Hi.
My interview was scheduled to June 6th, but on My 17th I got a call from the Consulate in Rio saying USCIS recalled all pending aplications due to a new request.
After researching and calling the whole world I found out that this was a worldwide thing.
Anyways, anyone else in Brazil had the same problem?
I was told we are 20 cases in Brazil.
Let´s exchange informations.

I´m in the same situation as you.
Unfortunately, USCIS will only review the cases once they have it back. That´s why they recalled all petitions around the world.
I think they can´t say: "Ok, the petitioner here is a woman, so they should be fine". That would be descriminating men. At least that´s why this new IMBRA law is gender neutral.
It sucks for me too. In my case, the USC petitioner is also the woman. And we did not met via an agency.. not even online. We provided evidences of how we met in person and they had alreday approved it.
What I think is that we won´t have much trouble after they start processing our case. But who know how long this is gonna take to finish.
The USCIS officer told me on the phone that I should give them at least 30 days to call them back just to see if they have received the petition back! Of course I´m calling them again next week...
I think the thing is that we need to ask now for general questions, since they really won´t give us any specific answers about each case.
We need to ask them if during this security-check they´ll ask us to provide anything else, if our petitions are going to the end of the line, etc.
Before they receive our case back, that´s the far we can go.
I have no more job, and soon will have to move. I had everything planned. Now, I don´t have a clue of how long this is gonna take.
I think from tomorrow, you should also call your fiancée´s Consulate in the UK, the USCIS and the NVC in London.
I´ll be doing that and we can all share information here.

I think that is the best we can get. IF WE CAN...
During next week, 2 weeks will have passed since the first person complained about their petition being returned after received by the Consulate.
I think that´s enough time for USCIS to receive it back, right?
I´m hoping we´ll hear something from them this week.

If you have your NVC case number, the Consulate in Rio will inform you of your case status, since it takes only about a week for them to receive it from NVC.
If they don´t have it there, then you should ask them about the recall.
One tip: You don´t need Packet 3 to apply for the police certificates. You can download it from the Consulate´s website, write your name on it and be ready by the time Packet 3 comes! It takes about 10 days to get this ready from the Polices (they are 2) an you can save some time by doing this.

I´ve been calling the whole world since May17th and the thing is: USCIS will only tell us something once they have received our case back from the Consulates.
So, specially for those from Vermont (they seem to have stopped approving petitions since April), what we should as is:
1 - Is the VCS waiting for any notice to restar approving petitions in general?
2 - About all recalled petitions: Are they going back to Stage 1 or are they gonna be on top priority?
3 - For those who do not had their petitions returned, but are yet waiting for a long time since Vermont has stopped: Are the recalled petitions causing delays to all others petitions?
I suggest this because THEY WILL NOT tell us about each particular case!

that´s what I meant, yes.
I had my interview scheduled for 06/06/06 (the number of the beast.. might that be the reason?)
They called me on May 17th to give me the bad news.
I called them back on May18th and they had already sent it back to the USA.
I´ll update my Timeline now.

In my case the petitioner is the woman and I´m the guy who´s the beneficiary.
Our petition was sent back to USCIS after interview date was given.
So I don´t know what happens next but I can say we were already afected by the new IMBRA law.
I´m going crazy. Don´t know what to do. Had everything prepared and now I can´t even get information about what´s the situation of my case.

Not complaining about the new law...
It just doesn´t make any sense for me that in my case the petitioner is HER and I´m the beneficiary - male.
We did not met online or through any IMB and provided evidences.
The new law is ok.. if they wanna do these checkings, go ahead...
But aprove and then desaprove a case without any further information????
What about people who have quit work, have a day to leave their house, bought aticket, have wedding plans, etc?
Who know how long will take for the petition to be received by them.. and only after that it will be checked again... and who know for how long! And then.. they will have to send it back.
And the worse thing: we won´t know anything about what´s happening because it was their mistake!

The way I see it:
Those who have not met via an IMB will not be affected by the new law, only have their case delayed.
Well, that means we are already being affected...
Still.. someone needs to find out how long it will take for those petitions to be sent back to teh Consulates.

How do you know if the recalled petitions will be processed first?
Did you hear it from someone or you are just assuming that?
I mean.. it makes sense to me but, I need to be sure if this is just a guess.

I think we will only find out once someone who had their petition returned hears from either USCIS or their Consulate.
Seems like USCIS did not receive any of the recalled petitions yet.
I wonder if for this new security check they will request every petitioner to fill out a new form, or even though they will perform this check on everyone, they will only request new information for those who met under an agency or internet...

Sure.
But I wonder if at some point, people filing out their aplications had to submit such certificates.
I read about that somewhere.
Maybe the new cases are being sent with this.

Hi.
They usually make you wait for about 30 minutes before talking to you.
It´s always like that. I know because I have been calling them in a daily basis.
I doubt that they are not answering your email because of the IMBRA delay.
This has nothing to do with them since the only thing they did was send the petitions back and inform us.
They are usually pretty nice at the phone and if you wait for 30 minutes will have your issue solved.

That would help to speed the proccess a little bit.
Another question is: Do the recent petitions sent to USCIS had any new form, such as a Affidavit of Criminal????
I heard about that somewhere.

Delay for interview scheduling at the Embassy in Rio

It takes less than this.
All cases received by the Consulate in Rio were returned to USCIS because of this new Security Checking.
It took only a week for them to receive my case from NVC.
Thing is: don´t wait for a contact.
If you have a case number just call them from Monday to Friday from 13:30 to 15:30 Rio time.
And please, if you find out anything about these recalled petitions post here.
