I have no personal experience, but a friend of mine traveled to Asia last month with her (American) kids on her AP. She went and came back OK (although she did have to go through secondary inspection which took another 2 hours).

Hi! I am in the East Bay too. I went for the written test in Pittsburg, and did behind-the-wheel in Walnut Creek. I just brought my passport, I-797C receipt and a utility bill that showed my current address. I am only eligible for a temporary one and they need me to send proof of legal presence (like a green card or EAD) in order to receive my full driving license. Alternatively, ask them about AB60 which allows "undocumented" residents to get a d/license.

I was able to get a temporary driving license (but still need to send proof of legal presence to get my full license). I'm in California.

Yes, I am aware that I won't be able to return to the US using my B2 visa since it was automatically canceled with the overstay. I do have my AP card though and my question was if I was able to return to the US (with no issues), given that I overstated my B2 visa.

This post is from 3 years ago, but wondering if you put in a service request online or did you receive an RFE in the end?

I adjusted from a B2 (I overstayed my visa by 6 months before adjusting) through marriage to a USC. My question is would I be able to travel back to my home country for a visit (about 30 days) and return to the US without any issues? I understand that entry is at the discretion of the CBP official, but would the overstay be a cause to deny entry in the first place? Or was the overstay "forgiven" once AOS was filed?

Yes, I'm guessing it wouldn't do any harm. I sent in 2 passport photos for each application (2 for I-485, 2 for I-765 and 2 for I-131). I also did not send in any G-325A form and only used my husband's birth certificate to prove citizenship. Did not receive any RFEs.

We provided lastest tax return +  last 3 years W2 and got through fine.

OP,  if your wife and kid are being deported, do you know where they are being deported to? They can't just put them on the next available plane to...nowhere?

Might be better to meet them somewhere (maybe Philippines, if they have a say on where they are being deported to?) to regroup and plan your next move (getting a US visa for your wife, since your child won't have any problems traveling to the US given that she is a USC)

I tried to apply for a SS# (for tax purposes) when my AOS was pending, but was told that I can only apply for one with an EAD (or a green) card. At that time my I-94 had also already expired.

I am in CA, if that makes any difference.

Is Form G-325A and a passport copy of the US citizen necessary for filing I-485? I don't see them listed on the guidelines, but I may be wrong?

Does anyone know if we have to pay and go through biometrics (for AOS) if you have paid and done it with a previously submitted AOS (which was later rejected)?

It is forgiven for spouses of US citizens, so no problem there. 

Also, what does it mean that it is forgiven for spouses of US citizens? I was under the impression that overstays are forgiven for spouses of US citizens (living in the US) doing the AOS. Does it also apply for US citizens living abroad seeking to do the spouse visa?

The overstay was for last year and was for 5 months so just under 180 days. Do you think that will be an issue and will they require an immigration lawyer to file the waiver?

What are the chances of getting a CR1 spouse visa for someone who has a history of overstaying a B1/B2 tourist visa previously? Overstay is under (but close to) 180 days.

We got married in NorCal (Contra Costa county) and got the wedding certificate immediately after the ceremony, but then again we had a courthouse ceremony.

And yes re#1, my passport was sufficient enough to apply for a marriage certificate.

Apologies if this has been previously answered, but just wanted to make sure before we send in our Form I-485 (together with AP and EAD).

How many photos do I send in with Form I-485? It mentions in the instructions that they require two - do I need to attach this to I-485 or is it attached to the biometrics form G-325A? I understand that I need to send a total of six (2 for I-485, 2 for EAD and 2 for AP). My daughter (7 y/o), who is also AOS with me, won't be needing EAD and the biometrics form. Does this mean she only needs 2 (or 4?) photos?

We are just now submitting our AOS form I-485 (we are doing the two step process and sent the I-130 petition earlier). My question is: can we send in form I-485 without the Medical and Vaccination Record form I-693? And only present it in person during the interview?

Also, does my 7 year old have to complete the I-693?

Not on the marriage certificate, unfortunately It does show both names (before and after marriage) on the license though. That's why I was wondering if I should send both license and certificate to reflect both names. 

Thanks! My marriage certificate has my maiden name on it though (doesn't show that I took my husband's family name). I'm filling all my forms using my married name. Is that going to pose any problems?

We got married in CA and have what is called the (1) license and certificate of marriage and (2) marriage certificate.

(1) shows that I took my husband's surname.  (2) only shows my maiden name. I am filling all AOS forms using my married name.

Should I produce both copies for the I-130 and I-485 forms? Instructions say copy of "marriage certificate" so I am unsure if that means (1) or (2)?
