  1. Just now, Scandi said:

Good, you'll most likely receive your mail then.

Yes you file all the ROC paperwork with the correct address and hopefully they add the extra number of your address in the system. You can also try to make an address change online if they refuse to help you over the phone.

Thanks, will give the online address change another try now.  I've checked the AR-11 I filed and it definitely has the apartment number on, so not sure what has happened.

I just needed some peace of mind.  All my paperwork is in order to send so it's just this one little blip that has me worried.

  2. I'm currently on a 2 year conditional green card and moved house back in March. I followed the correct procedure of notifying USCIS of the new address for myself and my sponsor (my husband) within 10 days, as per the guidelines.

This past week I received correspondence to remind me that I'm entering the 90 day period where I can apply to remove the conditions on my green card. However I noticed that the address does not include my apartment number - I've checked back on the documents I submitted to change my address and can confirm that this wasn't omitted from my side.

I called this morning and it seems there is nothing USCIS officers can do to update the apartment number on the system and the only thing they could do for me was update the address on my already accepted I-485 from 2 years ago.

So it's left me in a position of concern as there are 8 apartments at my address and it's only by chance that I received the last letter. What other measures can I take to ensure USCIS documents arrive to my correct address? Will USCIS update my records with the apartment number when I submit my paperwork to remove conditions?

Help ease my stressed and troubled mind

  3. Congrats allyalexandra and good luck avania.

We're still collecting paperwork to respond to the RFE we got at interview...it's been kind of a nightmare. Bank won't add me to the account without a utility bill to prove address (all the joint insurance documents we have aren't enough) Utilities don't bill out in joint names, only a primary and I can't be added as a primary as I'm not on the lease and I can't get on the lease as the letting agent requires a green card (it's part of their policy)

This is what we have got, but no idea if it's going to be enough:

    - Screen shot of VA e-benefits website showing me listed as a spouse (in pending status as they take forever to process anything)

    - Screen shot of water utilities account showing me listed as a spouse (on headed paper)

    - Screen shot of electric utilities account showing me listed as a spouse (on headed paper)

    - Joint car insurance documents

    - Joint renters insurance documents

    - Letter from Rental Agents regarding why they can't add me to the lease

    - Letters of attestation from four friends (and hopefully the next door neighbor is doing one)

    - Screen shots of Facebook conversations and Skype conversations

    - Letters of attestation from us both regarding the difficulties we have had getting documents (like the bank)

    - Receipts for the engagement and wedding rings, and other gift receipts

They already have around 20 photos from us that we took to interview.

We had an Infopass appointment earlier this week but it was a completely pointless exercise. We're both stressed and really upset - especially considering a lot of people have been accepted on much less than what we have (and there are no real red flags on the case, apart from my husband being a disabled military veteran and I'm only mentioning that as a red flag as it was something that the Interviewer kept bringing up and going back to)

  4. Hope everyone is doing alright and getting ready for Christmas ^_^

Any other May filers heard about their interviews yet?

We are still in the evidence gathering process for the RFE we received at Interview, feel like we have made some progress this week but we have come across so many people who have been incredibly unhelpful and even rude - it was disheartening but this week has made us feel much more positive.

  5. Hi Luisa,

We were in a similar situation - my husband is my sponsor and he's a disabled military veteran.

USCIS accepted the following documentation from us:

    - Letter from the VA stating annual benefit received

    - Twelve months of bank statements showing the monthly amount being deposited

This was how we worded the letter to accompany:

"Regarding the requested tax documentation, ************* is in receipt of disability benefits from the U.S. Department of Veterans Affairs which accounts for 100% of the income recorded on the I-864.

This income is non-taxable and therefore ********* is not required legally to file taxes in accordance with IRS publications 525 and 907."

USCIS deemed that to be sufficient in our case so, hope that helps somewhat :) I think knowing the IRS publications helps.

  6. I hope you will be prepared for an emergency if you have no cc and therefore aren't on the credit radar.

Having no credit history is a hardship unless you live in a cabin in the woods and off the grid somewhere.

Get the EAD and SSN ! You never know what the future holds and you need to think about being less dependent on your husband.

Why not get a joint one and if you do not like debt then use it very minimal and pay it off each month.

Ask the car insurance about adding you, get the car title in both names, get life insurance leaving each other as beneficiary.

Sometimes we have to do what we don't like to do in order to comply with the system.

We are covered in an emergency without having a credit card so that's not an issue (although husband is tempted by the idea of a cabin in the woods)

Future wise, I'm actually a qualified accountant so once everything is sorted the intention is for me to go back to school to update my qualification with the relevant ethics and codes of practice for the US and then I have a few book-keeping contracts waiting for me that I can work on in a self-employed capacity. We have also talked about me working part-time. The IO seemed very supportive of this when we were talking to her about it.

It's not that we don't like/want to do these things, but have just been met with genuine barriers. Hopefully will be able to make some progress today with the bank so that's a positive start.

  7. I say apply for ead card now [fee waived when showing receipt notices on i-485] then once you have receipt on ead, walk in to uscis office, citing emergency need with the security guards.

Then with ead in hand, go to ssa office, apply for ssn. Then go back next day and get the number.

With a ssn, you two can generate loads of stuff.

Its either that, or you generate about 11 letters of attestation covering each thing you cannot obtain due to no ssn.

Thanks Darnell, that's awesome advice as we didn't realize we could do that.

We have been given 90 days to respond to the RFE, so it sounds like the EAD is a viable option for us with the process you have stated.

  8. Hoping for a little bit of advice and assistance from this lovely community regarding our situation.

We had our Interview yesterday and although it was a little weird, everything seemed to be in order apart from needing more evidence of our relationship. The lady interviewing us said that she could split us and ask questions, but it would be pointless as she believed the validity of our marriage, we would just need more documentation for our records before she could approve us.

She seemed very focused on my husband (USC) being an 100% disabled military veteran and returned to that point a few times. Although he satisfies the criteria of having an income of 125% above the poverty line, it felt like she wanted to see evidence that he would adequately look after me (she questioned him a lot and hardly asked me anything) Due to the nature of his disability we are a very self-contained relationship with limited outside social interactions. Even the IO admitted we may need to be a little creative with the additional evidence.

So, this is the evidence we took to interview:

    • Photos documenting our relationship
    • Letters of support from my family
    • Cards from my family
    • Chat correspondence between the two of us
    • Couple of bills in my name

The additional evidence we are looking at getting is below:

    • Added to joint account and savings account
    • Added to household utility bills
    • Living will
    • Written statement from husband explaining his condition in relation to the marriage (she seemed to indicate to us to do this one)
    • Engagement and wedding ring receipts
    • State ID (hopefully picking that up today)

We're hopeful that would be enough to satisfy the criteria of evidence they are asking for, but I was wondering if anyone else had any other viable suggestions?

Just for reference, these are the things we are currently unable to do (unless anyone can give some helpful pointers):

    • We never applied for an EAD for me as we didn't think it would be needed (hindsight is a wonderful thing) so sadly no SSN
    • Despite pestering the letting agent to add me to the lease and them floundering around with a response of they don't know how to process me, they have now turned round and said they won't add me to the lease based on my immigration status and that they won't even give us a letter stating that. They even went as far to say they are not happy with me living here anymore. It may be the case we have to move out although we were loathe to do so due to the extra expense and stress (especially as we were looking at buying once my status is sorted) So that's another separate bundle we will need to unravel
    • Husband is very much against credit cards (he doesn't even have one himself) so doesn't wish to obtain those
    • As his income is from the VA, it's not taxable so he's not required to file tax returns so there is nothing joint there on that front
    • He's tried repeatedly to add me to the VA claim as that also covers us both for medical, but have been met with repeated brick walls
    • I don't drive, so not sure if he would be able to add me on to auto registration/insurance
    • No children and not a possibility either
    • He only has a pay-as-you-go phone and I don't have a phone at all (with no wish to either) so no contract on that front to be added to
    • As we are self-contained and minimalist, we don't have any friends that could write up an affidavit of support

At the moment my husband is wanting to instruct an attorney, just to help alleviate the stress a little, but I figured in the mean time the wealth of experience here could help us get on track with a few ideas.

So any evidence suggestions would be greatly appreciated :) Thanks for taking the time to read this as I appreciate it is quite lengthy.

  9. Now that the dust has settled on the interview and we're both in a better mind frame, we have a plan on what we need to sort out.

The interview was kind of weird though, we expected a format of ask hubby (USC) questions from I-130, ask me questions from I-485 and then ask about the relationship. Our appointment was scheduled for 2:15pm and we got called in earlier, sworn in and gave ID's. She confirmed our address and then all of the questions thereafter were focused on the relationship and mainly directed towards my husband, although asking me one or two things. I think she only asked me about 5/6 of the yes/no questions from the I-485.

We went through all the photos we bought with us and she was asking about them and then talking about the area, we also talked a little about the UK. She asked husband twice about whether he had visited the UK and seemed to talk about the K-1 for a bit and why we didn't go down that route. Considering there was nothing in our file that would indicate intent it was kind of weird.

She said she would need to see more evidence of co-mingling (despite us explaining extensively some of the issues we had - it's kind of a unique case and hard to explain) and gave us an RFE with 90 days to respond. She said she could separate us, but believes our relationship is legitimate so it would be pointless. She explained the process of Removing Conditions and then talked more about the types of evidence we needed to provide and because of our situation we'd need to be creative.

All in all, it felt very weird and we've both come away feeling really strange and confused. Specifically about the one thing she seemed to pick on.

  10. How long have u been married?

Since April; every time we have tried to add me to the lease they have stated that they don't know what to do or how to process it. They seem happy enough to accept our money every month though <_<

I've just applied for a state ID so hopefully that will help a little, we were hoping on moving house anyway but wanted to wait for the process to be over so thinking we will maybe have to move sooner rather than later so I can be added on to a lease.

We took a reasonable amount of evidence, just that they want more :( The things I expected to come up as issues were hardly mentioned, but she seemed to key in on my husband and on specific issue which was unexpected and irrelevant (don't want to go into too much detail on a public forum). Since the interview, everything we have tried to do since have been met with dead ends and we just feel so fed up

  11. Feeling very stressed out - she hardly asked me anything but fired most of the questions at my husband (who is the USC)

They want further evidence of our relationship and have given us 3 months - she didn't want to separate us as she believed our story but we just needed more documents. We just tried to go the lease company where we live and they were incredibly rude to us - they won't add me to the lease as I don't yet have a green card and they also won't even write a letter to state they can't add me to the lease....arggghhhh!!

We didn't apply for an EAD at the time as we didn't think it was something we needed.

I don't suppose anyone has any suggestions or any legal standpoints?

  12. Our Interview is today (18th November) and I'm so nervous :( I'm thinking of all the worst case scenarios.

We're prepared as we can be, got a little folder together with all our documents. Been reading a lot of interview experiences so feel as though I have some idea as what to expect. Trying to keep positive and focus on plans for the future (and our first Christmas together)

    How is everyone else doing?

  13. Congratulations to you both :)

Now November is here, I'm getting nervous about our Interview. I'm a pessimist by nature so thinking of all the things they could possibly "pick on", more than anything I'm worried about the medical as on the vaccination sheet they have filled in a lot of the dates, but ticked 'not age appropriate' for a few things :-/

The other thing I'm worried about is that both my husband and I have been married before (although we both have the relevant divorce documents) so I'm worried in case they go straight for that.

I know I am probably stressing unnecessarily. My birthday is a few days before the Interview as well :-/

  14. It gives me a little hope, as we don't have much evidence due to the fact we are wanting to make a big move once all this is sorted. We haven't been able to put me on the lease as they wanted to sign a new contract for another year (which is not great when we want to move asap)

I am hopeful these interviews are reviewed on a case-by-case basis, as due to my husbands personal circumstances, we don't really go out much. I'm really fretting they will give us a hard time at the interview.

The card being in production sounds positive Lara.

  15. Good morning May filers? I have a question. I want to ask if how long does USCIS usually take to review and make a decision after it receive response to a RFE?

We received a RFE last June for my I-485 application and responded in July. The last update I got is that 'Response to RFE Was Received'. That was 5 weeks ago.

    Thank you very much!

In a similar situation...my last update on My USCIS was on the 07/05 saying Response Received.

  16. No more news from me, my case status is still showing as response to RFE received. We didn't apply for an EAD but wishing I had now so at least there might be some progress.

I'm adjusting through Portland and believe that they are working on a 5-7 month processing time, so I expect to hear something between October-December. It's hard anxiously waiting though....I check the USCIS website daily and get all jittery on a daily basis until the post arrives.

  17. Hey all! I just came back from my mini 4th of July vacation and checked the online status. My i-485 status has been updated to "Case Is Ready To Be Scheduled For An Interview".

Hopefully I get my EAD/AP and the interview date soon.

    What's up with you guys?

Oh my gosh, I am so glad I saw your post as I checked the online status and it has finally updated after weeks of just saying "we have received your application'

The i-485 one now says "On June 24, 2015, we received your response to our Request for Evidence for your Form I-485" etc.

I'm so scared of getting a denial as they wanted tax returns for the I-864 but my husband has tax exempt payments so we have sent them proof of that and bank statements (just hope they read the letter we sent with it explaining everything)

I've been so stressed and anxious about the lack of updates, feel kind of relieved now. I don't tend to have the best luck and things usually go wrong for me, so I'm sat here expecting the worst.

  18. My USCIS still hasn't updated for us, still showing as received despite receiving the NOA's, completing biometrics and receiving/responding to an RFE.

We sent the e-notification form in with our original documents but we have had no texts or emails either other than the initial receipt ones. It really doesn't help the worry.

    Timeline:

    April 27th - Got married

May 13th - Sent packet to USCIS

May 18th - USCIS received packet

    May 23rd - NOA's issued

June 11th - Biometrics appointment completed

    June 13th - Received RFE for I-864

June 19th - Posted response to RFE

June 22nd - Delivered to USCIS

No further update to the above, just waiting and worrying :(
