    Yes I did see that but got confused about whether J-1 was considered lawful non immigrant

    My hubby is getting ready to file his N-400 but the selective service question is totally confusing. He came to the US when he was 25 but on a J-1 visa and then left after a year to go back to France. We lived together in France between the time he was 26 and 28 and then he came back to the US with his green card when he was 28. He never got anything about a selective service registration and we're panicking because we're nervous there was something he was supposed to fill out and didn't. He did live in the US before he turned 26 but on a J-1, does that mean he was here as a lawful non-immigrant? The wording USCIS uses is a mess

    Did we screw up?

  4. Thanks for your responses. So it looks like there's really no point in waiting, other than that when you apply you have a copy of the 10 year GC to send it with your application as opposed to expired GC and extension letter.

    My husband applied for his I-751 back in July 2016 at VSC and we are still waiting for approval. His GC expired 9/30/2016 (was granted 9/30/2014), which means that under the 3 years -90 day rule he can file his N-400 in early July of this year. I'm sure that there are many people in this situation right now (thinking about applying for N-400 before I-751 approval). Curious if anyone has gone ahead and filed and if so what has their experience been like? Is there any downside to filing before I-751 approval? Or is it better to wait?

    I know technically they can't approve N-400 before I-751 but I heard that sometimes they do both simultaneously or that 1 can force the other one to be adjudicated? 


    Also, is it better to apply for N-400 online or to send it by mail? Seems like the online option is pretty new, anyone had any issues with it?

    I guess it depends whether or not they would transfer your I-751 to the local office where you live, I heard that those local offices can sometimes take much longer to process files than VSC or CSC
    Local congressmen should be able to tell me whether or not my case has been assigned right? Guess if it has I'll wait and if it's still going through security checks I'll go ahead and file in the hope that I can push them to approve it...

    Thanks for the encouraging words :) I will probably wind up filing N-400 by late July if I don't hear anything by then. Maybe reaching out to congressmen by mid-July would be good. Last time my I-130 took 1.5 years, I'm hoping it's faster this time

    Employer can't require any specific documentation as long as the I-9 requirements are fulfilled. I used a Global Entry card and SS card and they had to accept that.

    After the letter expiration he will still be a LPR, just without proof of status. He can continue working no problem.

    So as long as he can provide a valid drivers license and SS card he fulfills the I-9 requirements, correct? If thats true does he still need to get the I-155 stamp 30 days before the GC expiration?

    OK this is very comforting. He has a MA drivers license that doesn't expire until 2020 as well as SS card. So meaning he doesn't even need to provide the expired GC and extension letter for proof of employment authorization?

  10. Hi Everyone

     

    My husband applied for his I-751 in July 2016 at VSC. I suspect given their latest processing times that we have another 1-2 months min of wait time before we hear back anything. His GC expired 9/30/2016 and the extension letter was received 7/6/2016. He's now looking for a job and will probably (hopefully) get one soon and I know that he will have to submit proof of employment authorization. Will the HR at a company potentially not hire him because they think he can only work until July or September? How should he explain this to potential employers? I know we have the option of making an infopass appointment and getting the I-155 stamp to get another year extension but we can't do so until 30 days before GC expiration.  Has anyone had this issue?
