  1. Hey guys

I already got my K1 approved and am traveling to the US after Christmas. I have a question though, referring to the work permit. I had the idea, reading forums and stuff, that even if you had a social security card, you would have to wait for your work permit to arrive (from your adjust of status) to be able to work. Last week, my fiance talked to a friend from work that said that that is not necessary. if you already have a SSC you can apply for jobs and will be hired normally. Is this accurate? I am confused.

    Thanks in advance!

  2. Hey guys, I am looking through flights to the US and most of the ones i find with a reasonable price have a stop. How long does it usually take to go through immigration with the K1 paperwork? i found a really good flight with 2h27min layover in Miami. How much time would you suggest to have between flights?

    Thank you! :)

  3. Awesome news!!

Now is a good time to complete your timeline and update your profile to list your country so if you have further questions your posts will be automatically directed to the proper forum. Everything from here on out is country specific.

I'm his fiancé!! so our timeline is under my profile!! But thanks for the notice! I just updated our info!! :)

question though, do they send out something saying they are sending the file to the consulate in the foreign country?

  4. Hmm. it depends on who you get as an interviewer. it's up to you if you want to take everything. My point of view is I'd rather be over prepared than not have something they ask for. You can send certified copies, that works as well.

I am also not sure, but those documents might be requested on the pre-interview. When you get to the consulate, they give you a list with an order to put your files in, you pass through 2 different people that will check your papers, and then you head to the actual final decision interview, so it might be required documentation for those pre-interview stages.

PS: my fiancé is also from Michigan. We're filling for FL because that's where he lives now. haha what a coincidence.

  5. Hi!
Yes! The consulate of Rio is the only one that issues immigrant visas. São Paulo and the others offer non-immigrant working and tourists. So yea, she will have to go to Rio for the interview. Also, in Brazil you don't have to send anything back. The packets are only for the next steps of the procedure. All documents listed will have to be taken to the embassy for the interview, so no need to send documents back.

The consulate posted around 2 months ago that the availability for the immigrant visas will be shortened in august and beginning of september, but not inexistent. I believe scheduling will be harder because the hours will probably be cut, since the ambassadors are also representatives of America here and the Olympics will probably give them some work.

Now what your fiancé needs to do is to get he medical done, with the doctors selected by the consulate and the shots, if any. fill out DS-160, pay the fees and schedule the interview. In the meanwhile, gather all documentation, specially yours, such as Affidavit of Support, tax docs, income verification, bank statements, employment letter, a new letter of intent, etc. I don't know if you have plans on traveling for the interview as well, but if you're not, it is really important that she has the original documents for the interview, so be ready do send these papers asap so your process doesn't delay much. Correios, our USPS, is not super fast and it can take a while to get things delivered. When scheduling the interview, make sure to think about the time frames needed depending on what your situation will be like.

I am also from Brazil. if you want to DM for questions and such, feel free to do so :)

    Good luck

  6. I am so sorry for you. women are not all like that, but some people will go above and beyond trying to immigrate. It is hard even for the ones that are trying to do so for true love because of this reputation. you have to move on and believe that you deserve better.

the money is pretty much gone. when you pay the filling fee, that's for all the work around your file. they consider "work" from the moment they pick up your file from the lockbox til the end. so, there is no chance. the best thing you can do is let USCIS know that she is not trying to get the K1 for the right reasons, either with you or him, because he might be on the same position as you right now or maybe clueless.

  7. I'm so nervous about my other half and the happenings in Brazil. I really hope it doesn't impact the process negatively. All I can do is watch from afar...missing him so <3. We are estimated for Sept 19th but the days keep inching up so I am hopeful. I hope everyone is doing well waiting :)

    Don't worry about it!

Nothing that is going on with economy, politics or anything else matters for this process. Brazil is one of the easiest consulates and the process is even quicker here because of all the online fees and no packets to receive/send. The only thing you should be attentive of is the Olympics. During august and part of september, the consulate will have relatively less availability for interview/issuing of visas. That has been warned on their website and facebook, but looking on your timeline, your process will probably not be here by that time anyway, so you should have no problem :) good luck

  8. You will need to complete the form, yes, but not right now. It is only necessary at the time of the scheduling of the interview, after the file is approved and passed through the service center, nvc and is there at your embassy waiting for you to do the interview.

when you do use it, you just need to take the confirmation page. you can print all of it for yourself, but the consulate will only request the bar code and confirmation number :)

  9. It's different from country to country but I think in Brazil things go faster if you want to. You can pay your interview fee online, set your own appointment online, there's no need to send packets back and forth, etc. If you work on the documents for the interview right now, whenever the consulate contacts you, you'll be ready to go.

    I have some tips:

    Check if your police certificates are available online, that way, if they're not, you have plenty of time to request them directly to the police;

    Have your American fiancé take a look at the i134 and practice filling it, make him get his tax papers and whatever else he needs as supporting documents. Remember that receiving his papers by correios can take a while (mine took longer than expected even if it was sent by express mail) and be prepared for that. Also have a copy of his birth certificate in hand at your interview, they don't ask on the list of documents but it's needed;

    Find your vaccination card and go to a posto de saude and make sure yours are up to date;

Plan on what you need to do in Brazil, like closing bank accounts, cancelling credit cards, let documents prepared for taxes, etc. I had a hard time exchanging currency, for example.

But the best advice is to breathe and not to worry, you'll have plenty of time to understand and do everything.

If you need help, you can message me (in English or Portuguese) if you want to.

    Good luck

Thank you for the tips!! You've been such a great help! We are doing those things since we can't do anything else but wait hahahaha

  10. The doctor in São Paulo doesn't allow you to schedule unless you already have an interview date and letter. I've tried to do so. My results from the doctor were ready in less than a week.

You can definitely call the nvc to get your case number faster.

Like I said, I suggest waiting for the embassy to contact you, because that way you can be sure your case is ready and have gone through all the Adm processing required for them.

I'm cautious and would not take the chance of scheduling anything before getting the green light from the embassy, but if you're comfortable, you do what you think it's best at your discretion

Thank you!! little by little, I'm trying to understand more about the process here in Brazil! i feel its a little different than other consulates!

  11. After noa2, uscis sends your case documents to nvc, they scan things, enter the case into the system, etc and from there it's sent to your country's embassy.

Once the embassy has it, the hard copy, they do some admin processing there and will contact your American fiancé by email to let you guys know about the next steps. There's not really a packet 3 or 4, it's just the email.

I strongly suggest waiting the embassy's contact before scheduling anything.

From there you can schedule the medical and interview. I don't know about the doctor from sp, but dra Juliana from bh only schedules the medical when you already have the interview appointment.

    Oh ok, got it

I see some people talking about calling NVC to get the RDJ number to schedule interview and medical. Is that a thing? Its also on the timelines here at VJ.

  12. I don't know how things are looking right now because of the Olympics, but last year I got an email from the embassy exactly 5 weeks from the Noa2. There were dates to 2 weeks later at that time.

Right now it seems nvc is taking a little longer to send the approved petition to the embassy.

The medical is scheduled to your discretion. Where are you from? Where are you planning to go to have your medical done? The availability will depend on the Doctor as well. People go to their Medical the same week as the interview. I went to mine 2 weeks before the interview

It will depend on your readiness and availability, I believe once you get the OK from the consulate, you can do everything within a month, if you're organized and have everything good to go.

    Good luck

Im from estate of Sao Paulo, I'll probably get the medical there, even tough it takes up to 10 days for the results.

I get a little confused actually about how the process works after NOA2 and NVC. So when you get NOA2, the case goes to NVC and then is sent to the embassy, which sends out packet 3. am i correct? the interview and medical will be able to be scheduled at what point?

  13. Hi there,

I live in Florida too and have been quite confused about the information provided. From the website it seems straight forward, but before i read that, i went to the DMV to get the handbook to practise and a gentleman who worked there asked what visa i had, and said because its K1 they require you take the test within 28 days (approx) from arriving, and if you don't, you have to wait to receive your NOA1 from the USCIS which you can use to take the test.

I saw nothing about the NOA1 on the website but i have seen someone mention the same information on Visa Journey, who also lives in Florida.

Once my NOA1 arrives, which should be sometime next week, I'm going to call the DMV to get more of an understanding on the situation. I would also like to go ahead with the DATA course but not sure if i'm allowed to do that yet.....

maybe call the DMV and speak to an advisor, it seems Florida is quite different to other states.

Yea, i hear FL is different! my fiancé called DMV and they had no idea what K1 visa is, which is quite funny. so, if you get the test within those 28 days, the license would still be valid for the validation of the i-94, correct? and then you would have to renew it with the NOA1.

I can use my brazilian driver's license for at least three months after i arrive, but i can't really purchase/lease a car and insurance without an american license. that is the sucky part!

  14. You wait now

The medical exam is far away in timing

USCIS will look to see if all documents are with your application /

then mail to NVC and you will receive a new case number for Brazil embassy

after they check for needed documetns, you will send in anything they need

then case will go to embassy and you will have to check for doctors on the US immigration list

don't do anything till immigration tells you

the medical exam is done just before the interview as she has 6 months after medical to travel to US (if visa is approved)

    Best of luck to you

The actual question was what do we need to get the medical exam and interview scheduled. I know it's a number, but where and when to find it? We already know the correct doctor and the exams i'll need, we just need to find out, for planning purposes, when we'll be able to schedule them. Which document will have the numbers we need to pay the fee, complete DS160 and schedule interview and medical. I know its impossible to know the date, but we need to know in which document will have that information.

we are mostly questioning because all blogs I found here in Brazil do not mention anything about returning any documents to the embassy, just taking them to the consulate at the time of the interview. Can consulates have different procedures about that?

  15. Hello! I'm also brazilian, and I thought about taking the vaccines while I wait for the NOA2. My only concern is that I'm a little allergic and wonder if it will be ok to just take a lot of vaccines in a short period of time.

Did you have your medical appointment yet? Which vaccines are required?

Im waiting for my NOA2 as well and taking vaccines slowly, so I don't have to get them all at once. you will need those vaccines:

    • MMR
    • Td or Tdap or DT or DTP or DtaP (One date must be no longer than 10 years ago)
    • Varicella (if you had chickenpox, History gets you a waiver)
    • Influenza (during flu season)
  16. Okokok.... The Flu Vaccine at this point is going to be a problem.

    A. DO NOT worry about it because doctor knows and will waive it.

    B. DO NOT worry about it because FOR USCIS Flu season is from October 31 to March 1st.

For reference Google USCIS and Flu Vaccination. It says it there. Make a copy and take if need be.

I just want you to not be so worried about it. My wife and I were. Until I researched it. At the medical I personally asked the doctor confirmed it.

This was the first time I heard about the season and dates that the vaccines are actually necessary. I thought it was at all times. I already got the triplicate one, it says "Influenza" on my chart. The clinic in Rio sent me a list of shots I had to get and didnt say anything about being from october to march only.

I am going to the doctor in São Paulo instead of Rio because its closer to where I live, going to Rio just for the interview. the doctor in São Paulo doesn't even send you a list, it just says during the medical exam he will tell you what to take. I just don't want to delay the process having to email him later with extra proof of shots or something.

But even if the doctor waives it, I will need for the AOS, cause it will probably be during the season. Would a brazilian chart work as proof or it would have to be the international one? example, if i get it after my interview and exams, will it work for the AOS?

  17. During the medical the doctor has a check list that he fills in with letter codes. On that list he marks those with waiver codes

Ooh got it! he can just waive it. thanks!

His wife's case is cr1/ir1, therefore no need to aos when she gets here.

You may or may not need the vaccine when you get here if you don't get it in Brazil. It will depend on your adjudicator and when the case is adjudicated. If it's flu season by then, the possibility of needing the vaccination is higher, it may trigger a rfe

ooh alright! so it's better to get it just in case, maybe. thank you!

  18. Hi,

Please what is packet3 in The I-129F process.

    Who send it?

    Thanks

it's the packet that the beneficiary receives from the consulate in the country the interview will happen. its a list of documents that you will need to take to the interview. therefore, the beneficiary only receives it when NVC already sent out the approved file and the consulate has it.
