  1. @LynetteMN Our immigration liaison with the Senator's office mentioned the option of filing for an expedite request, but thinks we don't have enough to prove the need for it.
However, USCIS claims to review and deal with these things in the order they are received. So how is it not a clear error on their end, when they process cases from later years and ours sit there, despite never having gotten a request for additional information, etc.

Since you spoke to lawyers, did you discuss any of this with them? Would be curious to hear what they think.

  2. @LynetteMN Our cases follow the exact same pattern, the last online update is that the fingerprints were added to the case in October 2022 (after it said it was ready for interview since Feb 03 2021)
(They were taken in December of 2020 - initially scheduled for late March 2020, but the country was shut down at that time, so they rescheduled them for that December.)

I have had a number of extension letters, I-551 stamps in the passport, and same here, now I have this piece of paper (I-94) where they actually even got the typing of the I-751 wrong, it reads 1-751...

@OldUser Thanks. We will look into a WoM.
Naturalization does not work for me, unfortunately. Austria generally does not allow dual citizenship and will all my family being in Austria I am not willing to give up the EU passport just yet. Covid showed that sometimes that's the only way to get back for a visit.
Will read up on a Writ of Mandamus.

    Thank you, both!

  3. Anyone else from the November 2019 filers still waiting?

We have reached pretty much the end of the rope when it comes to wait time. We do have a couple of things in life that need me to have my conditions removed and my physical card in hand at this time.

We did contact our Senator and they made an inquiry on our behalf, but all that came back is that it is ready to be scheduled for an interview (which we knew and can see online and it has been ready since Feb 2021) and that they do not provide processing times for I-751.

Case was initially in Lincoln, NE then transferred to Lee's Summit and then to Denver (which is our closest field office).

  4. Are all biometrics appointments cancelled/suspended?

The USCIS website states that they are suspending routine in-person appointments, but they also say "All ASC closures are posted on uscis.gov: For up to date closure information, visit the USCIS Office Closures page." There they only list the California Offices as being closed (due to shelter-in-place requirements).
Wondering if the Aurora (Denver) ASC is shut down or not.  As always, plenty of contradicting information on the USCIS website.

  5. Thanks Redheadguy03, I have tried this.

Guys, thanks for your help here but I understand the origin of the problem, it is just that I am not an admin or a coder to fix this problem here on the vj website.

    To elaborate:

I looked at several timelines, postings and profile informations from users. There are people getting processed by the field office I am referring to (we are talking about greater NYC area, I am not the only one who lives east of JFK).

But because one cannot find Long Island in the drop down list, one has to put in NYC as the field office. Simply because the Long Island one is not listed as an option.

What it does: not showing results for LI because nobody can select it (and therefore the website doesn't/can't produce a statistic). And it also distorts the accuracy of the actual cases that are handled by the field office in the city...

Maybe one of the admins can look into this.

I rephrase my question: Does anybody know why the Long Island Field Office is not on the list of selections which can be made when updating the timeline in the AOS section for AOS Field Offices?

Once VJ puts this as an option, people can select it and over time it will produce statistics.

  6. Good afternoon from sunny Long Island,

does anyone know why the field office of Long Island (located in Holtsville) is not listed on the table of Visa Journeys processing times (AOS from K1 visa)?

They do handle I-485 applications  in Holtsville according to the USCIS website and also have a processing time table which lists I-485 as a category.

The database from visajourney has proven very accurate for my journey so far, therefore I would be interested in seeing what the (past) experience/timetable of other users petitions who have been processed/adjudicated is.

Thanks in advance and happy Thanksgiving everyone!

    Chris

By processing times they mean they're processing cases they received in October 2016 you can always put in a service request online to see if you can get any more information on your case.

    Thanks.
However, my question still remains. What is meant by "processing" are they then literally about to start working on the case, or is this when they make a decision.
(Since some cases go without an interview and some require an interview - which my guess is: they have to schedule in advance and therefore take even longer).

I am considering a move and I'd like to figure out more about timing. So maybe some folks how have their GC now in hand can let me know more about the process.
How many weeks are usually between getting the interview date and the interview, etc...

Unfortunately, they won't respond to my service request because it is not outside the processing time (they do not assign an agent to my service request) and when I try to call them they can only read to me what I can see on myuscis anyway...

  8. Hi all,
I have a quick question about the "processing times".

I am still waiting to hear anything on my AOS since the last update was "Response To USCIS' Request For Evidence Was Received" on February 28 2017.
According to the USCIS processsing times my local field office is "Processing Cases As Of Date:  October 10 2016". What is meant by processing?
    Final decision?
They start working on the case?
How long in advance do they send out interview dates? (They have to budget some postal run time, etc.)

Maybe someone who has been approved and had an interview can give me some information...
We are considering to move and since there is so much trouble going on with address changes, I am hesitant to do so.

    Thanks in advance.
    Chris

  9. Hey Courtney,

I did not put in a request for expediting my case, because the day I received my formal employment offer letter, I saw that my status had changed to "card in production". The card arrived 9 days later in the mail. (The very next day I started working, haha. Shows how desperate I wanted to work, so hard to wait for the day to come when I was finally allowed to make money.)
My VJ tracker says it took 94 days for my EAD to be approved, if that is of any help.

I'm afraid I can't help you with your specific question, since I did not place a request for expediting my case, sorry.

Good luck, and I hope you will have your EAD card soon!
    Chris

  10. Thanks a lot Karlzy, :)

I should get the job offer letter today (wasn't formal enough at first -just an email, so I didn't wan't to risk sending that one in) from the company.
Though I am not sure if I really need to expedite it anymore because when I checked back to mycasestatus it says: new card is being produced.

Finally, it seems like my long wait is about to come to an (hopefully soon) end! :)

Thanks to y'all in this thread for input, I appreciated it!

  11. Hello community,

I am wondering how long my EAD will still take. USCIS received my case at  Jan 17 2017, NOA1 dates from Jan 24.
I have a written job offer and I am wondering since I am getting close to the former "guaranteed" 90 days if I shall wait for them to process it regularly or try to place an expedite request.
The company is heading into peak season from this week on, so they would like to have me there working asap. Also my savings after several months without an income are coming to an end (living in the Hamptons, isn't cheap, haha).

Do I risk anything with placing an expedite request?
Does this thing even get to the desk in time where my petition is dealt with?

    Thanks in advance,
    Chris

  12. Sorry, to read all this and it seems as there were quite a few of these cases last time.

But my question is: who filed all your paperwork to A, get into the country and B, the registration to vote?

Even in your home country it should be the same thing: you can't vote unless you are a citizen...
This is the one of the key points between a GC holder and a citizen. No one can tell me I did not know that.

I did quite some research and I am still in the process of getting my GC and EAD but it seems people really do not have an interest to know what there rights are, what their new homes rules are, etc.
I am reading books about colonial america and the history of the United States, sure it is sometimes oppressive but it is so interesting to get to know more about the country you live in and its cultural habits, traditions, etc...I see that not everyone is like that but I feel like you should at least know what your rights and obligations are.

Hopefully there is a way out of this dilemma but from all the information that I have gathered, this is a serious -and it seems like an unforgivable- mistake you have made. Sorry.

PS: did not know about the situation in NZ. Thanks for sharing.

  13. Dear VJ members,

I recently bought a new road bike which I want to take with me when immigrating to the USA.

Since it is not in my possession for more than a year I can't claim it as a personal item that is tax exempt...

How much will the duty/custom/tax it be?

I can't find any information regarding the amount of money it'll cost me.

It's a trek road bike and was slightly more than 3000.

Thanks in advance for your answers.

    Cheers, Chris

  14. Hi @ all!
Congratulations to all who are already married or at least have a visa in hand.

Unfortunately we aren't so lucky, but by now I am starting to wonder what is wrong with our petition.
We didn't get an RFE and received our NOA2 in early July. In August NVC sent it back to USCIS because there was a signature missing (not one of mine or my fiancé, it was a mistake caused by USCIS and NVC found it) it took them until Sept. 21st to approve it again.
We have a case number (since weeks) and by calling NVC we found out they received our petition with NOA2 dated from Sept. 21st on Oct. 5th. Despite being over the estimated days (5 or 6 according to VJ and timelines of other petitioners who got their NOA2 around the date (in September) we did) it is still at NVC. And they can't tell us when it'll be processed. Why??

Is there anything we can do to speed up the process? It seems odd that our case is delayed in every section for no reason.

  15. Our case was updated, and was approved by USCIS!

I did mailed a physical letter to the USCIS Service Center that had our case, outlining all dates we had received updates so far, and that there was an issue. I overnighted it, with return receipt requested so that I would know for sure if they got it. But given the dates that I sent the letter in, and when they approved out case, either it worked immediately, or they just approved in their own time and it was a coincidence, I'm not sure.

From when the NVC sent our case back to USCIS , to when USCIS approved it again was about 5.5 weeks.

  16. Hi,

I am the petitioner and filed on April 21st, 2016 the I-129F for my fiance in Austria.

Our case was approved on July 7th, 2016, and sent to NVC. But on August 1st NVC sent it back to USCIS, and USCIS says they received it on August 12th. It has now been well over a month and there has been no update on our case, and I can't get any information by calling.

I didn't even get a notice that it was sent back, I only found out because I called the NVC after it had been in their offices for over 30 days. All they could ell me was that their file notes said it was sent back for "missing signature page". I know for certain we didn't leave anything out of the original application, so I don't know what it could be.

What can I do now? Has anyone else had this issue, and if so how did you resolve it or how long did t take? Hearing our case was approved was so exciting, but now hearing it has gone backwards rather than forwards is so hard. Please give any advice to help us get out case moving.

Thank you in advance for and help,

    Elena
