  1. My wife's aunt just came here last week and all of the sudden the US petitioner changes. He's on the verge of just abandoning her and her daughter. He said he doesn't know what he wants to do after spending $ to bring her here. She paid about $3,000 for furniture as well. We hope this resolves, but if it doesn't what options would she have. Hire a high power Immigration Attorney?

    She has no options that you're alluding to. She has to go home. Nothing in the law compels the US petitioner to marry her. Just as the US petitioner took a risk, so too did your aunt-in-law. She took a risk and it didn't work out. She has to go back home. Nothing you've described so far would be construed as abuse.

    Your aunt-in-law can always hire an attorney. That is her choice. But it's doubtful the attorney can prevail for her as there doesn't seem to be genuine abuse in this situation.

  2. I know I'll probably get my application denied, but I just wanted to make sure.

    I'm going to be completely honest here. I'm in the process of obtaining my citizenship. I passed the interview and was recommended for citizenship approval on Sep. 17, 2010. I was arrested for petty theft on Sep. 29, 2010. This is my first offense. There's no need to remind me how unbelievably stupid and morally reprehensible this decision is. I'm not looking for justification. I know what I did was wrong, and I'm ready to accept all consequences.

    Let's get more of the facts straight. You posted that you were arrested. Given that it's only been less than 2 weeks, you couldn't have been convicted. Most likely, the DA hasn't even officially charged you yet. There is no chance of any deportation until at least a conviction. Can you be deported if you're convicted? Yes. It's certainly possible. Will you be deported? The chances are good you won't be deported. Given that it's not a violent crime, you're not on their priority list to deport.

    If you want to stay in the US and become a citizen, this is NOT the time to be cheap. Find a good (expensive) lawyer and really fight this charge. The best way out of this is to NOT be convicted on this charge.

  3. I am supposed to haVE my interview date on october 28th, i just decided on my own 2-3 days ago, but yesterday i got into an accident, and ended up having a cast on my Left foot. I am overseas filing for the 319 B naturalization, so in order for me to do my interview i would have to travel from japan back to america, in washington DC

    I am walking on crutches and I felt I would just let myself heal more before I leave the country, now my question is how can i reschedule my interview appointment? I haven't received the actual interview notice in the mail, maybe because the supervisor just emailed it to me, I am unsure if they will send me a physical one thru mail, I emailed her back but she has not answered me.

    ANyone know how I can best reschedule my interview?

    WOuld they be open to the rescheduling of my interview or should i just suck it up and travel even if I'm not 100% physically able to move around.

    Plus I'm staying at a friend's there and do not want to hassle them having to care for me so much more..

    I remembered you called to get your appointment. I would advice you call/contact using the same method you scheduled/obtained your current interview date. Tell them what happen--and be able to back it up with a doctor's letter--and I'm sure they'll give you a new appointment date.

    Re-formatted the tracking sheet that someone messed up by needlessly adding "eNOA" - people, electronic notices is something for you, not necessary to be reported - go by the paper NOA you receive. Once I took all the extra NOAs out as well as a bunch of dots it's looking better now...

    Please use this to continue filling the remaining of your N-400 process.

    Thank you so much milimelo for putting in the time and effort to reformat this tracking sheet back to its original format. It looks so much better now. I greatly appreciate your effort.

  7. Whoever introduced/added the eNOA and NOAltr really screwed up the whole formatting of the list. As the list with data currently exists, it neither works with fixed width font such as Courier New font nor proportional fonts such as Arial.

    Everyone, please take a look at instruction #5. USE Courier New font, not Arial.

  8. zqt3344, as per instructions line item #5, always use Courier New Font, other wise the formatting goes out of whack. I have reviewed this thread and it was this post that started the proper formatting off track. Please update using Courier New Font, not Arial Font. Thanks. Arial font makes it very difficult to read as the formatting is all off.

  9. No - you get your certificate at the ceremony; walk across the road to the post office and apply for the passport same day. That is what I am doing.

    Pay expedited processing and overnight return so you get it in 7 to 10 days.

    Download the form and fill it in and take it to the ceremony so you can skip across to the post office (passport designated post office)

    How much is the application fee for a US passport?

  10. i got my receipt number from the USCIS hotline ^_^ they just entered it yesterday and the lady from the USCIS military hotline told me they haven't even mailed off the NOA1 yet.

    But i know when we did the K-1 journey, that was how hubby got our receipt number, so u can just call them and ask ^_^ even if u ask the nonmilitary USCIS hotline

    when i called to get my n400 receipt# they asked me for

    1) Alien #

    2)first&last name

    3)and date of birth

    i tried looking it up on the website right away, my thing wasn't to be found so i called them again and I was told that for n400s the website isn't very reliable sometimes because it doesn't get updated right away.

    she did tell me though average n400 takes 4-9 months..

    so i'm praying we get thru it sooner since we're doing 319b, and there's this thing that we have to be here for at least 1 yr after the citizenship T_T

    I'm ok. Online image posted. But no number that looks like a NOA number. It's ok. I'm pretty sure the NAO will arrive by this Saturday. :)

  11. If it was a normal organization I would call em and switch it to Yakima or Seattle - but this is the USCIS. They would likely cancel it in Spokane and forget to reschedule it somewhere else and then after 6 months of calls and letters they would reschedule it back in Spokane !

    With this valuable knowledge of the USCIS systems, I am going to hold tight to what I have got and do that drive..

    Got to keep it simple with these guys or it invites trouble... I will be the gray man, low profile, straightforward, swim with the stream.....

    Come on early November and the USCIS divorce party !

    I hear what you're saying, but it just seems like acquiescing to the big bully. Each time another acquiesces, USCIS thinks its even more justified to do whatever they wish.

  12. I know it's embarrassing - had to reschedule UK holiday

    Now leaving 11th and returning 19th sept. I bet the interview letter is waiting for us !

    But they always give 3 4 or 5 weeeks notice of interview so should be perfect !

    Weird - as we have been switched to Spokane for FP which is 200 miles away rather than Yakima which is my local... even Seattle is 140 miles..not complaining - just going with the flow...

    You should definitely complain. There is no reason to make you drive 200 miles to a distant facility when a local one will suffice. That is just BS. I would contact them. 400 miles round trip is quite a bit in terms of wasted gas--bad for both your pocket and for the environment.

  13. to be honest it is kind of confusing since it does not seem to be like the normal or traditional type of RFE letter one would get in prior I485(2 yr GC) or I751(10 yr GC) filings before USCIS would let you move forward.

    I agree. It's very confusing to read that a RFE is a letter notifying the date of biometrics. RFE had previously always meant they wanted something more from the initial application.

  15. What if I schedule an INFOPASS to Garden City (NY) office and aske them directly if the lawyer can be with me?

    (if they cannot enter the room with me I d lose the attorney fee that can add up to 2,000$

    A lawyer should offer a free consultation. This is something you want to ask an immigration attorney in your area. An Immigration Attorney who practices in your area should know if s/he is allowed to accompany you to an N400 interview. Don't trust what INFOPASS tell you, trust what the attorney who practices in your area tell you. That said, make sure you talk to several local area immigration attorney, not just one, and see what the consensus is.

    I was looking at VSC time-line and compared it to CSC. I saw that there are people who filed in Augest and haven't received their decesions yet. This compare to California where now reviewing November files is so slow. I thought maybe it is not a bad idea for those people who filed at VSC in Augest and haven't received their decesion yet to send an email to VSC directly or USCIS Headquarters Office of Service Centers (email= SCOPSSCATA@dhs.gov) and ask them to follow their cases and also tell them about the differences between CSC and VSC processing times.Maybe they hire more reviewer or transfer some files to CSC to make processing times even. I found this email address on USCIS website. You can find more information about this on contact info on USCIS website.Good luck and hope everybody get his/her answer soon.

    If it's not been 6 months since your NOA date, I don't think you'll even get a reply. Where ever you go for help, unless it's been at least 6 months since your NOA date, you won't find much help. One place you can try is your federal elected Rep/Senator. They may take up your cause depending on how helpful they want to be to the USC constituent.

    Switching topic to our case, the wife received her GC today (12/21/09). She also received, in a separate envelope, the Welcome letter stating that she has been approved and stating that she should receive her 10 year GC card within 60 days. I thought it was kind of funny to have that standard disclaimer when in fact the card arrived on the same day as her welcome letter. :thumbs:

    We're done with this part of the process. One more (naturalization) to go next August. See you all then.

    Yeah, that's been told numerous times by different people. It will be okay.

    Appreciate the reassurance, but I wasn't questioning our completion with this part of the process. :innocent: I was merely relaying our experience with this hideous process and contributing further evidence/proof that indeed USCIS' information system is very screwed up. :angry:
