The wife passed the interview test this afternoon. Lady officer was kurt but didn't ask for much. Only wanted to see ID (green card and driver's license). All the other documents the letter asked for was never looked at. Wife answered the first 6 questions and passed. Oath ceremony is scheduled for next Thursday (11/18).
A MAJOR change took place at our local office. One can NO longer change one's name during the N400 application. If one wants a name change, one has to petition a court for a name change and it's a separate process with additional fees. $355 for court filing fees + other expenses in CA. This fracking sucks as she's waited all this time for a name change to save on cost. Had we known of this policy change, we would have changed her name a long time ago. She's pissed off about this change in policy.

Well so far thanks everyone for your suggestions.
J. Ro. Thank you for sharing your case. I understand that even with the name change your case went throught the AOS part without any problem?
The problem is that my case is stuck there, and the officer wont recognize the marriage certificate as a "valid" document for name change. In which case I was told, either I'll have to get a court order (which is really hard right now) or cancel my application and file everything again with my old name.
I've talked since with a couple of immigration officers from USCIS, they recognized they've dealt with cases like this before, and certainly a marriage certificate is a valid document and I should not be having to deal with this problem. Lately I was told again the only thing I could do is get the Officer to recognize how the law in Minnesota works.
On my last call to the officer she asked Why did I change my name? Because she believed that a man shouldn't change his name under any circumstances. I felt tempted to tell her to try and fill a government form with two last names.
I also went to the court district to find out if i could get a court order, and they said that i could apply for one but since my name has already been legally changed the Judge may not grant me a court order.
Well the next steps on this adventure are: Going to another InfoPass appointment and try to get some sort of letter or communication from them acknowledging that my name change is totally legal and valid for immigration purposes, and fax that to the officer.
And contacting a MN congressman/woman and let them know about my case.
On the last call from our officer we got her to give us her direct phone number. I've been tempted to call her and ask to speak to her supervisor, but I don't know if that would be appropriate.
What do you think of that guys?

Be careful, though. Not all USClS locations do automatic name change during the N400 process. And that includes SFO! I tried to do the same thing but during the interview I was informed that it was not going to happen. Had to go to the court house after the oath ceremony and request a formal name change. So in my case, unfortunately, I ended up paying $355 court fee plus running ads for 4 weeks (!). The name change process this way takes over 2 months. Good luck when you get there.
This is so stupid, but true. It was NOT the case before but it IS the case now. My wife just came back from her interview and the interviewing officer wouldn't allow her name change. She said USCIS no longer allows you to do a name change along with the N400 process. One has to initiate a formal name change through the normal court process and that it would cost a lot of money. This is LAME!!! But true. This was for the San Jose, CA office.

thanks guys ! Newark schedules the oath on the same day as interviews... but what is weird is that my interview is at 1 p.m. ... usually, interviews in newark are held in the a.m. and oaths in the afternoon... the letter of the interview says "Interview Date and Oath Ceremony: Dec 9, 2010
Wow! That's very interesting. My wife's letter did not say that. Perhaps if you pass the interview, you'll get your oath done on the same day? That would be pretty awesome!

I was wondering if you have / will take a lawyer with you to the interview. Is this a standard (safe) procedure. All my papers are legal and straightforward.

This question is frequently asked. Not all offices allow your attorney to be in the interview room. Some offices allow it. Some do not. It depends on your local office. Your immigration attorney should know the local practice of your area. Ask your immigration attorney, if you have one, or ask them when you call up attorneys in your area. If your case is pretty standard and straight forward, there's no need for an attorney to accompany you. If you have real or serious problems you anticipate being brought up at the interview then it might be a good idea if your local office allows you to bring an attorney.

i rescheduled it to nov. 9, 2010 the supervisor just emailed me my interview notice
and i didn't get anything about what to bring
LOL. That's the same day my wife has her interview.

I'm been told that our local area has oath ceremonies about every 2 weeks.

A yellow letter (don't know what its official name is, but it is printed on yellow paper) is a letter sent from the USCIS to N-400 applicants instructing what to bring for the interview. It states in bold and big print at the beginning of the letter that THIS IS NOT A INTERVIEW LETTER. Don't freak out if you don't get one before your interview, not everyone receives them, and it's not that important because the documents they asked you in that letter to bring to the interview are all included in that comprehensive list of "documents for interview" posted in this forum or some other forums on the net. FYI on my yellow letter it just asked me to bring my driver license/state issued ID, besides all the general instructions blah blah. But be sure to bring it with you to the interview if you do receive it.
There is also a white letter I heard that the USCIS sends out to N-400 applicants before interview. I never got it, it's also another computer generated letter telling you what to bring to interview. The only difference between the two (i heard) it the yellow letter is more specific for your particular case and the white letter is just a general letter that probably sent out to everybody with the exact same content.

Asked about ceremonies and they do them twice per month at Yakima. Sometimes at the courthouse with a judge and sometimes the USCIS are authorised to do it at their offices.
All in all it was a pleasant experience once I was in the room but I was worried before. If I had been a shady character with something to hide, she would have gotten some dirt out of me with her reassuring manner which was very skilled. She was really good at her job.
Just a FYI. This most likely does not apply to you Alan, as you're a Brit who most likely will not be changing names, but for others who may "Americanize" their names during this process, only a judge can legalize a name change. If your oath ceremony is done at an USCIS office, you won't be able to change your name. If one needs a name change, the oath ceremony will most likely be scheduled for in front of a judge. Only a judge can sign off (court order) on a name change; the USCIS does not have the authority.

Absolutely. I have suspected from the moment I took the lead in the August filers, that the ceremony would be the stumbling block and in the words of Bob Dylan - " He who is first will later be last"

Agree with Derekkj. Timeline tracking is great but it can also make you paranoid sometimes when there may well be no reason to be paranoid. Esp. with something like variations from local office to local office. I think there's probably less discrepancies when talking about service centers - but local offices seem more all over the place to me. But, if there was a way to contact the local office and get a response, I don't think that'd hurt either.
This will be especially true when it comes to the oath ceremony. I've been looking over the timelines for past months and some people were offered the oath the same day as their interview and others waited over 4 months before they took their oath. The oath ceremony is where I suspect we'll see the most divergence for all of us.

I don't see the original spec as being set in stone like the Constitution as I think it should evolve to suit the average member (We the people)
I would ask whether the average member was even consulted before the 'standard' was set ?
If the majority of members see 2 lines instead of one, then I think it should be formatted for the average member and not just those who decided the format to suit their own screen resolution
I repeat that 1024x768 is a standard web design screen resolution - so if it can't be seen clearly using that resolution, then it does need to be changed for the benefit of the majority or the average user
Alan, the font settings may not be set in stone, but Z has taken way too much liberty in unilaterally changing the font, deleting instructions, and adding a eNOA heading without any discussions what so ever. He just goes ahead and makes these changes as if the list is for his personal use only. This template we use is a standard that's been used for years. Specifically, it is the FIXED WIDTH FONT (Courier New Font) that is critical for proper display. In my 4 years here and throughout all the processes, we've always used FIXED WIDTH FONT. Everyone has always complied with the instructions. Z has been the only person I've seen who so rudely and unilaterally takes it upon himself to change the standardized template to suit his own desires. His actions are so rude and ridiculous.
He continues to insist that I'm setting the standard. I am only following the standard that has been widely used on this website for years. Look at post #1 of this thread. It was NOT my post. It's a standard template that every month uses. I will continue to change Z's unilateral alterations in this thread. His behavior is completely unacceptable.

ok, just and update about my case.
I emailed the supervisor explained that I got into an accident, ended up with a cast and that i'm now walking on crutches.
She emailed back saying she's sorry to hear about what happened to me and descheduled my interview date.
She did say though to just email her what the new interview date I would want.
I didn't even have to send anything so I am so happy about it. I did plan on asking my doctor for a letter about the whole thing so now I won't need to do that.
Now, hopefully my foot heals fast so I can fly back to the US before the plane tickets get super expensive! lol

Congrats on having such a smooth experience. I do believe they treat military personnel better than civilians.

zqt3344 again unilaterally takes action and simply deletes instruction #5 as if it never existed. zqt3344, your propensity to unilaterally take action and change standards is shocking. You unilaterally add e-NOA without discussion. You change font to Arial without discussion.
I didn't call you out on it at the time because I was being polite. But since now that you want to toss the grenade on my door steps when I try to change back to the proper formatting as given by the instructions, I'm certainly going to call you out on all your unilateral moves.

zqt3344, you were the one to unilaterally change the font to Arial when it specifically states in the instructions to use Courier New font. You took it upon yourself to change to Arial in post # 24 of this thread:
Prior to that post, everyone, including yourself, adhered to the instructions and used Courier New Font.

#5 specifically states ALWAYS use Courier New font.
You have repeatedly ignored the instructions and purposely screwed up the formatting.
milimelo, was kind enough to reformat the alteration you unilaterally made to the original template but once again you decided to unilaterally change the standard format to a proportional font. If you continue to purposely alter the standard template, I will bring this to the attention of a moderator.
In all due respect you keep changing it for yourself without the benefit of others and WE will be changing it back to improved viewing. And as Alan has pointed out it was working quite well and much better. So I am going to change it back.

VJ uploader tries but wont upload a wordpad file with a 5 meg screen shot as the max in my VJ upload file is 1 meg would you believe !I already have 600 k so it wont do it

No this one (the header line) spreads onto nearly all of 2 lines.. The post earlier today was fine. (by ZQT3344)
The resolution I am using (1024x768), is what the majority of web users use and what the web designers use, so the majority of VJ members will be seeing two lines
Not the end of the world as I can figure it out after a while - but perhaps other members could report what they see...and what screen resolutions they use (right click the desktop and select properties)
ZQT3344's post uses proportional font and is not acceptable for these logs/charts. We need to standardize on a fix-font such as Courier New font.
Alan, if you know how to take a screen shot, please take a screen shot of your full screen when viewing this website and upload it here, or share a link to where you uploaded the screenshot.. I'd like to see just exactly what is being cut off/moved to the second line.

Nope. A marriage contract is different from other contractual agreements. The fundamental elements are offer and acceptance, as long as both parties understand there was a clearly intended offer of marriage. A letter of intent constitutes an offer and promise of marriage, but a formal contract isn't required. A marriage contract could be as simple as a public proposal followed by acceptance of the proposal.
Suggest you do a google search of "Breach of Marriage Promise". The laws that cover it are separate from contract law.
Contract law and family law (marriage) are both state issues and as such will vary from state to state. A majority of states have abolished the right to raise an action for breach of marriage promise.

VAWA can also be used by an abused spouse to adjust status without the sponsorship of their US citizen or LPR spouse. In fact, the primary reason for the immigration clause in the VAWA act was to allow an abused alien spouse to adjust status, especially in cases where withholding AOS was one of forms of abuse. It probably comes up more often on VJ in removal of conditions cases.
But as several others have stated, they have to be married before VAWA can be used. She may have several civil court remedies for her problems, including breach of marriage contract (remember the letters of intent?), but she could only collect damages. She can't force him to marry her.
A letter of intent is not a contract. Actually, one can always try to argue that some agreement was a contract, and a letter of intent could very well be a contract if it meets all the requirement for a legal contract, but a letter of intent is not a contract if it is properly constructed as a letter of intent.
All contracts need 4 elements, 1) agreement, 2) consideration, 3) capacity and 4) legality, to be legally enforceable. If any one of the four elements is missing in the letter of intent, then it's not a legal contract.
