    The evidence they cited is a suggestion. Send them updated versions of everything you used to file (lease, bank statements, IRS transcripts, insurance, etc.) and anything else you might have accumulated since 2018. Good luck!

    We have a joint bank account and sent them statements that include both our names. As for vehicles, she owns a car from before we got married. We're going to be including me in the title so hopefully that will be one additional thing to add.

    Yeah... Despite life insurance policies with our name on it, rental agreements, joint tax returns, affidavits from family and friends, pictures, documents from the military recognizing our marriage, they sent a notice saying that we haven't provided enough evidence to show our marriage is in good faith. They listed out that the evidence they require is proof of children together and joint property or assets. But we're a same sex couple so children isn't exactly easy for us, and we're a military family and don't own property since we move so often. So... I don't know what more I can send them.

    Just wanted to see if anyone has used a lawyer in Honolulu or know of anyone they'd recommend?

    I filed for I-751 lifting of conditions back in June 2018 and I received a notice that is a little.. concerning?

    I've been able to handle all immigration applications myself but this is a situation I'd rather have professional help with.

    So I am still waiting for the removal of conditions but have been here 4 years and would meet the requirements aside from my case still pending

    This applies to the consulate interview and more to the following interview when you file the adjustment of status, but of the pictures you do have, if you have any of both of you with his family or friends, I'd bring those too. We brought tons of printed pictures of the two of us but at the interview they wanted additional proof that I was integrated into my spouses life and vice versa, and they requested pictures of both of us with each others family and friends. We printed out screenshots of our phone call records with the length of time we had talked, plane tickets, my wife was asked about my parents background and where they were born, and emails we had written.

    Definitely agree with Loren Y, don't leave the continental US. Once he gets accepted into the country, you can't leave until you receive your conditional green card or advanced parole.

    I figured they wouldn't but my last landlord insisted on it, and I was still working in Canada at the time so it wasn't a problem. This time it's through an agency so might be different.

    I have not yet tried it as i dont want to pay for something i do not need at the moment.. but if you do try it please let me know how it goes!

    I do however understand that the rest of the options are mail home only. 

    I don't know if I pressed the wrong option or whatnot, but the only options I got were for mail or it asked for current address, but wouldn't accept my US address. I'll check out the link you sent though. Maybe if I call and do it through the phone, it might work.

  9. Hi all!

     

    Just a quick question for those who may know.
    My spouse is military and we will be moving within the next month, however our (hopefully) new landlord wants both of our credit scores, but I haven't had a chance to establish a line of credit here in the US. I do have a good line of credit with my Canadian credit, and would like to provide that, but I can't find a site that will allow me to do receive it online and the only other option would be mailing, but it would mail to my last address and there's no option to change shipping address. 

    Has anyone else encountered a similar problem?
    Any ideas on how to go about this?

    If you are joining your spouse overseas, and you are on her orders as accompanied, then there is the option to expedite the naturalization process :) 

    I didn't know I could expedite that, and depending on how soon we'd have to leave I might be able to get that done. Thank you!! :)

    my spouse is in the US military and there is a strong possibility of her being stationed overseas. I recently got my green card in June, which states I couldn't be out of the country for more than 6 months a year.
    Does USCIS recognize a US military base as a US residence? Will I be able to accompany my spouse to their overseas base or will I have to stay behind for the duration of her orders?

    She thinks she's had a coworker with a greencard holder spouse who has accompanied because they said that USCIS recognizes military instillations as US residence, but I just want to double check..

     

    Any advice or help would be very much appreciated!

    In terms of part 7 we had written where we wanted to travel and for a family emergency, but on a seperate paper, I wrote out the situation, the dates, etc.

I did check 1d stating: "I am applying for an Advanced Parole Document to allow me to return to the United States after temporary foreign travel" but I don't see anything where I would have explicitly stated that my Adjustment of Status was pending, because we had sent the I-131 WITH the adjustment of status, so we didn't think we needed to explain that. 

    I'll definitely call them tomorrow to clarify and request to speak to a tier 2, and see what they can do. At this point my wife was just going to go without me, but if they can expedite it we'll see.
    I'll check with them again tomorrow but I'm not sure if we should send the denial back with a letter explaining the situation too.

    My name is Elle and my wife and I are a little bit confused.
    We filed for permanent residency back in November, along with the Advance parole application to visit a relative living in the Philippines with terminal cancer. The permanent residency application was accepted and is still pending, but the advanced parole application was denied due to insufficient funds. At the time we were sending both applications in November, we were told that it was all one big fee with the I-485 form, so we didn't need to send an addition money form. So when we were denied, we were a little discouraged and have been saving the $575 fee to resubmit the application. 

    So I just went to look again on the USCIS website to make sure we weren't missing anything, and it clearly says:
    "Note: You do not need to pay an additional fee for Form I-131 if:

    • You are filing Form I-131 Application Type B or D;
    • You filed a Form I-485 with a fee on/after July 30, 2007; and
    • Your Form I-485 is still pending."

    I intend to call the helpline to clarify why we were denied when it clearly states this on their website, but the office is closed now, so I figured I'd ask here. 
    Does anyone know why we would have been denied for insufficient funds?

  15. Hello, can you clarify, no timeline to file AOS meaning some people can choose to take their sweet time to file for AOS after marriage right?

    But at the same time will also be out of status? How long is the validity of the I 94? Wouldn't "out of status" be the same as being in the US illegally and thus, at risk of deportation/prosecution?

    I have a lot of the same questions which is why I'm unsure of what is going on. As far as I know, the I-94 lasts 90 days. The customs officer wrote down the expiration date as 3 months from the day I entered the US. That being said, I assumed that filing paperwork past that expiration date meant that I was in the US illegally even if we had married during that time. I don't know if the fact that I've sent in the AOS package means that my status has changed or not, so I guess based off of what the other members have said so long as you get married within the 90 days, you're fine?

  16. Hi everyone,

    So my K-1 visa was approved back in August, and I packed everything and moved that same month. I went through customs August 21st, and we were married August 24th. The customs officer wrote that the expiration date would be November 18th however, due to some trouble getting all the forms together, we only sent out the AOS package yesterday. We express mailed it to Chicago, and they told us it would arrive at the location by 8am on Nov 14th. We're very worried that my entire application is going to be terminated if they don't file it before the 18th.

    I've been reading very conflicting statements online with some claiming that since we married within the 90 days I should be okay if they file it after, and others saying that if they don't file it before the 18th, I'll be liable for deportation.

    Does anyone have any advice or know of which is more likely to be true?

    I received package 3 and am about to send it back to the consulate, I just wanted to ask a quick question to see if I am overthinking a certain part.

    There is one part of the checklist that says: __ Letter of intent to marry signed by the petitioner within 30 days of interview date

    Now, of course my fiancee will send it to me when the time comes, but I leave this blank right? Since I don't have an interview date yet and don't know when I will?

    I just don't want to make any mistakes.

    So I called NVC today to see if out case has been forwarded to the embassy in Montreal, and was told it was mailed 2 weeks ago.
    I haven't gotten packet 3 in the mail yet, so I was looking to call the DOS, however when I called the number I was told that the number is out of service.
    Is there any other way to find out the status of my case, and whether packet 3 has been mailed yet?

  19. 1) if she's active military it's 100% vs 125%

    2) She maybe uses USAA? She should be able to do online banking and print out statements from there, but it's not really needed unless she's trying to use assets. We use USAA and there are no branches near us but everything can be done online. I was even added to the account by emailing my signature card.

    3) She should submit her LES. She can go onto a website called mypay to get them. Tell her to ask her CO or the HR on base if she's confused about this.

    She's getting her commander to draft a letter of employment, but is there anyone he should make it out to? Like the American consulate in Montreal or just "To whom it may concern"?
