punch on the I-751 form as well? or did you put it in a clear plastic and punched the holes only on the plastic cover as other people have done to not tamper the form? Thanks

I did the two hole punch in every document I submited. Initialy, I put the I-751 form in a clear plastic cover but I saw other people sending their forms being punched and nothing bad hapened and changed my mind.

Unless you are sending one of your personal original documents, I think there is no reason for a problem to arise if you punch the forms or affidavids.

Good point regarding all the other evidence you submitted. Will look to see what secondary evidence we have.

As as far as cohabitation, is that in reference to “living in the same home” together or sharing a life together? What other documents can one show that you live together? Other than licenses, mail, etc. To me, bills don’t show that people live together but rather that the bill is in a person’s name. My husband and I do live together😊, it’s just that I was already established so that shouldn’t be a negative  in USCIS’s eyes. But of course I don’t work for them. Lol So I was hoping the documents outside of financials and the pics would show a life together.

Ok, so when I say proof of cohabitation, just mail at same address does not necessarily make it as living together. From what I understood, uscis wants to see something more relevant like: mortgage, rent, lease in both names.

If you do not have this for example and you are living with a relative/parent/friend that owns or rents or leases a proprety/apartment, then you should get a notarized statement from that person, along with your full explaination of the situation you are in. Just be onest with them.

If that's not the situation for you either, then you should explain it per example why is the place you live in and all the bills on your names only. That is it.

Of course that mail, DL's and other documentation with both having same address sustain your case. Just make sure you first explain why your case is like that.

Regarding your evidence for ROC, uscis wants to see primarely proof of financial co-mingling and cohabitation. I can see that you pretty much have everything. Just make sure the evidence you submit covers the period since you got married up until present day(where you lived, accounts opened, statements, all tax years etc).

As proof of financial co-mingling  and cohabitation you have options like:

    • joint bank accounts

    • joint ownership of car, house, land etc

    • tax returns filled as married(you do not need to send w2's, but if it makes you more comfortable, you can do it)

    • Mortgage, rent, lease or any other proof that you live under same roof

    • health insurance showing both covered under same policy

    • life insurance showing the other spouse as the beneficiary of the policy

    • retirement plans

    • power of atorney documents

    • wills

    • auto insurance under both names

    • utility bills like electricity, gas, water, internet...under both names or certain bills in one name and certain bills in the other name showing same address

    • phone bill under both names or has both phone numbers enlisted in the plan. You can include some random history activity on the account between the 2 numbers that shows voice and message records.

    • any type of active memberships that you have on both names (gym, botanical gardens, clubs). I included copies of membership cards that had our names, picture and other specific details.

    • proof of trips you went or plan to go together

    • affidavids from people you both know and have personal knowledge of your marriage(many people say they are not required. I say, if you can have them, send one or two, if you are in a position that nobody is available or you just dont have that many friends, don't worry about it. It is considered secondary evidence, so it does not hold much strength if not accompanied by the above mentioned proof)

    • mail, cards received and/or send with both names on the receiver/sender

    • proof of gifts - if names or information of the both are shown

    • pictures(make sure to write details like: date, place and people in the pics)

Hopefuly I was of help. This was what I could come up at the moment. If I am remembered of something else I will let you know.

    Good luck with everything!

No worries. It is still very helpful. And I understand as I’m in the same situation. I already had my home and utilities as well as insurance through my job. So it may seem one sided as he doesn’t have insurance through his employer. So I’m gathering all of our evidence as well. No RFE would be super awesome!! Good luck! Here’s what we have so far :

    • both drivers licenses showing home address

    • copies of joint tax statements for previous 2 yrs

    • monthly copies of statements of joint checking account, Dec 2016-July 2018 showing direct deposit for both of us and payments of bills and other daily uses

    • copies of joint savings account, month account was opened and current statement

    • quarterly copies of joint credit card (quarterly bc we hardly ever use)

    • designation of beneficiary for insurance and TSP (401) through my employer

    • 1095B for Health coverage through my employer

    • car insurance policy showing both names

    • quarterly copies of cell phone bill showing both names and frequent calls to each other

    • boarding passes and car rental agreement from vacation trip to Jamaica in June 2017

    • copy of flight info from when husband flew to Nashville to drive my daughter home, she was there for summer  internship

    • copy of rental agreement for apartment for above internship - showing checkout date same as his flight info

    • copy of info for upcoming cruise

    • copy of medical records from reproductive clinic for testing for possible IVF treatment

    • 3 affidavits from my family

    • photographs from marriage until now of us and with family and friends

As you can see it’s not a lot. So I'm trying to be creative also.

You have pretty good evidence here. Uscis wants to see mainly financial co-mingling and cohabitation proof. Everything else is secondary but not unimportant; they can built you a strong case if you lack in other areas.

I see you have the financial part ready; what about cohabitation? Mortgage,rent,lease...living with relatives? You have to prove you are living together at same residence. Whatever it may be the situation, you have to explain it.

Be sure to include evidence from the time you got married.

For example, if you married in 2015, you should include taxes begining with that year. The tax transcripts will give pertaining info such as married filled jointly/married filled separately.

Bank statements on the joint account should start also from the year you got married or the year you opened it/added spouse as joint owner. I got letters from my bank statting that we have the certain accounts open and active since certain date and we are both owners ot the respective accounts.

Just a side note : any type of insurance, car loan, account should not be mentioned or brought to attention if it does not have both names on it or it does not reflect your co-mingling or being together. With the exception of bills that can be in one name or the other. There are cases where one piece of evidence can bind with another one to give the full picture, just make sure that connection is properly presented in a cover letter.

Anything that has your guys name on it can be sent as proof. It may be of lesser importance but every bit counts.

Also a few questions on the I-751 Application on the evidence...

    1) As I understand it, I only need to send the IRS Transcripts, but why not also include the jointly signed 1040s?

    2) On each page of evidence, on the bottom, I plan on writing my wife's name in the form of Jane V. Johnson, A# 123-456-789... or should I put it as Johnson, Jane V.

    3) Do I need to include the entire phone bill(s) to just show we call eachother? T-Mobile tends to also include pages of pages of Data usage...

    4) Would it be better for me to put Notarized Affidavits ( they're already notarized!) towards the front or the back? Meaning, all financial stuff with financial stuff... Right now I have taxes, then affidavits, then the rest of the financial statements, etc.

    5) So I currently make payments on my wife's car, but her name is not on the title - because with her not on the title - 0% interest. If her name was added... 5% interest. Do I need to explain any of this?

    6) Let's pretend I have another legal name, like say Johnsie ( let's say it's like Bob vs. Robert ), that I have a few accounts use one or the other. Do I need to explain this at all?

Thanks in advance for your help.

I first have one question for you : The names, addresses and/or personal data like A# are the real ones? If so, not too good idea to make it public.

    To answer your Qs:

1.If you feel better to send the 1040 form, you can, but the tax transcripts for the years since you've been married is plenty(it should reflect you guys as married filled jointly or separately, but not as filling single)

    2. You can write just the A# as it contains all the info, that's how we did it for when we went through the visa process(now for the ROC we did not put it anymore even though I wish I did🤔).

    3. When you say entire phone bill, how many pages are you looking at? Are they numbered like  "page 1 of 10"?

If there aren't many pages and they are numbered, do include them, you have nothing to lose. If you have like 80 pages as I did, feel free to skip the unimportant pages(my opinion only). I included only pertinent info in our "extended" phone bill.

    4. As for Affidavids, if you feel they hold more weight and importance in their contents, you should place them anywhere you see fit. I placed mine in-between important documents such as tax and bank. For us, one of the affidavids(more like a notarized declaration), had pertaining info regarding our cohabitation at same residence. Our father/in-law wrote the declaration stating that we lived on his property since my arrival in the US and because the house is in his name, same the utility bills, we do not have evidence showing this certain info.

    5. If any piece of evidence you want to submit as part of ROC do not show co-mingling and cohabitation is better not to send it. Why do you want to send payments on your wife's car? Is her name and yours on same document regarding the car? Or the card you are making the payments with is a joint account?

    6. From my point of view regarding the names(if I understood correctly), in the form I-751 there is a section where it asks you if you use or have used other names than the one enlisted first in the US citizen spouse biographic info. If you complete the form with the things it asks you, I do not think it is necessary to give an explaination to why you have a different name.

    Few other things I noticed:

    A. Not advised to send original marriage certificate. On the USCIS website and on I-751 form instructions they suggest you do not send any original documents unless requested. I know people here on vj that did send the original and they got it back luckily. I only sent a copy(even though some people say its not required)

Note that affidavids, notarized papers or other required documentation specifically issued for the purpose of the ROC package(declarations, translations, police certificates etc) should be submitted in original form. Do make copies of the entire package before sending it.

    B. Enlist the years for the tax transcripts(ex: "2015, 2016 and 2017 tax transcripts showing married filling jointly/married filling separately)

    C. Your table of contents show only the exhibit name and not what is included exactly; do you have a more extended form or you intend to send it like this?

The reason I am asking this is that when I look at your cover page/table of contents, I do not have an idea of how many documents I will have to look over. Example: how many affidavids do you have? How many documents relating to car, house, insurances, bank..etc.

I know you may want to keep it simple but an ample description of what your package actually contains may be easier for the person analyzing your case and makes it less probable for documents to get lost or just skipped.

Hopefully I was of help and not offended you. What I know is from reading lots of threads here on vj and getting help from other great members.

Best of luck with your submission.

How did you manage using a fastener to put all of your documents together (being that thick)? I’m about to put together our documents for ROC as well and figuring this out. Thanks :)

It fit no problem...it was just perfect for one fastener. I initially used two fasteners and split the package, but then I realized that I may be good with just one since the wings of each fastener were pretty long. It may look thick but it was only 1.5 inches and 3lb.

My table of contents my look long and detailed but the amont of paper is not that big as others may think. I saw people here on vj that had 5 to 12 lb of paper. One very good example is the pinned thread of CookieCat member which was my main guide in asembling the ROC package. You will see the similarities.
