    Thanks for all your inputs. I wanted to quickly summarize Incase my original message was unclear.

    1. I submitted my N400 application April 2021

    1. I was invited to attend my N400 interview scheduled in Feb 2022

    2. When I showed up, I was told the interview could not occur because my a-file was not at the field office (Newark). The officer told me they will reschedule my interview once the a-file is at the FO

    3. I have not received any reschedule notice since then. It's been 1+ year since Feb 2022. It's been 2+ year since I submitted my N400 application

    4. I have contacted senator twice (in 2022) and Jan 2023 but they keep passing on the information provided by USCIS stating my application is in queue to be rescheduled. 

    5. I have filed case outside of processing time twice but no response to any of those.

    6. I have written two letters to Newark FO asking for status and also letting them know I did not miss my appointment. 

    7. I have called USCIS number to find out where my a-file is and they said ita been at the Newark field office since Aug 2022

    8. I have even tried FOIA in 2022

     

    Nothing has resulted in the reschedule of my N400 interview. This is why I asked for some guidance on next steps. From what I am able to understand so far from your comments, it seems WOM (lawsuit) is a solution and a few have also recommended ombudsman to ensure I go through all administrative processes.

    It is USA office who eventually caliberates the pressure on USCIS for a prompt adjudication. This may end up solving his issue because many USA dont want to add more work on their shoulders and resolve the matter before it creates an electronic file at DOJ.

    Do you have a copy or sample of this demand letter?

    If you apply Pro Se, you need to research and read precedents. You will need to read Federal Rules of Civil Procedure (Parts that apply to you) and any Local Rules so you can litigate your case better. It is not a rocket science but it is definately complex than doing an N-400, With that being said, there are plenty of people who have done it Pro Se. I am, personally, of an opinion that lawyers are waste of time except (Removal Proceedings).

     

    For a "Complaint for An Action Under 8 USC, Section 1447(b)," I can share a sample that will guide you to write your complaint.

    Hoping for guidance. I submitted my n400 application in March 2021. I was invited to show up for my interview scheduled for Feb 2022. When I showed up, the officer mentioned my a-file was not at field office so a reschedule letter will be sent to me once a-file shows up. I have called USCIS customer service line and they show a-file has been at office since Aug 2022. My case is now outside processing time and I have filed online request but it's not been successful. I contacted my senator Aug 2022 and they told my senator that my interview is in queue to be scheduled. It has been over two years since I submitted my n400 application, over one year since I was told my interview could not proceed because a-file was not at the office at the time, over 9 months since they told my senator the interview was in queue. What do I do next to get my n400 interview scheduled? I have filed multiple online request since my case is now outside processing time but nothing has been helpful. I feel stuck

  5. I got an interview notice to show up for my interview. However, I get to the office, they call my name but I see "requested" written by my name. The agent indicates to me that my case file has been requested and is not at the field office hence they could not proceed with my N400 interview. I tried to get indication on next steps but all they said was it varys and I will receive another interview notice when they eventually get the file. My case status on the portal has not changed to reflect this and still reflects my case has been scheduled for interview. Has anyone encountered similar issues? I am freaking out. This occured in the Newark office.

  6. I received a notice of intent to deny after our Interview at the field office. We responded back within the giving timeline. Its been 3 months now since we responded and we have heard nothing yet. We just recently called the 1-800 number and we were told our case was transferred from the field office to a service center. The level 1 analyst did not specify what service center on the phone.

     

    I have never heard of such cases were the field office transfers to a service center. Any assistance on this would be helpful. 

  7. I thought I would provide information on my AOS journey. It would be very helpful for some of you. I was on F1 visa status and met my boyfriend in college. After graduation we got married and the rest is history. I would provide a timeline with detailed explanation of each step where possible

    Met hubby and started dating freshman year 2011

    Proposed in late 2014

    Married = Early 2015 (we were both 20/21 in age at the time)

    We did not file concurrently, we filed seperately

    Filed I-130 = May 2015

    We got RFE for I-130 for g325a in July 2015. We filled it out and sent it to California.

    I-130 got approved = August 2015

    Filed i-485 and 765 = June 27 2015

    Application got rejected = July 2 2015. Apparently, we filled out section 2h as opposed to ticking 2a. We ticked 2a, attached a copy of the I-130NOA1 and resent it

    Resent 485 and 765 = July 09 2015

    Recieved NOA1 = Around July 16

    Got a job offer that I had always dreamed of and I needed to accept the offer by August 30. I sent a letter to the congressman in my district asking for expedite, filled out the required forms and sent my offer letter once i received my NOA1 because they needed the receipt numbers to consider any request. Sent this July 20

    Biometric notice = July 22

    Biometrics done = July 24

    EAD Approved = Early August

    EAD Card in hand = Around Aug 19

    Accepted my job offer

    AOS interview letter came in Aug 13 and noted my interview date was September 26

    Unfortunately due to a family emergency, i had to reschedule the interview. I also forgot to note that this family emergency required me to travel out of the country so I scheduled info pass appointment to request for emergency AP with all the relevant documentations. This got approved. I travelled for 7 days and was successfully paroled back into the country

    Before I left, I called the customer service number requesting for reschedule of interview and i wrote to my local office with all documentations. I did not hear back until a month later (my interview had passed at this point). When we heard back, we were asked to submit additional information which we did. Later we recieved a 2nd letter from the field office stating the i-130 was sent to NVC but they have requested it and until they recieve it, they do not require anything from me.

    I had my EAD and was working so i did not mind the wait. Finally the interview letter came 4 months later in Jan 30th 2016 asking my husband and i to report for the interview Feb 16th 2016. We interviewed on this day Feb 16th and got approved the same day, we got our GC 10 days in hand. In total it took 13+ month to get the GC. Took about 30 days to get EAD

    Now the INTERVIEW WAS A WHOLE DIFFERENT BALL GAME

    Our interview was close to 45 minutes LONG. My husband who is a USC was questioned alone for close to 35 minutes and I for 10 minutes. We were both sworn in at the same time but the moment my hubby showed his licence (different state) they told me to go outside. in regards to my hubbys licence he wasnt willing to change it because it had not expired and he frankly did not want to retake the exam. At the time, we didnt think it was a big deal but boy... MAKE SURE YOU BOTH HAVE THE SAME STATE LICENSE. Now the below are the questions we can remember them asking.

    QUESTIONS FOR HUBBY(what we can remember, we may miss some)

    - When did you get married

    - how did you meet

    - what did you do last weekend

    -what was the last amount you deposited in your bank account

    -what is your insurance provider

    -BRING OUT YOUR PHONE

    - Do you have facebook

    - open your facebook and scroll through the pictures (ofcourse my picture was on there)

    - What do you do

    -Has she been to your job

    -How much do you make /week

    - where do you live

    -parents name

    -siblings name

    - bills paid

    -average amount

    -describe the home

    -met the landlord?

    -Who pays rent

    -How much?

    - Why did you reschedule?

    -Where did you live before moving here?

    - Have you been arrested?

    -Who cooks?

    - what he cooked on saturday?

    -Favorite meal?

    -How many kids we want to have?

    -Own a gun? (this question came about cos my husband said he loves playing video games)

    - What type of video games?

    - What type of shows you both watch?

    -name of my employer

    -name of my school and my major

    -if he met my family

    -people who attended our wedding

    - How i met 1 of my friends that was at the wedding?

    -What i dod at night?

    - etc ..there was a lot more but i am drawing a blank now

    Questions for me

    After he was done for soo long, i was called in while he stepped out. Apparently, he got irritated with the lady asking him too many questions when he said he loved playing Call of Duty and she replied is that a shooting game? And his response was DUHHH lol..( yes he really said that). Well back to my questions

    - Basically they asked me similar questions to see if our answers matched

    - What did you do last weekend

    - What type of video games?

    - The type of shows

    - How much our insurance was

    - Last time we deposited and how much?

    - If our place was a house/apartment (weird)

    -why i rescheduled?

    - when last i left the country?

    - Port of Entry?

    Date of entry?

    - How many kids we want to have?

    - if i had met his parents

    - why our engagement was short? Well we dated for 3 years, he proposed and we married within 3 months..

    -name of his employer

    -how much he made?

    - where i had lived within the past 5 years?

    -When we both moved in together?

    -if i met his family

    -who our mutual friends were

    - How i met my friends?

    - what i do at night?

    - what his favorite meal was

    -what he cooked on sat and sunday

    -Turn on your phone, show me your screen saver, go to your picture folder and start scrolling (we had lots of pictures on it)

    Mine took about 10 minutes, he was in there for longer.. They took out random pictures and asked questions about the event too. The only documents they took from us where copies of our joint assets and pictures.

    After the interview, we were given approval and we got the GC a few days later.. I must say it was a very mentally tiring day and we were just glad it was over. The questions werent difficult especially since we have known each other for so long. Why they fished so hard, we still wonder. Another thing that we noticed was that EVERYONE else in the interview waiting room had an attorney except us.. I dont know what that means about our field office but as long as your marriage is real, you will do just fine regardless of what they throw at you.

    So my interview date was scheduled for September 15th but i lost my father and had return home for the funeral(September 17th). I called the number and raised a service request for an interview reschedule as soon as I got the interview notice (August 15th). I also wrote to the field office and turned in tons of evidence to support my claim.

    I have just received a letter from my field office stating that they cannot move forward until they receive my approved I-130 from the National Visa Center. These were the exact letters " We are unable to move forward until the Field office has received your approved I-130 from the National Visa Center. Once the office within your jurisdiction has received your approved petition, you will be rescheduled for an interview. At this time no further action is required and we apologize for any inconvenience"

    Now this is what I am confused about. I am based in the United States here and married to a USC. My I-130 was approved in August 12 2015 and I have the approval notice. If they had not received my approved I-130, why was I originally scheduled for an interview in September 2015?

    Is waiting on an approved I-130 from the National Visa Center an error??

    I am so confused.. I thought the National Visa Center scheduled interview for spouses that are overseas and not spouses that are already in the United States.

  9. I was on F1 student visa but undergoing the process to adjust status after getting married to my long time bf who is a US Citizen. I have an approved EAD, AP and form I-130. My I-485 is currently pending.

    I am filling out a form to obtain a UK visa using my EAD/AP and there is a portion in the form that asks what my current immigration status is.

    What do I put there?

  10. I entered the country as an F1 Student but recently adjusting my status to a Green Card holder. I do have a valid EAD and AP as my AOS is still pending. With applying for a UK visa, they have asked that I show proof of US Immigration Status. Will my EAD and AP suffice? If not, what should i present?

  11. My Husband who is a US Citizen submitted i-130 May 2015

    I submitted I485 and I765 June 24 2015 with I-130 receipt notice

    I got a rejection notice for both 485 and 765 on July 9th

    I resent the 485 and 765 forms with the corrections on July 10th 2015

    I have not yet received an update on the second submittal yet

    My question is, should i track the 1st rejection notice online for an update or will there be another new receipt notice # for the second submissions

    I hope this is clear

    I got rejected once because of improper filing. I have since resubmitted the documents but no news yet. My question is, should the current rejection receipt notice be updated online if it were accepted or rejected (hopefully not). Or will another recipet notice be generated again on the second re submission

    The reason I ask is we have since resubmitted the i485 and we have been checking the case status online for the initial rejection receipt notice for any updates and there has been no changes.

  13. I did go into my local USCIS office and they said i should send the RFE asap to the california service center.

    They also mentioned that if for some reason, I get another rejection that we should write a cover letter stating my husband is a US citizen while attaching a copy of his birth certificate and/or passport with the I-130 notice

    The wait game begins to see if the 2nd submittal we sent would be accepted... I hope it would be..
