Just curious, are there any body from the same field office whose applications were submitted at the same time but one with NBC receipt interview already done yet IOE receipts are yet to get interview notice? I see most of the field offices which are processing their applications within 5 months are done for april months. For example Phoenix field office processing date as of June 30th was dec 16th 2015. My guess is that if phoenix field office is processing application at the same speed (i.e as of may 30th, they were processing Oct 27th of 2015) about month and half in one month. They must be processing applications around mid march now. So within a month April filers should get interview notice for phoenix. Likewise i would think the same for other field offices. I am guessing just based on what i saw on this forum and processing dates in USCIS website.

    The reason i wanted to apply for my spouse and kid before becoming citizen ( currently i am waiting for my n-400 interview) is to buy out some of the I-130 approval time. Not sure if this makes sense or not please advise.

    Currently my field office N-400 processing date is dec 16th of 2015 as of June 31st. So right now they might be processing feb applications(just a guess). My priority date is end of May, 2016.

    As of now California service center is processing I-130 for all kinds within 5 months.

    With current timeline, i might be waiting well over another 3-4 months to complete my n-400 interview and possibly one more months for oath (total 4-5 months) if everything goes well.

    Assuming I-130 approves within 5 months, i am hoping i can upgrade my application to immediate relative category from F2A right after my N-400 ordeal is over. This way i don't have to wait another 5 months to get I-130 approved.

    Also does anybody know how long (actual time) California service center taking to process I-130? Because USCIS website says within 5 months.

    I believe currently the end to end k1 process takes anywhere between 8-10 months. So if my I-130 is approved, i can cut down total time by half so that i can be with my family sooner. Having a small kid an not being able to stay together sucks. Seriously SUCKS!!

    I just don't want to spend money to get opinion of a lawyer. So seeking vj members honest opinion and direction.

    Hope this is a small bump on this long tedious journey and i think eventually whole ordeal will be over. I am not sure why IO is going after your previous marriage. Nothing prevents them going back and questioning your previous marriage since the GC was via USC. I would be patient and probably start collecting as much doc as i can to show that the marriage was nothing but a legit one. Over 50% i.e 1 out of 2 marriage falls apart in US. I think the only question is were you in a legit relationship when you received your GC? And of course because you have already removed your condition.. So nothing to worry about much. I am not a lawer just my personal opinion.

    Please keep on posted on our second interview and let us know how it goes.

    How long were you married with USC before you divorced?

    Just to put everything in perspective..

    you said you were divorced last year and filed under five year rule so you must have been qualified under three year rule too if you were married with the same person because based on your posting you were divorced when you were still married with the same person for more than 3 years.

    Just curious if it is just divorce or something else could be popped up in your case? Every case is different but just out of curiosity if you don't have problem sharing your case.


    What questions were asked from GC form? just curious..

  5. I spoke with first level support last week before the USCIS update posted few days ago to inquire about the N-400 processing time of phoenix field office. That person said, as of july 14th the processing was done for Oct 27th 2015, later (couple days after calling) the website was updated and as of June 30th, processing is done for Dec 16th. Which means Phoenix field office taking about 6 months to process N-400.

    I am just wondering does it even worth to speak with first level support personnel at USCIS? Clearly the person on phone give me wrong information. When i asked to speak with 2nd level support, he flat out denied to transfer me to second level and advised to check back in a month?

    My idea is to make things faster so that my spouse can join me here sooner. Can't i upgrade my petition as immediate family of USC after n-400 is approved even if i petition as GC holder?

    My idea is while n-400 is in process, i like to submit 1-130 so that both go in parallel, lets say if i-130 and n-400 are approved at the same time, i would imagine the processing time for my spouse remaining work will be cut short by I-130 approval time because after upgrade the I-130 will go into the immediate relative of USC, correct?

    Just wondering if you guys can shed some light into my thought process and if this makes any sense to you guys? Really need some guidance which would be the best approach.

  7. I got my GC via USC but got divorced after almost 3 years of being together. By that time i had successfully removed conditions. Later got married but found out that i couldn't petition my spouse as permanent resident until 5 year anniversary of GC since my GC was via marriage to USC. Currently i have filed my n-400, so should i wait until n-400 process is over to petition my spouse as citizen or can i submit the i-130 after 5 year anniversary as permanent resident and later upgrade it to immediate relative of USC after n-400 is approved.

  8. Thanks dandk for the link. The way I understood from that bulletin is that USCIS accepts old N-400 form until August 9 however nowhere it says those applications have higher priority over new version.

    I still believe USCIS processes applications in the order they are received. Just looking at historical trend and obviously due to influx of naturalization application due to upcoming election.. I believe this time of year is always bit slower than other times..

    Just giving benefit of doubt until 9th, let's see if that makes any difference in processing new forms..

    That's very strange!! But the good news is that the interviewer was able to close it out.

    On a different note: when was your priority date for citizenship application, in other word when did they receive your application? Recently saw comments on visajourney forum that most of the applications (particularly starting with IOE*) are stalled so trying to get an idea approximately which months application phoenix is currently processing?

    She hasn't dropped her maiden name. Instead she has appended my family name to her name as i said in an example above.

    Marry Ann (Doe). So now her legal name would be Marry Ann (Doe).

    Can I put her Last name as Ann Doe and First name as Marry?

    Like i said her name in passport is: Marry Ann

    Marriage Certificate: Marry Ann

    Later Changed name to: Marry Ann (Doe) while updating state ID.

    Name in Daughter's birth Certificate: Marry Ann (Doe).

    I am from South Asia. I am taking an example. Her real name would be different than an example name.

    I know i had asked this question before but couldn't get clear answer. I am about to send my N-400 package in a week.

    I am bit confused about the spouse name section.

    My name: John Doe

    Spouse: Marry Ann

    Her passport and birth certificate has her name as Marry Ann. But in our daughter's birth certificate her name is written as

    Marry Ann Doe

    Also in our relationship proof doc. Her name is written as

    Marry Ann (Doe)

    When i fill out N-400, Part 10.4. How do i fill out the following?

    a) Current Spouse's Legal Name:

    Family Name(last name):

    Given Name (first name):

    Middle Name(if Applicable):

    b) Current Spouse's Previous Legal Name:

    Family Name(last name):

    Given Name (first name):

    Middle Name(if Applicable):

    Your valuable suggestions will he highly appreciated. I heard that there will be some delay if there is some naming issues so just wanted to make sure that i am using the right information before sending my package.

  12. Just looked at the N-400 form today coz i am about a month away from sending my package. Have few doubts about some of the questions. If anyone can answer, i would be highly appreciative of that person.

    Few questions about N-400 new form.

    1) part 10- 4

    under current spouse name: My spouse name is <first Name> <FamilyNameBeforeMarriage>. No middle name. But after marriage she kept her family name and also added my last name to her last name so now her name is like <firstName> <FamilyNameBeforeMarriage> <myFamilyName>. How do i fill out subsection 10-4?

    NOTE: Marriage certificate has her original name but subsequent name change has brought this situation.

    2) I just have one kid, there is room for at least 4 kids to provide information (if any). Should i put N/A for all other kids information besides the first one?

    3) part -12 (4 - A & B)

    Question is like below. The answer to 4.A - NO. So do i have to answer 4 B ? There are several questions of similar nature. Just wondering

    4. A. Do you now have, or did you EVER have, a hereditary title or an order of nobility in any foreign country.

    YES

    NO

    B. If you answer “Yes”, are you willing to give up any inherited titles or orders of nobility that you have in a foreign country at your naturalization ceremony?

    5) Due to job i had to move from east cost to west coast during last five years. So under past 5 years residency, duration of stay has to be continuous from address A to address B?

    The reason i am asking is, for example: i left east cost on say july 27th? didn't reached to west cost until July 30th. Stayed with friend couple days and rented apartment from oct 3rd. So there is a gap between address A and B of 7 days? What do i do about that date.
