  1. well mine is filed by my lawyer march 28, 2016 then receive the receipt april 1. april 6 received rfe and april 18 lawyer responded and in april 28 got approved.

may 13 it was sent to nvc and in june 6 i received a welcome email with invoice

I think your petition was approved really quick. I do not know the average time for these type of petitions to be approved but it was quicker than my petition.

I filled a I-130 petition. This has the average time of 5 months until it gets approved. Mine took 141 days(i am happy case I've seen cases where it took up to 200 and something days). We had no RFEs.

When we were announced that our case was sent to NVC, we waited like 10 days and started to call them and see if our case arrived.First time called and our case was there from 17th. We called several times to get our case number(once 2,3 days). Once we called and they told us that we have case number,we also asked for Invoice Identification Number and beneficiary Identification Number. Once we got these,we gave our email addresses to the NVC operator. Next, we completed form DS-261(Choose of Agent) and submitted it (on the NVC site). In 24 hrs the welcome letter from NVC(including the AOS fee bill Invoice) came by email to both of my husband and I. We paid the fee in that same day and next day we called NVC again to review the DS-261 form over the phone(I found out here on visa journey site that if you do not review it over the phone with them, the IV fee bill will not be invoiced that quickly--They review it in one or two weeks without you calling them--). 24hrs after reviewing the form over the phone we received another email with Choose of Agent confirmation and IV fee bill Invoice. We paid that also in same day.

Now,as you know, we are waiting for the IV fee to show as PAID(now shows "IN PROCESS") so that we can complete the DS-260 form.

Note:i wrote everithing in detail so that it can be helpful for others that read this comment and want to see how this NVC process work.

  2. We applied at USCIS on 3rd December 2015 . NOA1 received on 14th December and NOA2 on 3rd May 2016 (141 days from NOA1).

Our case was sent to NVC on May 11th and received on 17th May.

Case number assigned on 3rd June(but we called on 6th to get it. On 3rd we called in the morning and they didn't had a case number for us. I guess it was assigned latter on that day).

How was the process for you at USCIS?

Oh..and the priority date from the NOA2 was December 7th,2015

I do not know what "d" date are you referring to...

  3. lets just hope that on monday it will be paid. when dd u apply for your visa in uscis?i mean d date

  4. the documents are prepared by the company lawyer. after i filled out the ds260. they will mail it right away to nvc and hopefully in less than a month. it will be case completed.you?

what do you mean by writing the cover page for aos and iv package?

We do not have a lawyer to manage our case, I choose my husband as an agent for NVC processing. This means we will handle all documents and forms.

In relation with the AOS and IV cover pages, it is an option, not a must do. I want to do this in order to make it easier for the NVC agents to review our case. I want to let them know what I included in every package (even though both AOS and IV will be sent together ). I don't want them to mess up my case or to send me checklists for documents I already included but they omitted to see. (I know few cases here on visa journey that experienced that kind of stuff and they had delays in receiving case complete)

Anyway...in your case, you have a lawyer that takes care of this so maybe he will handle it better.

  5. are your docs ready to be sent to nvc? sure ill check now

Yes, we had everything prepared ahead of time. We did our best to know what documents are needed for NVC processing and we collected them already. I sent my civil documents, pictures and translations to my husband in US about two weeks ago and he requested his tax reanscript for last year and we have everything in hand. We just need few hours to organize and put them together.

At the time being, I am writing the cover pages for AOS and IV Package to send them to my husband through email.

This Sunday we will have the package ready . Monday we will ship it hopefully.

What stage are you on with the documents?

  6. Well they misplace documents all the time. I got RFE in USCIS stage for one passport photo of my husband whic i did send. I was super confused with I 864 form. But i sent. I always thought i will get checklist well a little depends on luck i guess.

At the USCIS stage we had no problems...no RFEs thank God...(141 days from NOA1 to NOA2)

About NVC stage and I-864 forms, i have been very sure that we have to use the I -864EZ form but since my husband is self employed we need to use the I-864 one. If my husband would have not observed this little thing about self employed case, we would have sent the wrong form. It is not confusing, but you have to be very careful and read the instructions for every form and you can easily find out wich form is suitable for you.

Hopefully NVC will not give us headaches and be smooth ?

  7. yes we are just the same. it is just i dont pay for the aos simce there is a work eaiting for me in US. but the rest of the process is the same. submit ds260 online, send the civil docs and financial docs from employer and wait for it to be case complete and for the interview

    That's good then?

Good luck with colecting the documents and sending the package to NVC. Let me know when you get a scan date.

This weekend, my husand and I are going to put the package together and send it by next week to the NVC. Hopefully the DS-260 will be available by Monday since I understood that it takes up to 2 or 3 days for the IV Fee to apear as PAID and then the form will be available to complete and submit.

  8. I sent all of these everything relating to petitioner in the AOS package. Lol i was always confused with AOS and IV, so i wrote down everytime i sat that AOS is petitioner and IV is beneficiary. In IV package i sent my documents and all certificates and affidavits with the joint bank account.

☺ I see...For me is pretty clear the difference between those two but I was just wondering if it will be a good idea to have both beneficiary and petitioner's civil documents in both packages(at least passport and birth certificates copies). This way they won't be able to say that they do not have this or that, since I observed that a lot of people got checklists for missing civil documents or wrong I-864 form.
  9. employment based category 2. immigrant visa for professionals with advance degree.. maybe it will be paid status on wednesday US time

Ok...I understand now. But will you have same path in receiving imigrant visa as IR-1/CR-1 fillers?

I mean,at this stage of NVC processing,do you still have to send AOS and IV Package and wait for case complete, interview and then to have the visa issued as we do?

  10. To be on safe side i sent the full passport copy of petitioner's passport, driver license, SSN card and even the federal student benefit copy. Upto you if you want or not. And as i used joint sponsor i sent his dad's passport, marriage certificate, SSN too.

This is what I am thinking to do too. Even if they do not require his documents, I will still send them just to be on the safe side as you said.

Did you placed them in the AOS package or IV Package?(or maybe in both? )

  11. Yea, I sent that in. I'm a rule follower. I did everything exactly the way they wanted it. Which is why I was so angry for them check listing me.

Ua...this is so not right. I'm already scared of what may happen to our case when the package will get to NVC. Hopefully nothing bad will happen, although I already am disappointed on NVC if they really treat the life of other people so carelessly.

I'm sorry for you being in that situation with checklists. I truly had high expectations for US to be fair and prompt to these type of situations like visa issuing, especially for spouses of US citizens?

  12. You only send what they ask for in that welcome letter. Petitioner doesn't send passport, BC or PCC.

NVC isn't perfect, so whomever is looking at the file misses looking at something, or they lose a document. I got check listed twice for documents they had, were not needed or unobtainable. i don't think they train their agents well enough to know all the rules. I had to tell them their own rules when it came to my case.

Other times, it is because the petitioner forgot to send something in or sent an expired for, or forgot to sign something. it just depends.

Hearing the words "a checklist has been issued" is a horrible feeling. I don't wish that on anyone.

I wish you a smooth journey.

Ok,thanks...But one thing, did you completed that document cover sheet with "X" as appropriate?(the one NVC sent in welcome letter)

If you did that, they should have seen that one document or another are not needed, enclosed, unobtainable or not applicable. Otherwise it is not fair to send unjust checklists to people that are struggling to resist this whole time being apart from their loved ones.

  13. hello

    the status is "in process"

my aunt just paid for the iv fee bill. aos fee is exempt since this is an eb2 visa.

    yes sure.

well according to my lawyer we will fill out the ds260 and we must send some civil docs to nvc so they can start the visa processsing

We are in same position. We paid IV bill 2 days ago and it shows "IN PROCESS".

    What is eb2 visa?

  14. we are almost the same. mine got case number June 6, also, AOS says my petitioner is EXEMPT

    Hi there!

At this point, in NVC processing , we have paid our AOS and IV fee bill. We are waiting for the IV form (DS-260)to be available to submit and hopefully to send the package to the NVC by next week. What is your status?

It would be nice for us to help each other with information if we can. I will provide you with any infos I have?

    Good luck!

  15. Hi everyone!

I'm curious about one thing? Why do people that sent AOS and IV Package were getting checklists? For example, for what did they got the checklist? Do they forgot to send a document? Generally, the NVC welcome letter has a list with everything you must send. Is there anything else that they need but not tell you about? In the AOS package should there be both petitioner's and applicant's civil documents (except for the I-864 form and tax transcripts) ? And how about IV Package? Should it include petitioner's passport, birth certificate or police certificate?

I'm a bit confused about how and what should I send to the NVC....Someone who has been trough, can you please inform me exactly to what have you sent in both packages to the NVC?

  16. Yesterday my husband called NVC to review DS-261 over the phone. They askeed him only two questions and then they said that the IV bill will be invoiced in few days.(this is the last update to my case)

I have a question, Is it ok if we send in the AOS package just the last year tax transcript(2015)? We are going to send additionally copies of payment checks my husband received from his jobs (he works as self-employed in construction). Has anyone received a checklist because they dind't enclosed the 2014 and 2013 year transcripts?
