    I'm not sure about the exact details of the whole thing...I just remember that 2 or 3 people tried to expedite their EAD/AP's due to various circumstances, and ended up waiting longer. I'll try to look through the thread and see how long it took for them to get their cards.

    Starting October 18th, spousal and fiance visa's will also be banned :(

     

    I believe that there will be some sort of case-by-case deliberation however, and I think that if you can prove that the ban will cause you some sort of hardship, then they'll make exceptions. Again, this is case-by-case and I'm not exactly sure how easy it'll be to prove a hardship. At that point I would say that it would be best to get an immigration lawyer involved.

    It depends on the officer, how far along the mother is, and why she claims she's visiting the U.S. CPB's are trained to ask look out for these types of scenarios; no one is guaranteed entry into the U.S. unless they are a citizen. I'm not saying it's right, or that it'll happen, I'm just saying that it's better to be prepared for all possible scenarios. Prove that you can afford the delivery costs, and hope for the best.  While it isn't illegal to deliver in the U.S, it's also not illegal for a CBP to turn people away, sadly :(

    I was in secondly once and saw a pregnant lady denied entry because the CBP said she had immigrant intent

    Also saw this before. Chances are that they will deny you at the point of entry if your intent is for immigration purposes and if you can't prove that you are able to pay the medical expenses.

    A lawyer can't guarantee that you won't receive an RFE....

     

    Either way, it's up to what OP wants. People who use sites such as RapidVisa generally pay for the peace of mind. You can very successfully handle your own case (no one knows your case better than you and your fiance), or you can choose to go the RapidVisa route. On this site, you'll find that most people will be rather insistent that can do your case on your own.  There is no service that can make the visa process go any faster, unfortunately... so do what you're most comfortable with! :)

    File charges on her if she physically attacked you. Take pictures of everything as well. 

     

    I believe that if the marriage was entered in good faith, OP can still get a green card if he's the victim of domestic violence? Can someone check me on this? 

     

    Also, best not to generalize American men or women when at least half of all users on this site are American...

    It honestly depends on what you want to do. If you know you want to get married, then I would apply for the K1 AFTER you two meet in person and have evidence that you met. The K1 visa allows you to go through the AOS process. As far as I know, the B2 visa will not. So if you want to get married, and have your husband become a permanent resident, then go the K1 visa route :) 

     

    And I bet! It's certainly and exciting time! :D I can't imagine what it would be like to wait to meet someone for 12 years!

    Should you decide to go through the K1 visa process, Visa Journey is an amazing resource. I did all of my husband's K1 and AOS paperwork on my own with the help of this site :)

    Ah, then no worries on the financial part! 

     

    NOA1-this means that the USCIS received your petition. You will receive this when you submit your application for a K1 visa as well as an AOS application (adjustment of status, AKA the green card).

    NOA2-this means that the USCIS approved your petition! In the case of a K1 Visa, after your case is approved, it will be sent to the NVC (National Visa Center) where it will be further processed and then sent to your fiance's country so that they may review the case and further it's progression. All in all, your K1 visa petition will be reviewed by 2 countries.

     

    There is no NOA3 :)

    People who who are eligible for the VWP (visa waiver program) are unlikely to be approved for a B-2. So I wouldn't get too excited about that. 

     

    Take it slowly. Meet him in person first and find out if your online lust for one another transfers to real love for one another. 

    My husband was approved for a B2 before we went the K1 visa route, as we anticipated that he may stay longer than the given 3 months on the VWP.

     

    However, the finance thing *is* something to think about. My husband went back to the Netherlands to save up for a while so that he would have plenty of money when he came here. The AOS process is looooooong and daunting. And from what I've been reading, it's taking even longer now than it was when I applied in January. You also have to make 25,525 annually in order to qualify for the K1 visa as your household will have 3 people in it.

    1- Can we apply for a K-1 Visa while he is in the states??  - I sent the paperwork in for the K1 visa the day my husband left for his home country after a 3 month stay. However, your fiance would need to stay in his country while you go through the K1 visa process. 

    2- How long does it take to get approval for the Visa? It varies. It can take as little as 3 months an NOA2. or as long as 10 months. After that the case gets sent to the NVC, then to your fiance's country where they will require him to get a medical done as well as an interview. Our whole process took around 6 months, but that's considered pretty fast.
    3-How long do we have to be engaged before filing for the K-1? There's no requirement as to how long you need to be engaged :) My husband and I were engaged for 2 months before we filed.

    4- How soon upon his return to the AUS can he apply for the Visa? See answer 1 :D 

    5-Would you suggest him coming back on a B-2 Visa for the 6 month duration, and apply in the states for the K-1? I wouldn't suggest that he file for a B2 after filing for the K1. It may be considered fraud.

  12. I would go ahead and send it in. We got an RFIE when we didn't submit our 2016 tax return even though it was January when we submitted it and it was too early to do taxes <_< In regards to the marriage certificate, sometimes the USCIS loses stuff, as infuriating as it is :/ Unfortunately we have to play by their rules and have to make up for their mistakes. Send the evidence that you have and just bring it for the interview as well! :)
