    I-765 (EAD) can also be used as ID and you can also use it to get an SSN. 
     

    Put “TBD” and you don’t need to add any additional information or explanation on travel plans (I know it asks it there)/you can put N/A.

     

    Its best to print out both forms and submit together with I-485. Don’t forget a copy of NOA for I-130.

    They are FREE forms with I-485 package.

     

    You never know if she needs to urgently travel back to her country.

     

    Without I-131 she would not be able to do it, she would abandon her AOS.

     

    I-485 takes years sometimes.

     

    You can put "To be determined" in the date for future travel.

     

    Also file I-765. While she doesn't want or need to work now, she may need to in the future. Considering high cost of health insurance in the US, she may even want to work part time at Starbucks, who can provide it, for example.

    Thanks for the advice, that is a good point and we don't have anything to lose by submitting them, so we'll complete them as well! We don't foresee her travelling or getting employment but you are right that you never know for sure.

     

    A couple follow up questions, I see I-765 can be submitted online, but I am still able to just print it out and ship it with my I-485 package(also including the I-131), right? If I do it that way I don't need to include any additional fees for them?

    My wife and I are submitting a I-485 for my mother-in-law after having a change of plans while she visited, and since she does not plan to work(we will be supporting her and filing affidavits of support with the I-485) or leave the country until her petition is completed, we are wondering if we can skip the I-765 and I-131 entirely. She will not be working, and the I-131 seems to require upcoming travel plan info of which we have none. Is it an issue if we do not submit these with the I-485?

     

    We also previously submitted a I-130 for her, and the receipt notice said "The beneficiaries of a petition must wait until a visa number is available before they can take the next step to apply for an immigrant visa or adjustment of status to lawful permanent residence." However we would like to submit the I-485 as soon as possible so we can extend her stay in the US until the petition is completed, as her current B2 visa only allows her to stay until mid-May. Maybe this is referring to an applicant that is outside the US currently, and does not apply for our situation? Is it an issue to submit the I-485 now?

     

    EDIT: Just found on page 22 of the I-485 instructions "Immediate relatives do not have to wait until Form I-130 is approved to file Form I-485. You may file your Form I-485 together with your Form I-130, while Form I-130 is pending, or after your Form I-130 is approved" So I have my answer to that part of my question. Editing in the answer instead of removing that part in case it can help anyone else!

    Was also wondering, should we expect the interview to be more difficult since she first came on the B1 / B2 visa before we applied for the adjustment of status? Wondering if that might be an issue during the process, we kind of changed our plans and submitted the I-130 a few weeks after she arrived.

  5. Hello all,

     

    My wife previously immigrated to the US on a K1 from Vietnam, and since has become a naturalized citizen in May 2022. We got her mother a tourist visa late last year to come visit for a couple months to help with the last stages of my wife's pregnancy and first stages of our first child. Her mother liked it here more than we expected, and as the birth got close we discussed and decided she'd be OK to stay for a year or two and help with our baby. We already submitted a I-130 soon before the birth in December and are working on the I-485 now, but had some questions I was hoping this great community could assist with!

     

    Her I-94 notes to admit until May, so I was not sure if that would be extended with the submittal/receipt of the I-485 or we also should submit a I-539? The long flight is a hardship for her so we'd rather she didn't have to go back and forth if possible. From looking at other forum posts, seems like the NOA for the I-485 should extend her visa until the petition is completed?

     

    We also cancelled her return ticket since it was for late January since we realized we would need help longer than that. Would her not currently having a return ticket be an issue in this process? Wondering if we should book another return flight for her around the expiry of the I-94 to show our intent to follow the visa, or if that is not necessary if we are submitting the I-485. We'd like to do whatever we can to help the petition be successful. Any help is much appreciated!

  6. Ok, thanks a lot to both of you! We will get some better bank statements and the full tax returns and check out the links you provided.

     

    One more question I had was that our IDs show different addresses because I did not update the address that was on it from before, and since she got hers later on she had our newer address on it. We have leases from 9 months after she got here until now, is that sufficient, or will the IDs be a potential problem? She was not able to be on the lease for the first place we lived together since she did not have a social security number yet, so the first official record of cohabitation we have is from around 9 months after she arrived in the US. Does anyone have any recommendations on how to deal with that?

  7. Hi everyone, been a while since i visited the site but our 90 day window to file the I-751 for my wife has opened and we are trying to prepare all of our evidence. I had some questions that I would be really grateful if someone could help me with!

     

    1. Currently we have leases from the first place we moved into together about 8 months after she had arrived in the US, since we lived in a place that I was already on a lease on until that time and the rental company didn't require us to get a new lease when she moved in. We also have bank statements, but they are not detailed and mostly just show that we have joint accounts together. My wife could not open her own bank account until about 9 months after arrival so the earliest date on the banking documents we have is around that time. We also have pictures from trips we've taken together, and a summary of our tax returns from an accountant for the last 3 years showing that we have filed jointly since 2017, she arrived in December of 2016. Is this enough evidence, or should we be getting more detailed bank statements, more official tax return documentation, or something from the place we lived together for the first 8 months?

     

    2. Should we include the full tax returns for the last 2 years, or is just the summary page from our accountant enough? Are the W2s also helpful even if they each show our individual information? 

     

    3. I also saw on the USCIS I-751 page something saying not to submit the checklist of evidence with the initial filing, but they do want us to send the form and the evidence all at once right?

     

    4.  I did not see anywhere on the USCIS I-751 page about a cover letter, but I have read here in a few places that it is required. No problem to do that but was looking to clarify.

     

    If anyone can help us out with these questions that would be amazing!

     

     

  8. I am a native USC, I just kept hearing about it, and saw some examples so I thought we needed it. I also thought I saw some people saying they sent a lot of pictures, and a lot more chat logs than me, so I was just trying to be thorough and make sure we don't get asked for more information, delaying the process. I have not visited her in Vietnam yet, so I have no boarding passes or anything for visits, but we met studying abroad in Japan, and lived together there. So what about the timeline, is that in the first package, or does that come later? I saw some people say if you need it they will ask for it, but if they will likely need it I'd like to get it to them soon as I can.

  9. I am currently assembling my initial submission package with the I-129f, and want to make sure of what it is I need for this initial submission. Currently I have: I-129f, G-325a's from each of us, the intent to marry letters, about 110 pictures, 5 ish pages of chat history for each of the 11 months we have been dating(I hope this is enough), a lease from where we lived together for 6 months, declaration of how we met, student cards from the same school, student visas from Japan with our shared address on them, and a passport photo of her. I still need to get my birth certificate copied. I have seen the timelines and 10 years residency on this forum, but are those something that get sent with the I-129f? They seem to have case numbers listed on them, and presumably we won't have one until we submit our case. I also am curious as to when the financial stuff comes into play, but from reading the forum I think it is before the interview. I want to get this sent out sooner rather than later, but making sure they have everything they need to review our case quickly is the most important. What else do I need?

  10. We lived together in Japan, and it would be from Hanoi. The income requirements is probably something we'd need a cosponsor for, which I can get. Since I have been abroad I haven't been working, I am currently looking, but is it a good idea to wait until I find a job to apply? I am also concerned about listing addresses correctly, as Vietnamese and Japanese addresses sometimes seem vague on what should go in town, province, etc.

  11. Hello,

    I am currently filling out applications and getting materials together for the K1 visa application, and have a few questions. First, I want to get some proof of an ongoing relationship, and we have photos, but I'm afraid that the lack of emails, and phone bill stuff could make it harder. We did live together for 6 months, but the lease got lost in the move. We do have our student cards showing we went to the same school for 15 months, and student visas that say the address we lived at on them. Are those and the photos enough? I am also worried about filling out the forms correctly before I send them, should I look into hiring a lawyer, or is it something I can do myself? I am not sure if we can afford a lawyer, but I want to be sure that the petition passes.
