    You do not need the divorce decree recognized in the Philippines for the visa process, your fiancee will need to bring her divorce decree (and a copy for the embassy to keep) to the interview.
    Follow the embassy instructions letter for what is required.
    If the divorce was initiated by the foreign spouse your fiance can get her divorce recognized in the Philippines.
    I suggest if you decide to get the divorce recognized in the Phils that your fiancee contact an attorney, the process is not as simple as showing up at PSA (use to be NSO)
    Here is the process your fiancee must follow: (do remember this is not required for the visa process)
    Annotation on the effects of divorce declared in a foreign country
    A request for copy issuance of COM with annotation on the effects of divorce abroad resulted to a negative result or COM without annotation.
    How to correct
    The divorce decree granted by a foreign country must first be filed for recognition in the Philippine Regional Trial Court (RTC). Once the local court recognized the foreign divorce decree, register it to the LCRO of the place of jurisdiction of the RTC which granted the petition. The next step is to provide the copy of the registered court decree and certificate of finality to the LCRO where the marriage was registered for the annotation in the COM. Once registered, you may now request for an annotated COM at NSO. The complete set of documents: registered court decree, certificate of finality, certificate of registration and the annotated COM is to be forwarded through courier to NSO for processing. Also hand-carry the set of documents for filing an application at NSO-Central Outlet, East Avenue. That is not correct. Embassy do NOT require the MC be annotated, the embassy will accept the divorce decree without issue.
    Wrong. The embassy will accept the divorce decree without the MC at PSA being updated.
    Having the divorce recognized in the Philippines is SOLELY for the Philippines, is not needed nor required by the embassy.

    How can I say this? ... you got one ignorant attorney.
    Embassy instructions letter lists the CENOMAR as a required document. They will also want a copy of the divorce decree, bring the original along to the interview for the CO to view, but only give the embassy the copy)

    CENOMAR is standard requirment for k1 visa, but the usem will only require u wen u already have ur packet3.. Since ur fiamce is divorced with a foreign husband, she will still need to apply for cenomar but she will be givem a cemar instead, but she will only need to attach her final divorce decree to the cemar just to establish that she is already free to marry.. It will be ok..usem will tramp the cemar because of her divorce decree

    Just received my 1st packet from US embassy for my application of K-1 Visa yesterday. I feel so worried about one of my requirements that they asked me to submitt, the CeNoMar w/c stating of my singleness in the Philippines. I was married in Phils. but divorced in hong kong. The problem is, Philippine Government will not recognize my divorce so my record in NSO will still remain Married. But i also read that the US embassy will acknowledge my Divorced in Hong kong. I was so confused if there will be a conflict on my papers for this situation? Will my Divorced Certificate trumps my CeNoMar? Anybody here been through on this kind of problem in applying for K-1 Visa? I hope to hear some response! Thanks!

    Nso will issue you a cenomar with your ex's name on it. Usem will accept your cenomar but make sure to attach the copy of your foreign divorce. My fiancee had her interview last month and they accepted her cenomar with her ex' husband's name on it.

    U dont need to file annulment in philippines, my fiancee file a divorce in japan too,,u need to take ur divorce decree to NSO and ask for Red Ribbon and u can still use ur philippine passport with ur ex husband last name,once u get married here in US then u can apply and change ur last name,, if u have a ym id i explain u everything
