I recently renewed my Philippine Passport at the embassy.  While waiting, I saw a few people ahead of me encountering problems with renewing their passport and changing name to their married name.  They require a lot more paperwork like ROM, NSO Marriage Certificate from the Philippines, etc. It is definitely easy to just get the passport under her maiden name.  Hope everything works out for you guys.

    Let everything else be in her maiden name except for the N-400 that you will be filling soon.  In the N-400 form, you can legally change her name to her married name.

    We have a lot of evidence that our relationship is true and not fraud. We have registration of our car under both of our names, life insurance where I am the beneficiary, joint tax, leases, Power of Attorney signed in front of a notary, joint savings and checking account, many pictures of us going on vacation. There is no way this could be fraud LOL.

    Hi.  I-751 instructions does not require that the sworn affidavit should come from a US Citizen, so your sister can write the affidavit.  It has to be notarized for it to be considered a "sworn affidavit".  Your sister can get the affidavit notarized at her bank, and it should be free.

    - Copy of receipts/credit care statement for gift to each other (apple watch, necklace, purse, perfume, flower delivery, wallet)

    - Copy of couple wedding invitations from friends addressed to both of us with our current address

    - 40-50 pictures together of past 2 years 

     

    Although we don't use our joint bank account, my husband writes me a check every month for half amount of rent/utility bills. Should i include this proof in replace of joint bank account? or it will look more suspicious?

    I suggest that you only include the joint bank account, and include the statements on the months where there's an activity on it.  Do not bother to show the separate bank accounts as these may just add confusion & suspicion.  Only give what they ask for, which is the joint account bank statement with transaction history.

    We already have a baby- 2 months old -  does it help the case when having babies together ?

    Assemble your application before leaving so you can just send the application as soon as you are back.

    I don't think they will send it back. You might just get an RFE which should be an easy fix.  Please update us.  Hope everything goes well.

  7. Well, here's my two cents about it. I'm a Filipina and I was 23 when my fiancee started the processing the petition. I do not need consent from my parents to get married. I simply informed them of my plans to get married as a sign of respect. If she really love you, she will move mountains to be with you. Maybe she got cold feet. We'll never know. As for her family, it is a shame that they are acting like that. This might not be the words you'd like to hear but it is better to move on. Save yourself from a bigger headache. You deserve better.

  8. I just want to share the opinion of the counselor in the CFO seminar I attended before leaving. The counselor said there was no need to report the marriage as the Philippines does not recognize same-sex marriage. With regards to the name change for the passport, she believes the consular will not honor the marriage certificate to change name so the counselor suggest that it is better to pursue the US citizenship and get the US passport under the new married name. I hope this helps.
