    USCIS does not take GC back at the interview unless if they have same day oath and if you decided to take oath. No they do not take your passport. I believe PL has dual citizenship provisions and pl citizens must use their pl passport to enter pl (i read this somewhere in wiki).

    The Las Vegas Field Office conducts Judicial Ceremonies twice per month and Administrative Ceremonies only on rare occasions.  This office conducts same-day naturalizations for Judicial Ceremonies only.

    she can probably ask to reschedule the oath after she comes back but i wouldn't take chance for such things because if IO forget to put the note and oath is scheduled while she is out of country, it might deemed that the application is abandoned by applicant and Citizenship is denied on that ground. 

     

    I don't know anything about Las Vegas Field office.

  2. regardless of formtype of processing center, USCIS updated the processing time as July 28th, highly unlikely that they will be processing all types of forms until July 28th. 
     

    For example, in CSC the petition for Alien relative (brother /Sister ) of US citizen was around 2011 last month but now it is July 28th. Their ETL system might be broken. 

    Eg.

    I-130 Petition for Alien Relative U.S. citizen filing for a brother or sister July 28, 2016
  3. USCIS updated processing time today. Ironically processing time for I-130 in California Service Center went backwards from Aug 16, 2016 to July 28, 2016.

     

    before today's update, as of Jan 25th 2016, it was saying they were processing applications as of Aug 16, 2016. 

     

    It is very strange. Anybody has any explanation? I will be calling USCIS on Monday and ask them how is that even possible?

    Agree with Bearmirus that if you are ever arrested/detained by law enforcement officer, you MUST disclose your offense in N-400. If it is the only conviction, all you need is Court Certified deposition letter and send it along with your N-400 package (court certified disposition letter is enough which has all the documents needed by USCIS). You can obtain disposition letter from the court where you were convicted of DUI. 

     

    Q 22:  Have you Ever committed, assisted in committing, or attempted to commit , a crime or offense for which you were NOT arrested? Y/N

               N (unless if you have committed something that law enforcement is unaware of) 

    Q 23: Have you ever been arrested, cited or detained by any law enforcement officer for any reason? Y/N

               Y (because you were arrested, cited or detained - NOTE traffic tickets are considered as CITATIONS ) 

    Q 24: Have you ever been charged with committing, attempting to commit, or assisting in committing a crime or offense ? Y/N

              Y (because you were charged with DUI ) 

    Q 25: HAVE YOU EVER BEEN CONVICTED OF A CRIME OR OFFENSE? Y/N

              Y (because you were convicted of DUI ) 

    Q26: Have you ever been placed in an alternative sentencing or a rehabilitative program? Y/N

              N (Unless if you were placed in alternative sentencing or rehabilitative program ) 

    Q27: Have you ever received a suspended sentence, been placed on probation, or been paroled?

            Y ( since you mentioned 3 years probation is completed resulting from DUI)

  5. Two things:

    Even if you have submit service request, still you can set up infopass appointment and inquire about your case. Talking in person gives much better relief than waiting for weeks. Usually it takes weeks to get the response from USCIS via mail. 

     

    1) First theory: i think your online status says that the oath letter has been already mailed on Jan 17th, correct? if so it would be highly unlikely that the mail will take a month to deliver to your place. Either the letter has never been mailed or it got lost. Unless you want to wait, i would make Infopass appointment and find out whether the Oath letter has been mailed or not. 

     

    2) Second theory is: your oath letter hasn't been mailed out to you yet. Some reason online status changed that the oath letter is mailed on Jan 17th. If this theory is correct, then you probably might want to wait until 6 weeks. 

     

    Usually, if you don't receive USCIS correspondence  after 30 days of their notice, you should contact them. So you have little over a week before you go to the local service office and inquire the status of the oath letter.

     

    Did you ask why online status says the letter has been mailed out yet your online account doesn't have the letter uploaded yet with USCIS support person?

How much a person who has passed naturalization interview  and waiting for OATH should be worried with barrage of EO (executive orders) signed by current president (meaning given current fluid situation, likelihood of him signing similar EO) ? Just wondering if he has the power to delay the naturalization process for those who is currently in line for oath?

    did the officer had your wife's I-130 application along with your N-400? Just curious how was he able to correct your marital status in I-130 during your N-400 interview? 

     

    I have N-400 interview coming up and wondering if i have to bring any docs that i submitted while applying for my wife's I-130 as LPR? As you know all the applications (I-130 or N-400) have the same A# number so wondering if N-400 interviewing officer will also have I-130 application form during N-400 interview? 

  8. I am not legal expert but if USCIS finds out that the OP has lied in application form, they should've taken action within 90 days. Not sure why they would wait for 2 years to re-schedule interview. 

     

    I don't think second interview has anything to do with OPs petty theft. As OP mentioned above that they were doing background checks and might have taken such a long time to clear background checks. Since the interview was conducted 2 years ago, they might want to cross verify the information in his application form to ensure that he all of the information still holds true. For example, OPs marital status , kids or PO might have had other traffic related incidents etc..

     

    Each case is unique and we wouldn't know the root cause of the problems All we can do is guess. Unless OP tells the truth.

    Quite interesting, not sure why they would schedule your interview after 2 years of previous interview. If there were no police report filed, your information wouldn't be in national database so the question of petty theft wouldn't come into question. If USCIS finds out you haven't disclosed this information, they would've denied your application. 

    So i highly doubt the issue here is with your petty theft. 

    Also not sure why the USCIS officer said that you would get your oath letter within 6 months from interview date which itself seems pretty odd. 

    What were the questions asked at the time and do you remember any specific area where the USCIS officer might have asked you more questions. Also was your n-400 based on 3yr or 5 yr rule?

     

  10. I had one ticket in Smyrna Georgia back in 2006. Now i live in Phoenix. How do i find out which court should i be calling in to inquire about certified copy of speeding ticket? 

    I am really started thinking if we really need those docs because as long as the citation is not related to DUI or drug they say the docs are not needed. I didn't put any information under question 29 in N-400 but marked YES ( q 23) if i had cited before. 

    I wanted to get the docs before going to interview rather than being sorry afterwards.

    I am going through my n-400 application to prepare for my upcoming interview. I answered YES to the following questions  since i had citation for traffic violation (civil traffic i.e. speeding over the limit by 5 miles or making illegal turn etc).

             23) Have you EVER been arrested, cited, detained by any law enforcement officer (including any immigration official or any official of US armed forces) for any reasons?

    They all happened long time ago probably 5-10 years ago. I don't have any traffic citation tickets nor the proof of payment. I don't have a single traffic violation within last five years. 

     

    Also the question 29 (n-400) has table to complete with when the citation was received and how it was resolved etc. Unfortunately i didn't put anything in question 29 since i don't remember date or year when it happened because all of the traffic citations were before 5 years ago. The reason i said 5 years is because i don't have any citation since i had my GC and i am LPR for 5 years and 5 months. 

     

    Would this be a problem for me during my interview? if so what can i do at this stage to mitigate my situation. Also how can i get the copy of traffic citation and fines paid? 

     

    Since i have moved to different places over the past 10 years so it is ABSOLUTELY impossible to contact courthouses in different states and get the documents even if this is an option.  Please advise what should i do next?

    If you are filling based on 3 yr rule, you would have to send docs that confirms you are living together, your financial commingling, health insurances, car insurance etc. So pretty much you need to gather docs that were sent during ROC. Sends as much doc as you can if you filling based on 3 yr rule. Yes also include pics between ROC and now etc. Read the N-400 instructions clearly before sending your doc to USCIS. If you work your homework now, it will save some of your time later. 

  13. Part 5 - Addresses the past five years.

    •    include address back home if you haven't been to US for five years. 

    Part 8 - Employers in the past five years.

    • only include the employment history, if you don't have five years history, don't worry .. provide whatever employment history you have so far. Note, you don't need to go beyond five years history. 

    Part 9 - Time outside the US for the past five years.
    Maybe I should write about the past four years? Correct?

    Part 11 - Children
    I still do not have children. Write N/A or blank?
