  1. Just enclose a copy of your green card and mail that in with your circumstance with even a note, its against USCIS federal regulations to serve on jury duty as an LPR. Amazing the number of city, county, and state employees that don't know anything about immigration. And never even heard of the USCIS.

    Hi there, I agree that that's it odd how many government agencies seem to be so closed off from each other.

    There is a exception box on the reply summons for jury duty that does allow me to check off that I am not a USC and to write my nationality. If I was months and month away from citizenship or not in the process, I would check it off and not think twice about it. ( I also got a jury summons a couple of years ago and that is what I did)

    My concern is if I am lucky enough to get sceduled for my oath cermony in Nov, and I report my new status to SS and the DMV which will verify USC status- and then afterwards someone from the jury comission checks my status it would have looked like I lied.

    But I suppose, if that did happen it would come down to the fact that was true and accurate when I wrote it.

  2. Hi all, I have my civics test and interview this coming Monday.

    A few days ago, I received a jury summons in the mail telling me to report for Jury Duty on Dec 3. I know that currently as a non USC I am exempt from Jury Duty but given that I am very near the end of the naturalization process, I am not sure if by Dec 3 I will be a USC.

    My husband says I should just respond now, saying I am not a USC and send it in the mail. But part of me thinks that maybe I should bring it with me to my interview and ask the IO how to proceed as I am afraid it might look like I am 'trying to get out of jury duty' or that if I become a USC in by the time they process my reply, it will look like I lied in the responce.

As to the concern with Visa Fraud, what they are examining is if the relationship is involving petitioner and beneficiary is bona fide- as opposed to being made up for the purpose of an immigration visa. Even if on the surface it might look as if ‘you are the other woman’, it doesn’t necessarily equate to visa fraud.

    Although this was a number of years ago, my husband’s grandfather and grandmother divorced after 50 years of marriage because his grandfather was having an affair with a woman young enough to be his daughter. He later married her and petitioned her for a marriage based visa ( I am guess it was a AOS since she was already in the U.S.) So, if they were successful despite the moral and ethical transgressions of their relationship, I really don’t think you have much to worry about.

    Although, because you are not married but currently pregnant with his child, my guess is that they will likely require a DNA test in order to process the CRBA for your unborn child.

  4. When my husband first sent in our immigration paperwork, we did not get our NOA1. He called the USCIS hotline and all they could tell them at the call center is that the documents were received. Finally after 3 months we were informed that my husband accidently dent them our copies of the application without the original signatures and that everything was being sent back and we needed to resubmit the documents.

    Unfortunately failing to send all the required information in or making mistake such as my husbands can cause some long delays.

    ETA. I also don't know how your attorney missed this. You are paying him him/her good money to make this a smooth process.

When I was in the process, my letter for the interview was not sent to me, (It was either lost or sent to a lawyer my MIL hired at one point when there was an unexplainable delay- and the lawyer never forwarded it). Fortunately, we had a friend of the family who work at the U.S. consulate in Toronto who was able to contract people in Montreal, which is how I learned I had finally been granted an interview. They also sent another letter.

    I happened to be visiting my husband in the U.S. at the time and had to change my flight home. to get to back to Canada to be make my interview. Fortunately, we received a replacement copy of the letter in time, or I fear I would have had trouble making it past security in Montreal as they require it.

    I hope you don't have the same issues but my advice would be to forward the copy of the email to your fiancée and have her print it out. I expect without the invitation letter, she might come under some extra scrutiny that might cause some time delays, so I would suggest she show up as early as possible.

    I didn't see this answer in your reply to her but I might have missed it, but it's never a bad idea to bring a copy of all the paper work you both submitted, including the I129-f,

    I wouldn't recommend that she attempts to bring nose spray. I know other than generally baby formula, most Consulates and/or Embassies do not allow you to bring in food or drink. She also will not be able to bring in her cell phone. She will be allowed to have a small personal bag such a purse but not a large bag such backpack.

  6. It's not illegal to come to the U.S. and get married (Vegas, anyone?"). It's illegal to come to the U.S. with the intention of immigration through marriage and not leave after.

    Of course it's not illegal to get married in the U.S. but it is fraudulent to be deceptive when answering a CBP agents questions. If they ask, what is the purpose for the trip...and in reality it's to have a wedding ceremony (and then return to Canada) but you say...it's a "girls weekend away". That is a lie....and the ramifications of it can be more trouble than if you (or whoever) told the truth in the first place.

    The WORST thing that can happen if you tell the truth is they will deny you entry in that visit. It will not ultimately hinder your visa process or approval.

    The WORST thing that can happen if a CBP agent suspects you of fraud, is that you can be BARRED from future entry into the U.S> ( I believe it's a year ) .

  7. Hello, if I am reading your post correctly,

    *You and your husband are CURRENTLY legally married (I am guessing a civil ceremony)

    *You want to be able to go visit him but are unsure if you will be bounced back at the POE because of your pending visa

    *You would like to have a formal 'wedding' ceremony in the U.S. with some guests accompanying you into the U.S. and you plan to return to Canada after a short time to await your CR1 or K3.

    *You are wondering if your visa process can be expedited so that you and your husband can be contestants on a Television show.

    As you seem to already know, visiting your spouse (or fiancee) while having a visa pending can be a bit of tricky and confusing issue; and in most times you can be at the mercy of the CBP agent processing you. Some agents might feel that because you are an intending immigrant (at some point) they will deny you entry...while others are more concerned about the purpose of that particular trip and make their call based on that.

    As you have said, it's helpful if you are able to firmly establish to their satisfaction that you are planning to return Canada on the date you have stated, such as providing a non refundable return ticket, a copy of your lease, a letter from your employer ect.as well as any currently paper work related to your visa application such as your NOA2. It will help establish that you aware the legal process and are taking the correct steps to follow it.

    Unfortunately, no one here can guarantee that you will have no problems crossing into the U.S. Although, I can tell you that when I was in the process, I was always allowed to enter. Sometimes, depending on the question they asked me such as "Hello, do you have any fruit?"..."No"...."Great have a nice day" it was quick and easy...sometimes I was asked for proof that I planned to return. Only once was I sent to a secondary inspection, and it wasn't even the agent who processed me. After I cleared inspection and went to hand my card to the agent collecting them, she took a look at my baby (mine and my husband's- I had given birth prior to getting my Cr-1) and marked my card to go to the secondary.

    When I handed my card to an agent at secondary- he asked me what happened. I told him, "Honestly I don't know...she took my card..then she kind of did a double take when she saw the baby stroller- marked the card red and sent me over here". I guess he must have felt sorry for me (seeing I had a small baby and needed a Air Canada Rep to help me with my bags - for those who don't know, at Pearson Airport you don't get to drop off your bags until after you have cleared customs) or because they were so busy he didn't want to add more work to their pile..and sent me on through.

    As far as you and your family/friends entering the U.S. for a formal wedding, I would encourage you to be as honest as possible. If a CBP agent suspects you are trying to be deceptive or get one over on them , the consequences could have devastating effect on your visa process. Again, the questions you get asked might be as simple as "What is your final destination in the U.S. " or they could be more involved.

    As to your visa being expiate so that you both can appear on a televised competition, it seems unlikely. In my situation, it kind of was (long story...as my process took almost 1.5 years...because of some minor mistakes on my husbands part such as sending the copy of the application instead of the one with our actual signatures (causing a 3 month delay) and for some explainable reason after our application cleared the NVC the CSC asked them to send it back which caused another several months to rectify ...but in our situation, our daughter (a USC) was very ill.

    I have also heard of an application being expedited because a child of beneficiary (who was also going to immigrate) was going to 'age out'. In addition to situations if the fiancee ( in a K1) was going to deploy.

    Your husband is free to plea his case to try and get the process expiated, but given the examples I am aware of..I don't think they would consider this to be a 'life and death' type of situation.

  8. I got my letter in the mail today. My interview is scheduled for Mon Oct 21 at 7:50 AM in Santa Ana. It said to arrive no early than 30 minutes prior (I doubt the would be open much before then...and to allow 2 hours for the process.

  9. Got a yellow letter asking me to bring my Drivers License to the interview... why? o.O

    I think it's pretty standard as far bringing your DL with you to the interview. My letter said the same thing.

    I have no idea why your letter was yellow. Maybe because you filed at the 90 mark prior to be eligible for naturalization based on marriage?

    I have no idea if they are good little boys and girls or not. But I do know that somebody shouldn't be able to keep anything that doesn't belong to them.

    I don't hate poor kids..I love children, especially my own and I won't allow others to take what is rightly theirs without a fight.

    Yes, the poor children should get to keep the gifts. Are you saying the gifts should be taken away? How do you know the kids aren't good little boys and girls? Why do you hate poor kids?

From what I can recall only stays outside the U.S. for 1 year or longer would require a re-entry permit, however a stay outside the US for longer than 6 months might trigger a secondary inspection. I would probably be prepared to prove that your absence was related to your mothers care in the event the suspect that perhaps you were 'working out side the country' and didn't want to report the income.

  12. The amnesty is for children brought here by their parents. These children have lived as US citizens for their entire life. Giving them amnesty is simply the right thing to do.

    No, the current Amnesty legislation in the house right now extends well beyond just the dream act.

    And even then ...why is the right thing to do?

    Look at it this way...

    If someone breaks into your house and steals all the Christmas presents under your tree to give to their children because they don't have the ability to buy there own; and they are caught. Should their children get to keep the gifts because it's not their fault their parent stole it...and as far as they knew...Santa brought it because they are good little boys and girls?

    Citizenship (as far as naturalization) is a gift.

  13. My 3 year old son has some possibly serious health issues going on. Just a call from the pediatrician about a lab result that needs tested again, with serious stuff online about it. Am afraid here... And my wife is leaving on Monday for additional training with the Air Force. Anyways, might not be on here much until figure things out. Need people to step forward to add people on their timelines. Only a couple know how, it seems. Since my wife was able to get her citizenship first, I felt I needed to stick around and help with those who remained. But i dont know a thing of what the future holds right now, and I can tell you how to update people on the timeline if you let me know if you will help out if told how to do it.

  14. Although it was a while ago when I was in that stage of the process, it took less than a week to get my passport back. But I did bring a pre-paid Canada Post Express delivery envelope with me to the interview for them to mail it back to me in. I am not sure if that can still do it that way, but if they can it will definitely help expedite the process.

  15. I think my documents are complete. I answered all of his questions correctly. But i messed up on his last two questions, what is your fiances phone number? And what is happening in south carolina? Im just really not good in memorizing numbers thats why i told him honestly that no sir. and the last question whats happening in south carolina? Like what is the news there? I told him that hes not telling me any news sir. Then he asked again, thats the time i got really nervius and cant answer no more

    Heck, with automatic dialing, there are tons of phone numbers from people I speak to frequently that I don't even know.

    Was there someone crazy happening in S. Carolina at the time that it would be noteworthy?

  16. Ok, great to hear. What proof did yu give if you don't mind me asking? I'm thinking 4 years of high school and college transcripts, 4-5 years of Income Tax Transcripts and bank account and medical records. Hoping that's enough.

    What evidence did you give and were you required to get a DNA test? Was the process difficult at all? Thanks for the reply.

    Hi, from what I can remember we submitted our marriage certificate which showed we were married before our child was born (although I am not sure if the date of marriage was significant ). Our daughters long form birth certificate that listed the both of us as her parents...and my husband sent copies of either his tax returns or w2s that proved he met the residency requirements.

  17. I am excited. The USCIS IO instructed my wife it would be preferable that she appear for her interview/oath in her military uniform. I told her I want her to wear the Air Force dress skirt with the jacket, since it will look more professional and more formal, in my opinion. She thought maybe the pants instead, but I think the skirt looks more lady-like and formal than the pants, and it will make a better, more professional impact on the interviewer I think. I told her this should be treated as one of the most important days of her life, and she needs to present an appearance of highest dignity. So I already got her uniform out and her ribbons pinned on the jacket. She was issued standard patent leather oxford tie shoes, but according to Air Force uniform regulations she can wear pumps, in line with the regulations. So I am ordering the shoes directly from the company that clothing sales at the Base Exchange gets their shoes from. I am ordering them from the company so that I can get the non-skid soles rather than the smooth soles, because I remember when I was in the Army and had to wear the dress shoes, they were so slipper on smooth surfaces and grass.

    I printed the map to the field office in Memphis already. Got all her documents and required IDs ready. I will do the final tuch-up to her uniform the day before we go. Now we just wait for the next 10 days to pass, and keep making sure all is prepared. She works at the air base this weekend, and in September she leaves for 3 months on active duty, God willing as a United States Citizen Airman...

    Congratulations to your wife and your family; we are thankful for her service (and your prior).

    I hope you post pictures of her in her mess dress. I am sure she will look fantastic.

  18. Our first child was born in the midst of our CR-1 process. It did not effect our process and we were not not required to provide a DNA test.

    My understanding is they typically only request a dna test when the child is born out of wedlock where the intending immigrant is entering with under an I-129f. Your child (assuming your wife is pregnant and gives birth before she enters the US) will and SHOULD NOT enter as an immigrant. They would enter as USC after you have completed a CRBA, or Form FS-240 . You will need to provide proof of marriage, the long form birth certificate of the child that lists you as the father, along with proof your your US citizenship; you will also beed W-2's (or other documents) that show that you have lived in the U.S. for at least two years .

    Essentially, yes. But even if you had already met the requirements for the 3 year rule, based on the current processing times you likely would still not become a USC until after sometime after Sept 2013,
