  1. Great news! :)

     

    Today wife received green card in mail. Woohoo! :D

    To answer question from couple posts ago, there is no indication that green card is conditional. Expiration date is two years from approval date and category is CF1. Nothing else indicating that it is a temporary/conditional.

     

    Thank you everyone for following along this journey, help, and all of the support during the process. See you soon when lifting conditions :)

    I assume it something like temporary driver license here in oregon. Because  EAD expires in a year, driver license also expires in a year but also there is a note "LIMITED TERM"

    So maybe on temporary/conditional greencard it will say something similar. Will know for sure in couple weeks.

    Thank you, just one less thing to think about now. They are probably working on May-June filers at this point, since we are march filers with May RFIE response.

     

    My theory is that with our case, because we had RFIE on I-485, all our cases were reset as if we filed when RFIE response was received.

    I checked estimated processing times that this forum provides and it was pretty spot on in terms of EAD/AP applications. Meaning on the day we received status update for EAD/AP the processing date on this site was May 18 or 19. Pretty much the date our RFIE response was received. Also I took a look at list of all timelines that filed on May and some of them already had interviews scheduled for similar date as ours. Even now looking at timelines I can see that a lot of May-June filers seems to have interviews scheduled or are within window to get their's scheduled.

     

    Anyway, what I was trying to suggest was that in our case RFIE reset the filling date to that of RFIE response received date for all of our applications. There was a conversation about this before we got any updates, so here is our story. Anyone else with RFIE on their AOS application, check estimated processing times for EAD and AP that this forum provides when you get an update on EAD/AP. Let us know if processing date was close to the date your RFIE response was received by USCIS.

    Sorry to burst your bubble but those two letters are most likely the approval notices. The actual card arrives in a big white envelope with red highlights saying priority mail and that one comes with an actual tracking number so you should see that come up in the USPS app.

    You almost did it :D:D As I read first few words from your post I remembered reading that it comes in bigger envelope with tracking and almost got bummed out.

    Luckily it looks like there is also an envelope from US citizenship and immigration services, which I didn't know about until now. Woohoo! Out for delivery already too :D

     

    I am so excited for this to finally move, just like when I was applying for citizenship for myself ^_^

    Congrats! We are hopefully just a month from you :) 

     

    A lot of members used to keep up here but just like with K-1 thread it dies out as people get approved. Wife's EAD combo card is most likely arriving today in mail. USPS informed delivery showed two letters from NBC.

    Fingers crossed that those aren't just notices and there is finally a card in there :D

    I think USCIS should waive the second medical for K1 adjustments... it just seems odd to me that we have to already go through the hassle of having a second interview with documents gathering etc. and time schedule conflicts (no vacation around this time) and then even have to worry about spending another $300-400 again on another medical. I'm starting to think that I would've rather had a waiver and just waited a little longer for the approval ;) 

    I too do not understand the need for second interview for K1 adjustment. Green card that is issued is still a conditional permanent residency privilege, so perhaps it would be more appropriate to have an interview when removing conditions. I mean in first year we haven't really gone through much so interview is just going over application and a conversation. Something that has already been done when getting K1

     

    On the other note, I checked Immigration Timelines tab just now and noticed something odd. Processing dates for employment authorization and advance parole are current May18th. This is very close to the date that our RFIE response was received. Add the fact that employment authorization and advance parole statuses changed recently and today. 

     

    So if anyone else with RFIE is still waiting, please do us a favor and check processing times tab when status updates. Maybe this is just a coincidence or perhaps there is theme going on. In our case RFIE seems to have reset the timeline for EAD and AP.

Yours will just have expired so the IO might just let it go and be fine with the 'old' medical. You can read so many cases and won't get a definite answer on the K1 medicals. Some officers go by the fact that as long as you filed AOS within one year of the medical, you are fine and others go by the rule that the interview must take place within the one year timeframe the medical is valid (which is the official USCIS rule). It's the question whether you potentially want to waste a couple hundred bucks to play it safe or rather wait but have the peace of mind that you won't get an RFE for that and can potentially have the greencard two weeks after the interview or not... it's personal preference I guess.

    So there is no definite way to tell. Called up couple office nearby Portland and the lowest price I could find was 315$ with no vaccines. Guess we can take our chances and see what office at the interview says. Thank you again for the insight

You are right, as soon as you get approved for the greencard, the EAD technically becomes void which leaves you in some sort of a limbo if you were to travel abroad with EAD/AP but have not received your greencard yet. Yes, I've read that there might be the chance that she would get lots of problems at the border in this case, but then again I feel like this must happen quite often with people who just get waivers and might be abroad in the timeframe their adjustment gets approved. This must be a grey area but I've read that technically the EAD is void and you would need the greencard to enter, however they should still let you enter if it happens to fall into this odd timeframe... 

    3. Also keep in mind that you could potentially get a RFE/RFIE at the interview for missing documents or even renewing the medical (if adjustment is from K1 visa and it's been over a year), so it would take a while until you get the greencard and then it would suck if it gets all of a sudden approved while you are abroad. 

     

    Obviously in the best case and likely scenario you will have the greencard in hand two weeks after the interview, it's just the question whether you want to play it safe and not book anything or go with the likely scenario. :)

    Today we got an update on AP saying that case was approved and right after that EAD case status changed to card has been mailed. I guess in our case those two went along together.

     

    So about medical, it has been a year this august 5th. We filed paperwork in March while medical was still within the timeframe, but it was not included in the paperwork (forgot). Then when we got RFIE for financial support, I went over the papers and realized the mistake for not including medical. In RFIE response we included the medical as well and explained that it was not included in original papers filed.

     

    Do you suppose we will get RFE/RFIE for the medical at the interview in our case? Technically we followed the guidelines of having valid medical when paperwork was filed, but I don't know and haven't researched what would happen if medical is expired during interview.

     

    Maybe it is worth the trouble to get it done right before the interview just in case.

  9. My wife and I are thinking about finally making a vacation trip outside of USA, and in current situation that we are right now I would like some input from forum members.

     

    On September 1st EAD status changed to new card is being produced, so maybe two or three weeks after that we will see the EAD card.

    On September 27th we will have our AOS interview. If we receive EAD card by that time, is it going to be taken away at the interview? This is just my guess, but if they do then AOS decision has probably already been made and green card will be issued as a replacement. Is my guess anywhere near close to the truth.

    Now in case that my guess is true and they will take EAD at the interview, what happens if we do not receive EAD card before the interview? Is there going to be a second interview to turn in the EAD card, or does EAD card become void assuming positive decision on AOS? If it does not become void and/or it is not taken away at the interview, then would there be a problem if we travel after the interview but before green card is in the mail? Could she be denied entry with EAD in this case?

     

    To note, this is only a "what-if" kind of questions. We haven't made plans 100% and are just in process of figuring it out. Good vacation deal was offered to us and if our situation permits it we would love to take the deal.

  10. Just called USCIS regarding EAD since it has been 75 days since USCIS received a response. The reply was basically that they are processing papers from March 3rd (or 5th) and our paperwork was submitted on 27th. They are backlogged and in this case should hopefully make an update within 30 days.

     

    For some reason I have a feeling that because wife's AOS received RFIE the receive date for EAD will also reset to the receive date of RFIE response.

IO came out and called my name, he was not smiling but professional and polite, took us into his office and swore us in... then he went through our full names and date of births and address... then he went through the questions on my i-485... then he asked my wife where we had met and around what date... then he asked if it was both of our first marriage and we said yes, then he asked if either one of us had kids and we said no then he asked who are the kids in those photos and i was pleasantly surprised that he had actually personally looked through the pictures and i said those where her niece and nephew... then he asked if we had any extra evidence we want to submit and i gave him our wedding album and my sealed medical form... he said we did a background check and everything looks great that your marriage is bonafide and your green card is approved!!! he then went to get some copies of some of the pics from the wedding album (we had already submitted close to 38 pics with the application) and then he said you will get the card within two weeks and explained ROC and naturalization... then he asked us if we had any questions and we said no and he lead us out... hurraay!!! i hated that we were all tensed up as  the interview appointment letter had mentioned a long list of things to bring to the interview and we hadn't gotten an employment letter from her boss and didn't have the most recent pay stubs but he didn't even ask about them... so i guess this process is finally over for now... thanks to every single one of you who has read my posts and answered my questions and been a part of my journey, you guys made it easier for me... thank you...

     

    P.S. I'm kind of worried that i haven't gotten an update on my status online yet, interview was at 1:30 PM and now its 12 30 in thew morning and no update yet... I am gonna post this same comment on the March, April and May 2017 topics as there are people on each who have supported me through this process...

    It's strange, both the RFE letters says "Request for Initial/Additional" evidence, and USCIS had it up as "Request for Initial Evidence," on the website.  When I talked to a Tier 2 they said it wouldn't restart the whole process it should just resume where they left off based on the fact that it was a simple typo but who knows.  The RFE was SO late, it seems like it was only triggered when I put in an SR on the EAD.  When I spoke to Tier 2 the time before that they also said my I-465 looked ready to for interview but they are backlogged.

    That is RFIE, Request For Initial Evidence. I got the same letter and word "Initial" gave it away as RFIE. Correct me if I am wrong.

    If rep said that it will not reset time but simply resume once response is received then perhaps EAD/AP RFIE has different effect on the processing time.

    Could they have lost your RFE/RFIE response even though status was updated to RFE/RFIE response received? That would be bizarre

    AOS, Yes, it most likely reset that. EAD/AP, I don't really know. First time we called and provided receipt number lady said that RFIE for AOS reset EAD time. Second time I called because someone else here also mentioned that USCIS officer noted that RFIE would only hold EAD not reset. Last time I called about service request and was told that service request response was "within processing time" because RFIE put EAD on hold so when service request was processed it was still within processing times.

     

    Also look at other members here. @emchappie I believe has similar timeline with RFIE and sent RFIE response later on, however, I think card was either mailed or already received. So there is no real fact if RFIE resets or puts EAD/AP on hold.
