  1. I agree. I just sent the I-751 for my husband and I put our son in Part 5, he is a US Citizen born to us here, because this is the way I read the instructions as well. I wouldn't freak out over other cases; I've known the USCIS to make mistakes. Besides, I highly doubt even the most challenged person reviewing our files would confuse our US Citizen son with a child needing to have conditions removed...

    I think the form asks for all children, however the instructions say:

    Conditional Resident Children

    In Part 5 of the form, please make sure to include any conditional resident children applying with you in order to have their conditional basis removed, or they may file separately. Please remember to provide their A-number.

    Thus it would appear Part 5 is specifically the place to list children removing conditions with the petition, not 'all' children as asked.

    Look, your reasoning does not make sense. The form says "list ALL your children", the instructions say "make sure to include conditional resident children" -- there is no contradiction here! The instructions are merely reminding you to include conditional resident children in the list of ALL your children.

    Why are you twisting the meaning of the instructions to derive a conclusion which contradicts the wording both on the form and the instructions? Is it really that hard to understand the very simple English used by the USCIS here?

    We have a few days to go before being ready to file, and am completely uncomfortable either way, as the form and instructions literally SUCK on this point...

    We have three children, 2 mine from previous marriage, plus our own child together, and would love to list the three, but don't want to fill out the form wrong. Unfortunately the instructions on the form and separate instructions for the I-751 do not mesh.

    Thinking critically, I think whoever created the form and instructions failed to real world test them!

    The wording on the form and the separate instructions DO mesh, you're just twisting them up in your head to mean something different and are seeing a contradiction which does not exist.

    I'm not going to tell you what to do, but your interpretation of the form and the instructions is just plain wrong. I think you should list all three of your children in Part 5 of the I-751, write 'N/A' for each of them in the A# column, and write "US Citizen/Address as in Part 1" for each of them in the immigration status column. If you put an A# in the A# column when you don't have to, like in Haole's case, then the USCIS is going to think that child is a conditional resident, so think about this carefully if your child's situation is not straight forward in this regard.

    If you want to forge ahead with your misinterpretation of the I-751 and its instructions, and not include your three children in part 5, then don't come back here to whine when you get an RFE or your packet is returned to you because the USCIS judged your I-751 to be incorrect or incomplete.

    I'm sorry for my somewhat harsh tone here, I'm just annoyed that many people seem to be twisting up the wording of this form and coming to conclusions which may put their petition in jeopardy. The last thing I want to see is people getting into trouble with the USCIS.

  3. WE PASSED!!! The interview was very easy. We showed up 15 minutes early, was called back at almost exactly 9am, the guy didn't really ask us any qustions, he really just wanted our joint bank account info, rental agreements....etc. He then asked Anna what she planned on doing in America for work, she said she was studying nails, he actually gave her his personal cell phone number and said that she could call him if she needed any help finding work because he knew a lot of Vietnamese shop owners (it turned out he lived in our small city an hour away). Then he went on talking about how loyal Asians were to their husbands and how he had a Vietnamese fiancee once who lived in Indiana and they had to break it off because of the distance. Then he went through the list of usuall questions real fast, 'are you communist, are you going to be a prostitute, are you going to practice polygamy'...those sorts. Then he said our card would come in about a month and wished us a great life together. He didn't ask to see any pictures, he didn't ask about my job or my lack of a job therefore...he really didn't care too much about anything. We lucked out. Anyways, thanks everyone for your support.

    Congrats! I think you had the same interviewer that we had, sounds exactly the same as my experience in Seattle :)

    For your husbands employment, I was in a very similiar situation. In 2004-2005 I didn't make much money at all due to school and working only part-time in Italy. I simply sent them my 2006 tax returns which were well over the poverty line and a letter from my current employer. Due to my current job being full-time and making well over the poverty line the lack of money in 2004-2005 never even came up and I didn't send them anything in way of an explanation. I was prepared to explain it during the interview should it be asked, but it never was.

  5. Okay ... I have limited time to utilize our medical system and I have just found out that they do the chest xray at the medial but to adjust status they are now requiring a TB skin test to be done. If I ran to a lab and had it done and took the paperwork down with me would they accept the information not done by a certified US civil surgeon?
    Requiring TB test? this is the first I've heard of it--Pras did AOS last October, and we didn't need to do TB test.

    I had my interview last week and never had a TB skin test done and yet got appoved.

    Same for me. Had an interview last week in Seattle and no mention of the TB test tho I know my husband didn't have one.

Hey guys I didn't submit any additional shots other than my St. Luke's certificate which I included in my AOS, I was thinking I just had my medical in Manila and if I get an interview I would surely be required to have all the additional shots that we don't have in Manila. I have been transferred to CSC and got my EAD approved and I got three touches for my AOS three days in a row so I took a good shot in not getting any additional vaccinations thus saving me money and I'm now waiting for approval of my AOS....

    You aren't clear of this requirement yet. You may have saved a bit of money by not getting the additional vaccinations, but I imagine 1 of 2 things will happen: 1) They will send you an RFE requesting the I-693a which will delay your AOS. 2) They will expect you to bring the I-693a with you to the interview and hold approval until you supply it.

    The interview letter lists things that you are required to bring to the interview. Our letter indicated that we should bring the I-693a if not already submitted.

    I know that SLEC does not give all the required vaccinations needed for AOS. If you didn't get them elsewhere and have them documented on the form provided by SLEC, you will not have met the requirment and will not be approved for AOS until you do. I think you are jeopardizing your AOS.

    There is an option number 3. My husband had a Vaccination Suppliment from his medical at the consulate in Italy, form DS-3025. We sent a copy of that form along with our AOS application and were approved with no problem. It wasn't an issue at the interview either. I think it's one of those things that is up to the discretion of the officer dealing with the case. The most it could cause is a delay.

    I just contacted my bank and they told me they could provide a letter with information on when the account(s) were opened, what my average balance has been for the past few months and my current balance. However, they cannot personalize it, so they say, to also list my deposits in the last year. They said I'd have to request more detailed account information from an independent company online that has nothing to do with my bank, sort of like a credit checking agency.

    Do you think this bank letter would be enough without deposit information?

    I should also say that because I'm a grad student and my income is not enough I'm having a co-sponsor. I'd like my bank letter to show that I have savings/assets, so the information is rather important in my case. However, I've also been told that the fact that I have a co-sponsor with a good income is the main thing the foreign consulate wants to know.

    When I went through the K1 visa process, my bank letter didn't have any deposits listed. Only the current balance and average balance for the last three months and I didn't have a problem. The instructions for the I-134 don't ask for a list of all deposits only for the average. I wouldn't worry about it especially with a co-sponsor.

  8. I know a few of the April Filers had interview this week. I would appreciate if you would post your experiences taking time from your partying (just kidding :)) after your approval, since my interview is next friday.

    I posed my experience with the interview on the 12th. You just need to go back a page or so to find it. I think it got buried in the EAD party. Anyone heard from Maggie? Her interview was the same day and place as mine!

  9. Hey, I've been absent from the forums for awhile. Work has been keeping me busy... Anyway my husband's AOS interview was today in Seattle. That was just about the easiest thing I've ever done. We got there really early, around 9:00am for our 10:00am interview. We didn't get called in till a little after 11:00am tho. It was taking so long me and my husband started making bets which person was going to call our name, ahhh boredom. I won :)

    Anyway, we got sworn in, asked to verify name, birthdate, home address, telephone etc. Asked all of the usual "Do you plan on practicing polygamy" questions and such. Then he asked how we met, how many times we've visited each other. My husband and I met attending school in 2003 so we've known each other for awhile, been dating for 4 years, and I lived with him for a year in Italy so there didn't seem to be much question about the validity of our relationship. He asked to see wedding photos, and joint assets. We had joint bank statements, credit cards, health and dental insurance, car insurance, and lease agreements. No utility bills if you're curious. Then that was it!

    I brought all my financial info, pays stubs, letter from my employer, marriage certificate, birth certificates but he never asked for anything! We also seemed to have gotten by using only the vaccination form from the consulate in Italy, tho he never asked to see that either.

    He said my husband should have his card in 10-14days. Really nice interviewer, joked with us almost the entire time :)

    Well, just came home and grabbed the mail, and look what we have here.... INTERVIEW! July 12 at 10am :)

    Only thing is, for some reason they decided to put Beaux Arts, WA instead of Bellevue, WA as our address. All of the previous notices went to the right place, and the rest of the address is correct including the zip code. Should I call the misinformation line or is this just a case of someone using auto fill incorrectly?

    Maybe floridaguy is onto something. That being the case nuzzel and I should received our appt letters this week. When did you do biometrics ride? Stop thinking RFE or you'll get one!! :blink: Think 'appointment letter' :thumbs:

    PS: We are slackers people!! I had to go to page 3 to find our thread...

    Looks like ridejewel had biometrics one day before my husband, you had it one business day after, so we're all in the same timeframe. Hopefully we'll all get some news soon!

    Wouldn't it be wild if the three of us got our appt for the same date??

  12. How can USCIS descheduled an interview if i did not have one scheduled??

    I received this message today on my email and i have no idea what they are taling about... They didnt schedul any interview....

    Did it happen to someone here??

    If you do a search of VJ, you'll see that this has happened to others before. Usually when an interview has been descheduled there was one scheduled before, and the advice on that has usually been to go to the canceled interview anyway. Some people have been denied AOS for missing an interview that was cancelled.

    However, since yours was never scheduled, you don't have a date or time for this non-existant interview right? I would say, schedule an infopass appointment to find out what's going on. Perhaps USCIS has a random email generator...

  14. I am curious to about how they determine who is transfered and who gets interviewed. We did not enclose any additional info other than what was requested. I wasn't sure if we were supposed to. Maybe I should have asked here first! :crying: Anyways it is what it is at this point. We are still waiting to see if we will get an interview or go to CSC, which no longer looks like 'the way to go'. Looks lime most interviews are getting scheduled in about 3-4 months from submission, based on those that have received an appt.

    Being that our biometrics were so close, I have an eye on you to see when you get your interview or CSC transfer. I noticed that many of the April filers before me have gotten notice of an interview or transfer, lets hope this is the week for some Seattle action! I am so impatient...

    It's a really nice page with the averages between NOA's, biometrics, and interviews. Every case is different but it's useful to see the stats. Also, click on the link to "My Assistant" and add your own timeline. The more info in the stats the better they will be :)

    It all depends upon the dreaded FBI Name Check. If you get cleared quickly, then you will get processed administratively.

    we were stuck in "namecheck limbo" when filing for the K-1, but that only took a few weeks to go to Washington & then back. I will just have to cross my fingers......the last thing we want is to be stuck :angry:

    why are they sending so many cases to the CSC? does anyone have an idea?

    It has something to do with the USCIS trying to speed up the processing of some case types, but if you go and look over the CSC transfer thread it's hard to find the pattern.

    As I said, minor error in more of semantics than an error in answering the question. Since I've only done and looked into K1, I was just answering the question based on that.

  18. Judging from your timeline, you came here on a K1 visa, so the answer is no. You have to be married to file AOS and copy of the marriage certificate is one of the required documents. As for EAD, you could have applied for one once you arrived with the K1 visa, or have gotten a stamp at JFK that gives you the right to work, but both of those are only valid for the period that the K1 visa is valid. Once you apply for AOS you need a new EAD.

  19. If you are planning on using your married name legally, you should fill in your AOS (and EAD/AP if desired) in your married name. This will avoid having to do a name change later on.

    As far as your AOS approval is concerned, it doesn't make any difference to them that you had a small wedding first and then had a larger one. All they are concerned with is that you married within the 90 days of arriving with the K-1 Visa.

    You do not need to do anything to change your name legally, you just start using it. You will, however, have to inform your bank, credit card companies and SSA (if you have a SSN card in your maiden name) that your name has changed, and they will require a copy of your marriage certificate to prove the name change.

    If I'm not mistaken, it's the husband applying for AOS, so for the forms it's not an issue. I don't think there will be a problem at the interview, as long as you have proof bona-fide marriage. Changing your name is a personal choice based on tradition, not a legal obligation. I'm not changing to my husband's last name, I'm quite fond of my own :)

  20. Welcome to Seattle. Maybe we'll nearly meet up at INS for interview. Our biometrics are only one business day apart!

    We got the biometrics done in Seattle today, you'll be glad to know it was quick and painless :) The people there were really nice and we were in an out in about 20 minutes!

    thanks for the info Nuzz! Question: Did your husband have two appts? Mine has an appt at 1 for one application and another at 2 for the 2nd (one is EAD and other is AOS). I would imagine they really only need one set of prints to do all their work?? :unsure:

    He had one appointment for both, we had one appointment letter with both AOS and EAD on it. I'm sure they'll just do them together, they didn't take multiple prints or anything. Just show them both appointment letters :)
