  1. That theory sounds great. It does help from getting an RFE, but does not have anything to do with how fast they will process your case.

    I have two immigration attorney friends, that have been in the business over 15 years each and they reviewed my packet and it still took 148 days. Granted much of that time was due to Imbra. But save yourself some angst, be patient and go by their processing times, no matter how ridiculous they seem.

    When you get to 30 days past their processing time, make a congressional inquiry. That is about the only thing the will get your file off of the bottom of the pile in corner.

  2. The attached spreadsheet was based on the last update by Uling. I am not sure it is 100% accurate but should be close.

    I attached this with my congressional inquiry request to make the point that random dates were being approved and they were not communicating honestly with anyone.

    I hope this helps those of you who have asked for it. Sorry it is not complete and 100% accurate but enough to prove the point.

  4. The letter below is from a template that another well known VJer provided me. I can not take credit for it. I feel it was the difference in getting my approval moving that I will share it with our VJers needing approval.

    I will definetely be voted for my congressman again. He was very responsive to me. Even wrote me a letter explaining what he was doing and would be in touch with when they received their response.

    He sent the inquiry to USCIS on 8-21 and I received approval 8-24. I don't believe it is coincidence.

    I also attached Uling's spreadsheet showing the random approval dates to illustrate the point further.

    Dear Congressman XXXXXX:

    I am writing to request that you inquire the California Service Center (CSC) in regards to their procedures when approving I-129F petitions (petition for fiancée visa). I also would like information regarding my specific case, as I am unable to obtain any information from USCIS regarding this matter.

    I filed an I-129F petition with CSC on 29 March 2006 (attachment 1) on behalf of my Fiancée, NAME, a resident citizen of the South Korea. We meet all the requirements for a fiancée visa. We have met in person within the last 2 years; we are both of age to be married and are eligible to be married.

    In May of 2006 we were informed that all fiancée petitions were on hold pending decision on how to proceed with the new law regarding International Marriage Broker (attachment 2). On 10 July 2006 I received a Request for further information (RFE) (attachment 3). I immediately returned the form and CSC acknowledged receipt on 19 July 2006 (attachment 4).

    On 21 July 2006 CSC beginning sending petition approvals. These approvals were on petitions that dated from March 3, 2006 to June 6 2006. Policy at CSC had been to process all petitions in order based on their NOA dates. Since beginning approvals after IMBRA it appears that this is not the case.

    I would appreciate answers to the following questions.

    1. What policy is CSC now using to determine priority in processing I-129F and why are they approving petitions in seemingly random manner?

    2. What is the exact status of my case and when can I expect approval?

    I really appreciate the list you kept. I used it as part of my request with my congressman, showing the various approval dates and requested an explanation. You are part of my small success. Now the rest of the story.

    AS@$Hole are not allowed to live in Texas. But some rednecks do!!! :lol::lol::lol: Of course I was not born in Texas either.

  6. Everyone!!! Thank you!!!! If you are a March filer, I would suggest a congressional inquiry. I think it is the only thing that gets the dust blown of our files. 152 Days too long.

    VJ has been a wealth of information and support for me. Only thing that has kept me sane. Hang in there for those not approved yet, and keep the faith.

  7. I would not be concerned about your NOA2 for at least 120 days. That is the average processing time even Pre-Imbra, just because some have been approved earlier does not mean that is the average.

    If you filed the old petition, then you should be getting an RFE. If you don't get one soon, then I would try contacting them to at least get the RFE, but they will probably respond with the RFE once they begin to adjudicate your case, which should not be for another 30-60 days. Just my opinion, good luck and I hope you have a speedy prcess.

  8. We will see if that applies to congressman inquiries as well. I faxed my request yesterday to my congressmans office and will follow up tomorrow with a phone call to see if they honored the request. This is total Bu$$Sh^t. There is no justification for the total lack of compentence and disorganization.

    While they were waiting until the first week of july to RFE's they could have at least done some prelim processing. (3 months worth)

    It does not matter what any notice or website says, they can manipulate and changes however they please, they have all the control and power and they know it.

    This should be publicized to the media and we should all flood our congressman, senators, ombudsmen with responses of this missappropriation of government resources. Oh I forgot they only use the fees we send them, well up the fees, I would gladly pay another grand or two to get this done.

  9. Know one really knows, it could go either way. I have a good friend who has been in DHS as an attorney and has been a practicing Immigration Attorney for 10+ years and his advice is that if you are this far out, it can not hurt you. They don't get vindictive and they don't change que's. Cases are assigned by the adjudicators as they come up and in this situation it is all random. He has seen the random date processing before and it is when situations like IMBRA have caused a significant backlog. They are just processing to get them out in order. If they actually pick up your file they will process it. My 2 cents for what it is worth.

    His comment was "no attorney can know what they are doing unless they have been there to see how they are managing the process and if the procedures have changed. In times like these, it is a toss up."

  10. I sent my inquiry today to my congressman. I contacted them back on July 11 and they asked me wait another 30days.

    I also asked them to inquire about the random dates of approval. Their is not much they can do but ascertain the status from making the inquiry. However, from all the previous cases I have read on VJ. The petitions were at least picked up at that point and processed with the approval coming soon after.

    I think it forces them to look at your file and since they have it front of them, they finish it.

    I am hoping for some kind of positive response. My rfe was received back on July 11 and they sent the RFE email 7-19 so who knows.....

    You are even a couple of weeks earlier than me. Geeessshhhh.... how long should you have to wait and June 15 NOA1 has been approved.
