As has been wisely suggested, you need to contact an attorney. This is not a "self-help" situation you are in. You would have had to sign the voter registration in order to receive the card and Missouri voter registration specifically states you must be a US citizen in order to register. In the eyes of immigration you have misrepresented yourself to be a US citizen and it will definitely be asked during the naturalization process whether you registered to vote and/or voted.

It will not matter to them that you were here only 3 weeks or did not read what you signed. The burden is on you, the immigrant, to ensure you are following certain regulations and registering to vote is a serious matter. Please be sure you receive professional assistance.

I have wondered about this too. I was married in November, and I filed taxes as single. I am still listed as single.

I was told by someone in HR at work that I wouldn't add her to insurance etc. until she had her visa, and SS#. Until then, I should remain single.

I dont know if this is true or not, but I havent looked further into it.

You will need to amend your return. If you were married in November you must file as married (as married filing jointly or married filing separately). If she has no SS# you would need to follow the procedure to request an ITIN. Filing your taxes has nothing to do with how you are set up at work or whether or not you can add her to your insurance. You cannot file as single if you are not single.

As far as the stimulus check, you will need to contact the IRS. You might just have to declare it on next year's return, or it may depend on whether your wife will have her SS# by then, but they should hopefully be able to guide you on how to rectify that or you might check the FAQs on the irs.gov site. If it hasn't been submitted to you yet they might be able to cancel it if you contact them right away.

Also, once your wife obtains an ITIN it may be acceptable to your employer so you can add her to your insurance, etc. The number is formatted just like a SS# but you might explain it's an ITIN so they can confirm if it can be accepted. Each employer is different on how they handle that.

I'm assuming you mean an affidavit provided regarding your life as a married couple and not the "affidavit of support" normally referred to here as the I-134/I-864. If so, then yes she can. If you're referring to the I-864, it isn't needed for the I-751.

Or missing the part at the top of Section 5 where it states "do not count anyone twice". You can stop scratching your head. If you've already counted her, you don't count her again. That form has multiple uses, so it applies in some cases to count a wife in the event she wasn't included on Line 10, Part 3.

We ran into this situation when adjusting Dawn's status because she received a citation shortly after she got here.

We included all the documents we could (the citation, proof of payment, email from the clerk showing the incident closed) but still received an RFE. We ended up contacting the clerk's office; she tried to tell us there was nothing else to provide. After a bit of extra prompting, we were able to get a letter from the city attorney on their letterhead explaining he held the position of prosecuting for the city and that there were no court documents, etc to provide because the incident was closed after the fine was paid, etc. After sending that it seemed to satisfy them and her AOS was processed shortly after receiving the letter.

The I-751 was changed a few months before we submitted David's I-751. The verbiage used to be "since in the US" but became "ever". You will want to answer "yes" as has already been suggested.

David hadn't made a copy of the police report he had (when he got the K-1 visa) . I included a copy of the original attachment letter from when we had submitted the I-485, explaining we no longer had a copy of it and had already been submitted, and basically just left the original details that described what happened (dates, disposition, etc). After I sent the I-751, fearing an RFE or rejection, we arranged to receive another police report from England in case it was needed (and to avoid missing an RFE deadline since it would take a while to receive had we waited).

David's I-751 was processed without incident; we didn't receive an RFE. It was rejected originally but not because of that. We do have a copy of the police report now though...will probably submit it if he decides to pursue citizenship, I'm sure we'll need it then too.

I've read that when one has dual citizenship and, in the case of a UK/US citizenship, travels to the UK they should show their UK passport when entering the UK and show their US passport when returning to the US. Yes, I still notice David's accent and it still makes me weak in the knees. He hasn't seemed to have lost it since he moved here in 2004, although he does use more American terminology than he used to...but at least it's still with his accent (which makes it sound even funnier sometimes).

Hey, things are improving though! When we submitted AOS in 2004, Chicago was estimating 2 years for processing at the District Office (none/very few were being transferred to CSC for approvals without interviews) and we were thrilled we were done in 10 months.

I'm Aquarius, he's Scorpio. We had warnings about some aspects of our match but we did it anyway. The warnings were true but the good parts are VERY good.

Someone who waits for AOS is leaving themselves in a very precarious position if they wait just to avoid the hassle or fees of lifting conditions on a conditional green card. No one likes to think of it but what if something happens to the USC or their marriage in the meantime? I certainly wouldn't want to leave myself in such an unstable position since it would be nigh impossible to adjust status should anything happen, not to mention being "trapped" because of a lack of EAD or AP. That in itself would hinder adjusting to one's new life here if nothing else.

That my husband was still married when we got married. I've been legal resident (based on marriage with a US citizen) for more than 6 years... I'm ready to become a US citizen and file my N-400 BUT.... they ask me for divorce papers from my husband's prior marriages (he is my first and only husband)

now he is a Vietnam vet and suffers from all kind of mental illneses PTSD, flashbacks, etc.

So he says that he doesn't remember when he got married or divorced or nothing. I know that he was still married because we just found out his ex and she told us. She lives in GA and we live in CA.

Now...not sure if I really need his divorce papers when I file based on ... I got into marriage in good faith and we've been married since 2000.

I cannot pay a lawyer, I was ready to do the paper but now I really don't know...

If anybody knows if the divorce papers after 5 years of being resident will delay my citizenship from going through...

This doesn't make sense. If you are LPR based on marriage, the question regarding any marriages/divorces came up at that time as well. What did you put on the original paperwork, and with what supporting documentation, when your permanent residency was approved in the first place?

This topic brings one question to mind for me. Are proof of taxes going to be needed for the AOS interview? Or will they be going by what was submitted at the time of applying for the AOS?

They will have what you've submitted to that point but depending on when the AOS interview is (if you have one) or when it's processed (at CSC) you may need to bring more current or updated information, or submit to CSC in response to an RFE (if they feel they want updated or more current documentation). I was asked to provide the previous year's tax return at our AOS interview because another tax year had passed by that time, as well as an updated I-864 with my current income.

You will, of course, want to take the originals of what you have already submitted as copies in the event it is asked for at the interview.

In your first post you mention she must wait to get her divorce finalized but here you speak as if she might already be divorced? If her ex has already remarried it would be a reasonable assumption they are already divorced or are remarriages allowed there without being divorced?
