  1. It is not a conviction. Deferred adjudication means that the judgment of guilt was deferred pending completion of the conditions of the agreement you entered with the prosecutors. If successful as you were, the court will dismiss your case. As such you are not convicted of the alleged crime. But if you violate any of the conditions (terms) of your agreement, you will go back to Court and after a hearing the Court may adjudicate you guilty of that alleged crime, then you will have a conviction. In your case you were not convicted. So the answer will be NO.

    A no contest plea is throwing yourself at the mercy of the court. If you accept a court order restutition then you are more or less accepting responsibilty for the crime, just like a guilty sentence.

I know that everyone says that they were not a fault, and that I was not guilty, but that was the case with me. Anyway, I did not want the case to go to trail so I pleaded "No Contest". I paid a fine and did my community service (deferred adjudication). My lawyer told me that under the terms of "deferred adjudication" that it would show as a conviction. Today I checked with another lawyer. She looked up my record and agreed that it is not a conviction. I read the I-129F Draft and it looks as if it is asking if you have ever been convicted of whatever. I am going to say NO! Am I right?

    If it is charge of moral turpitude e.g prostutition, pimping e.t.c then you might wanna consult with a lawyer. I think a conviction of moral turpitude count against visa issuance. Some interviewers focus on integrity and honest.

    It is sexist biased #######...

    Why.... becuase abuse can happen against anyone to anyone regardless of gender..

    people can mistreat animals

    All of the above happens and all of it is wrong...

    It is my opinion that women abuse men just as much as the other way

    around if not more.

    The issue is that men are too proud to report it and sometimes don't

    even recognize abusive behavior for what it is. No man wants to admit that he

    is abused by his wife and that he is psycologically a basket case becuase he is always being

    told what a useless waste of a human being he is.

    I have no arrests, convictions or even police encounters for abuse but my ex-wife has tried everything

    possible to get me to do something I would regret.

    So.. lets be fair on these boards... and call it SPOUSAL abuse.

    or VIOLENCE against PEOPLE.

    Women don't have a monopoly when it comes to being mistreated or abused. They just shout the loudest about it.

    Lets open our eyes to the other side... Spousal abuse by women towards their spouses, causes alcholism,

    depression, suicides and broken lives all the time.

    IMBRA is not only for women, it is also meant to protect men. It is for everybody outside the USA wanting to immigrate to the country on the basis of fiance visa regardless of sex. It is only unfortunate that women makes up high percentage of the ones getting abused. Get it ?

    Women make up the most complaints but the difference may end there. Female to Male abuse is silent, ugly, prevalent, and destructive. It goes unreported and unaddressed most all of the time.

    In short we really have no idea how many men are abused because men don’t report it or talk about it until it is way too late and situations are out of control.

    Again, abuse is equal opportunity and not sex specific.

    This post realy shows how naive or how young the poster must be. This IMBRA affect just the same as anybody on this board, but the truth is the IMBRA law was implemented based on statistics of innocent victims that were being victimised by unsuspecting foreigners. Nobody ever said IMBRA was for men or women only but the truth still remains that most domestic violence victims are women. If more men are victims and decide not to report it, the women must be a smarter sex then. And just in case you are wondering, i'm a grown @$$ MEN !!!

  4. Wow!! I have known this man since we were 10 or 11 years old.

    He has never used drugs!! He is not a junkie!! He doesn't drink or smoke!

    He was riding in a car with another ex friend and he had drugs

    in the trunk of the car. He was unaware of these drugs.

    If I had not know this man most of my life, I would not

    believe his luck. Nobody that ever meets him would ever suspect

    him of being a criminal. Although he does tell people about it.

    Most people think that he is joking with them.

    His main problem is the women that he has been dating.

    He won't even consider an american woman anymore.

    He was not trying to find anyone to marry.

    He felt he was better off alone. With that history I can't blame him.

    His high school sweetheart is the only decent woman that

    I think he has dated. That was 20 years ago!

    He has told his Russian friend about this and

    they are still pursuing a relationship.

    This man has a good job. He is not violent regardless of his record.

    I agree with with the IMBRA thing. It is something that should

    have been done years ago. I just hope that my friend will not be

    hurt because he took the easy way out instead of fighting

  6. Especially a felony against a woman. You can thank IMBRA for that and support it 100%. This is why we have IMBRA to protect women fro those killers,pimps,pediphile, molesters drug addicts e.t.c. This IMBRA does not bother me 'cause i have no criminal past to worry about. And frankly i think most interviewers are gonna frown at any criminal records. Especially a violent one. which is good. No need putting an innocent woman at risk because she wants to live in America !!!

  7. My best friend has met a real good woman. Which is surprising considering his past

    relationships. He had a drug conviction (felony) 15 years ago.

    He lived with a woman for 4 years. She had been in a mental hospital twice.

    They only had a relationship for 6 months. They shared a house for 3 1/2 years.

    This woman obtained a TPO (temporary protective order ) as an eviction to

    move him out of the house. While he was staying at my house in another state

    she called 911 several times. Claiming that he was following her or in the front yard etc.

    I know for a fact that he was not guilty of this!!

    Well anyway one day he was pulled over on the freeway. Had a felony warrant for

    stalking. He sat in jail for 6 months without bond. He had plenty of evidence to

    support his defense. But, he chose to plead guilty to a misdemeanor charge of stalking.

    He would have been in jail another year waiting for a trial(( Plus his attorney was terrible.

    Now if that is not too bad here is worse.

    His last girlfriend (which I hated ) Turned out to be cheating on her husband.

    When he found out he broke off the relationship. She was moving to another

    state with her husband and son. The husband moved a month before she and her son.

    She started to call my friend and he went to visit her twice.

    The day after the second visit her husband was shot in Oklahoma.

    We are in South Carolina. 2 years later he was arrested for the crime.

    The husband named another person as the assailant and claimed that

    he did not think that my friend shot him. They had met in the past when he found out

    his girlfriend was married. So the trial is ready to start and the prosecution offers

    a plea bargain. My friend accepted it. He went to jail for 5 months and has 3 years of probation.

    We thought that he would win the trial but, he was looking at 40-50 years

    if he lost.

    So his record now consists of 2 felonies, A drug conviction and felon in possession of a deadly weapon.

    And a misdemeanor stalking, criminal trespassing,

    Will he be able to marry this woman that he has met and bring her to the US?

    Your friend seems to be violent, this is why we have this IMBRA thing. not to put innocent woman in the hands of killers,molesters,pediphille and drug addicts. He needs to work out his issues first b/4 putting that woman at risk. You can never trust a junkie. Frankly, looking at this IMBRA thing your friend needs to focus on completing his probation b/4 marrying again. Marrying a foreigner should be last on his list right now.

  8. Going by your friend's past, he seems to be a very troubled individual. What you fail to mention is if he has given up drugs. I wouldn't allow him next to my sister !!! Believe me any interviewer looking at this loser's criminal record will think twice b/4 putting that woman at risk. I feel sorry for the young woman.

If he gets a Temp EAD at POE it is good for 90 days.... he will need to apply for a SSN and that will take 2 -4 weeks to get.... if he then finds a job and starts work and you have got married and filed for AOS and EAD the chances are that his Temp EAD will have run out and he will have to give up work and wait for the 1 year ead to be approvel and received before he can start again looking for work....

    At the moment 1 year EAD is taking 90+ days to get.... and in some cases people have got their interview date before they have the EAD.....

    You are wrong, most employers will hire you once you have a valid Social security number and social security card. If you get a temp EAD, chances are that you will not lose your job or have problem renewing your EAD for extra time. Please get informed and be sure of your right. Many people in the usa does not even have a EAD and get good jobs. A social security card can be more powerful than EAD in most cases. A valid SSN card will get you a driver's license but EAD will not.

    The cheque was sent to the lawyer and I believe she submitted a cheque from her office, and when I emailed her yesterday she still had nothing to report yet.

    She is going to forward the information as soo as she gets it, she better ha ha. I also asked her about the new form, she said she would forward it as soon as she recieves that too, so I am keeping my fingers crossed.

  11. Ours was also submitted May 25 (via a lawyer), and as of yesterday she still had not recieved anything. So I am hoping like you today or tomorrow we hear.

    If your check has been cashed you can get your reciept number at the back of the check. It starts with "wac". And you can check your status at uscis.gov. I just checked mine. thanks for the reply anyways, good luck on your case.

  12. Unfortunately, you have no idea how the Writer and Editor will spin your story. While they're giving you the impression now that it will show you in a good light, you'll never know until it's in print. You may want to tell the story from the point-of-view of people doing things the right way, but they're in the business of selling newspapers and will tell whatever story they want.

    I wouldn't be worried about your photograph, but about allowing yourselves to be used without having any veto power over the text. If you want to ensure the story is what you intend, write a Letter to the Editor and include your photos if you want.

    just found out they want a pic of him here in the us....and one of me in canada.....however i think i just answered my own question(not that u guys were not helpful, you were)...this is not solely about us, it is about everyone...and how it affects EVERYONE. so the pics will more than likely ruled out as far as i am concerned...i just want the story out there.

    Your associated pres story will not make a difference and it will only hurt other good people trying to use this visa category. You just applied in April and you are already inpatient. Any unneccessy headline story will only shed a spotlight on your visa category and make the public want more information which can prolong the process of the whole process. Immigration and USCIS is all over the news now in America due to the illegal alien problems and the attention has put a gridlock on the process. Why don't you wait for your own time and deal with USCIS by yourself instead of jeopardising other people's applications. Beleive it or not an AP story will not help you and can possibly hurt your application by shedding unneccessary light and scrutiny on the process. American public are very wart of all immigration processes right now. Bad enough we have IMBRA delaying the process, please don't complicate things any further and wait for your turn.

    I wasn't trying to suck you into a 'battle' in the least. All I said was we would have to agree to disagree about your idea that we 'hammered' you in your thread about the truth. All the posters there were very positive, and as encouraging as they could have been - except in the fact that they felt what aussiewench articulated - that it is/was a little too early yet for us to know facts.

    I remembered the original thread because of your quite surprising reaction in it - to say that your thread sucked, please delete it, etc etc. - given everyone's overall positive replies.

  14. For those of us who just filed, i call USCIS today. The customer sevrice rep told me that there would be a form sent out regarding the IMBRA thing. She did not tell me how long it will take but said soon. I think i heard her say the new form her being put together this week but i'm not sure i heard her right because she was in so much hurry to get off the phone. :P

    Anybody interested can call 1-800-375-5283 and see what another customer rep says.

    I have been trying to call back and get someone else to talk to, so i can see if the other customer rep. knew what she was talking about. She did tell me that she does not not how long it will take but i hope it becomes clearer within a week. I'll call again in the morning. hopefully talk to a different person. but i don't think this should take long. Background check is not hard to check. I work for a law enforcement agency and i know that you can check a background of anybody thru NCIC within 30 minutes. So i don't know why they would be taking forever. A finger print check thru NCIC/TCIC takes no longer than 30 minutes to get a hit back.

  16. I spoke to a customer service rep. at USCIS Tx. branch. She said that they are about to start sending new forms out for the IMBRA thing. She didn't tell me how long it will take but said soon. Hopefully it won't take long. She said something like they are implemeting it this week. i'm not sure i heard that right, though because she was in a hurry to get off the darn phone. :P

  17. ok first of about divorce and marriage. lori filed divorced against her hubby but through the mexican court. it was granted so on the basis of that divorce she though to be free to remarry. we got married in NY as her city office accepted that divorce. we were legaly married but when we filed for i-130 the case was denied bcz fedral law doesnt approve mexican divorce. so it was bigamist thing. now as she has got divorce from NY so she is free to marry legaly. well as for as lawyers are concerned till now we have paid 10,000$ in total between all this procedure.

    Your case is very complicated, think about. How do you expect US immigration to understand, when we can't. Immigration are too impatient and not legal savvy for them to follow a divorce from Mexico all the way to japan. what i mean is, may be you should find a good lawyer and work with him instead of paying foy some crooked lawyers.
