My husband and I just overnighted the RFE response back yesterday so they got it today. They wanted proof that I was a US Citizen (apparently they must have lost the certified copies of the birth certificates that we included for me). I also included with the RFE a copy of my passport Bio page per their request. They sent the RFE to my husband (the beneficiary - AOS immigrant).

You should have never have sent an original to the USCIS. Get a certified copy (You'll need it anyhow since you won't be getting your original back.) You can then send them a photocopy of that (front and back) and/or the bio data page of your unexpired passport.
You send it back with the RFE as a cover page. If you have to send it to a PO box make sure to use tracking via USPS. If there is a street address you can use UPS or fedex.
What I sent them was an original (certified) copy that I got from my local city hall two months ago when we started this process. I had to pay $10 per copy so I got a couple. I say "original" because it's not a photocopy and from the source (ie the city hall).

Received the RFE letter in the mail!!!!!
I need help with what so send for the RFE we just received. We filed I-130, I-485, I-765 concurrently. My spouse just had his biometrics last week. We knew the RFE was coming and it just arrived and here's what it says:
"Submit evidence to establish that the petitioner on form I-130 or decedent on form I-130 is a United States Citizen. Such evidence may include: a birth certificate issued by a civil authority showing birth in the United States, a Puerto Rico Birth Certificate (myst gave been issued on or after July 1, 2010), a copy of the biographical page of the petitioner's unexpired United States passport, a copy of the petitioner's Certificate of Naturalization or Certificate of Citizenship, or a copy of the petitioner's Department of State Form FS-240 (Report of Birth Abroad of a United States Citizen)."
So, I have some questions:
1) I already sent them an original birth certificate, why do they want another - did they lose it? Do I have to send them an original birth certificate again or can I send them a color copy?
2) Do they just want one item from above or should I include the passport biographical page color copy as they ask for?
3) I always thought here on Visa Journey people say to NEVER send just the biographical passport page? However, here is the USCIS sending us a letter asking for just that page and no others? I'm very confused!
4) Do I need to send it back to them with tracking? ie FedEx or Overnight? Do I need to include a cover letter as well and a G-1145 for email / text notification or since I already sent them that with the original packet it's tied to that?
Thanks !!!

I have read that an AOS RFE holds up the whole case. While that sounds bad, the other cases I saw that had an RFE and responded quickly (which it sounds like you may be prepared to do) didn't have too much downtime. They seem to be getting approvals about the same time as their peers.
Thank you! Do you know if they actually do requested the full tax returns, can I just send the tax transcripts from the IRS instead?
-
We got the RFE (after checking the status online it said RFE was mailed 12/31) we have yet to get the actual RFE. I'm thinking it's for tax forms as I only mailed my most recent return and not the transcripts from the past three years. In hindsight I should have. If they do request all full tas returns from all three years in the RFE can I just send the past three years worth of transcripts instead? I went to the IRS to get them jus tin case we got RFE.
Does the RFE also hold up the EAD card processing or is it case by case basis?
-
We checked the case status and got RFE mailed on 12/31/15
It's probably for tax returns for all years as I only sent the most recent. Is it OK if I send them just the transcripts if the RFE wants full tax returns?
Thanks!

My husband and I arrived back in Saint Louis from Christmas in Rhode Island. The biometrics letter was in the mailbox yesterday, must have been there at least a week or more. Appointment is on 1/5/2016 for biometrics. Anyone know when we should all expect to have our interviews? I'm hoping we will not have to have one since he's been here in the US on various student VISAs for many years.

Received my Biometrics appointment in the mail today ?
what date do they have it scheduled for? (the biometrics)
-
Still waiting for the NOA1. ( they received it 08th december).
It's "only" 10 days but makes me kind of nervous because everybody else got it already ?
My husband (lives in a different state) got the NOA for the I-765 and I-1485 in the mail. I got all three texts and emails for the I-130, I-765, and I-485. I called USCIS and they said that sometimes they don't mail a hard copy of the I-130 NOA.

I don't think so, but someone was saying their AP document was being processed before they received their biometric letter. It could be possible....but I doubt it. I have yet to see it anyhows.
Thank you! Anyone get their biometrics letter yet?
-
Is it ever possible that USCIS will not require biometrics if AOS? Just go straight to the interview?
-
My husband received his NOA in the mail for the I-765 and I-485 yesterday in Missouri. I have yet to receive the I-130 NOA hard copy by mail, but I live in Rhode Island so it should probably be here by Tuesday to me. Whoo hoo! Hopefully the biometrics appointment letter will arrive sometime in the next 6 days.
-
Anyone having this issue? We got 3 text messages for the NOA for the I-130, I-485, and I-765. All with MSC #'s.
However only one of the MSC #'s actually works when we track the case status online and that is the receipt # for the I-485, the other two aren't working yet. Is that normal?
-
We sent the package a week ago, still didn't hear anything. They received our docs on Sunday December 6. They also didn't cash the money orders.
We sent the G-1145 along with the other documents. That means they will notify us when they have the documents in hand and start working on them?
Yes, it should be in the next few days that you hear something!
-
Anyone know what location it will be at?
Also, only one of the USCIS Receipt #'s is working for checking the case status and that is for the I-485, the other receipt #'s for the I-130 and I-765 don't work yet, but I haven't gotten the hard copies.

Hey all,
I'm the petitioner and I live in Rhode Island, my spouse is the beneficiary who I petitioned for AOS from his J1. He lives in Missouri for work. On the docs that we submitted for the concurrent filing we wrote down St. Louis as that's the closest office to him. Is that where he will go for Biometrics and where we will go together for the in person interview or is it up to the USCIS to choose ultimately?
Thanks!

It's moving along quickly for us!
-
Congrats! I'm sorry I can't answer your questions, but I have a question for you, what is the $420 for?
The fee for the I-130 that needed to be filed with the I-485
I-130 fee = $420
I-485 fee = $1070 total (including biometrics fee)
My spouse is currently in the USA on a J-1

11/29/2015 -Mailed I-130/I-485/I-765 concurrent filing to USCIS Chicago Lockbox
12/02/2015 - Delivered to USCIS at 11:00 PM !!!
12/08/2015 - Received 3 NOA text messages from USICS at 11:25 PM !!!
12/09/2015 - Checks for $420 and $1070 showing cleared as of 12/08/2015 in bank accounts
I'm worried this is going so quickly - my husband is visiting me on 12/20 for Christmas. I'm afraid they will send the Biometrics appointment letter while he's here visiting (he lives in another state for work). Will I get a NOA text message for the biometrics or will they schedule it here in my state while he's here visiting if we ask?
-
Why not wait out the entire day? Today is the estimated/expected delivery day and the day has not yet finished. No need to panic so soon. Good luck!
I was worried for nothing. It was delivered last night at 11:22pm!
I assume now we just wait for the checks to be cashed and a notice from USCIS that it was received (notice of action?).

Hey all,
I'm a little nervous. We shipped our I-130/I-485/I-765 concurrent filing packet to the Chicago Lockbox on Sunday morning from Boston MA's main post office using Priority Mail with Delivery Confirmation. When we track the package this is all we see. Shouldn't the package have been delivered by now? What if there are not anymore scans? Anyone ever see this happen?

You are the sponsor. If your income is enough, it's not necessary to count anyone else's income.
Thank you very much! It's just very strange, you'd think they'd want that type of information on the person being sponsored.
-
Thank you so much, one other question... since my spouse who is the beneficiary that I'm sponsoring is getting income from his University that he teaches at now while on his J-1 why was his income never asked for on the I-864 or anywhere else? Do we just bring that to the interview meeting? It's not like we need it for the I-864 as I make enough to cover both of us.

USCIS received our response to the RFE!!! Yay, I hope this is a good sign! They didn't put a date though that we'd hear by and I know most people get a date in their status when they'd hear by.
On January 14, 2016, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSC###########. Our National Benefits Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.
