  1. ISO ADVICE: My fiancé and I filed our 601 waiver With the Kingston Jamaica Embassy June 6, 2017. We received our RFE August 20 2018 stating that we also needed to file a 212 waiver because our previous lawyer did not we hired another lawyer to file our 212 and it was received October 26, 2018.On November 20, 2018 I received a letter in the mail from USCIS stating that the Embassy in Lagos Nigeria does not have our 601 waiver and all actions and this case has been terminated(see pic below) we contacted the Embassy in Kingston Jamaica and they wrote us back in the email stating our waiver has been approved but I have been on the phone with USCIS since last week and they see no approval in their system. My question to you is what should be my fiancé and I next steps? And how much longer are we looking at?

    The issue could be you filed 601 waiver before the interview.. I've spoken to Lizz Cannon before about this because I know I will need a 601 waiver and how long that process will take. She said it is very risky to send in the 601 waiver before because if it hits someones desk and start working on it without your K1 interview denial they may automatically deny your 601 waiver.

    It was just recently denied and the wavier was sent before and we are eligible to file the wavier 

  3. Hello everyone

     

    my fiancé and i went to out interview today and was denied under section 212 a 9ai but we are eligible for a waiver. The things is we filled our wavier before the interview and uscis said they received it June 6,2017 we even presented the printed out wavier packet..however the CO said it was not in the system. She then handed over some information to contact to see where our case is located. We called our lawyer as soon us we got home and told her the information. Everything else in the packet seemed fine and the CO's seemed very apologetic. Our just told its to stand by and maybe we can set another interview. Is there anyone on Visa Journey who has every experience anything similar to this or if anyone had any advice please feel free to comment. Thank  you our wavier is at Nebraskas  center and its a I 601

    What did your lawyer say? 

    You can checkout Law offices of Spar & Bernstein,PC located in NY # 1 800 529 5465. They deal with all aspects ; concerning Immigration & more. They also have a FB live Monday-Friday 9am & 12pm (1hr) where they answer immigration  questions from any caller. 

    well we have a lawyer and she told us to wait 15 days too see what happens next... we filled our waver already and uscis said they received it june 9 2017 the co's said it wasn't in their system just yet so we have to wait

    Here is the link I found with the poverty guidelines. This is for the I-864 form for those that are applying for the spousal visa; which is 125% poverty requirement. I believe the K1 requirement is 100%. But I would use this as a base so you see what the requirements are per household:

The point of the sponsor is to ensure that the beneficiary does not become a public charge, so if your sister(s) are willing to sponsor her, as long as they meet the poverty household requirement when they add her as a dependent to the form, and can provide proof that they meet the requirement, you guys should be good. One of the requirements for the K1 visa is that you cannot be married, so I'm not sure why she would tell you that. The sponsor requirement works the same for heterosexual couples as well as same sex couples during the K1 process.

     

    Thank you so much..I sent this link to my lawyer hopefully she reads it. We have been so stressed about me not having a job for awhile and just going to school but I know once she gets here I know we will be alright. Now I just have to see what the income will be for a sponsor of four people. T

    No but ur sister will have to have enough income for 4 people to be ur co sponsor.  JA does not count child support as income, so they will subtract that.

    So all in all...we can have a co sponsor we just have to make sure we are above the poverty line required

    she believes there can only have a sponsors unless we both are married which we are not...

     You guys are right the I 129f was accepted and we plan on filing our wavier this week but I'm still confused about the I 134 from what I understand I can use my  monthly disability and the money from my GI BILL for my housing for school as my income. And Yes I am a full time student studying forensic science I have sisters who stay in the same state as me but they have kids but are willing to file for me and my other sister out of state also our lawyer told us we may not be able to use them I just want to ensure something.

  11. Hello my fiancé and i have had our k1 visa approved and we also have our case number from nvc. We are working on her wavier for unlawful entry but thats not our biggest problem. i know we have to file a I-134 which if the affidavit of support the problem is i got out of the military and haven't worked in 2 years. i have been collecting disability and they have been getting payed from the GI bill to go to school. I have family members who are willing to be our co-sponsors  but our lawyer said she doesn't believe we can can have any. I'm not to familiar with the system but i do know we are almost at the finish line and i don't want to be the reason we lose. if anyone has any advise I'm all ears and yes I'm looking for a job as we speak but the problem is i won't have any tax returns to show from it IDK PLEASE HELP!!!

    Yes I'm back I went to babados to see for my birthday. It was amazing.Now I'm back in the states going to school.We are in the process of filing our wavier for unlawful entry  ,which cost $900 dollars. I'm just ready for this too be over with and be with my soulmate❤️ SN the visa is been filed in Jamacia
