  1. When we filed for 1-129f he was in New York. Before my interview with the embassy he moved to California and we sent in the address change through email. I got my approval and right before my POE we decided to go to New York instead of California. I haven't given my new address to anyone since my POE.

  2. This is for anyone that eloped in the NYC outside of city hall. My fiancé and I currently are not living in the city so we cannot go and find out. The 311 number wasn't much help, she just read what was on the website.

    I read that you can bring your signed licensed marriage to city hall before closing time the day of or on the next business day and get your marriage certificate on the spot instead of waiting after your officiant to send it back for you.

     

    Anybody done this?

    There might be someway around this because it could be as if you had a business back home and you are getting income from that. I am not an accountant so maybe try looking into the IRS Q&A section. Online business are tricky because they don't have a physical place.

    That said, it's not worth the risk (or your time) to spend this much energy looking for loopholes. You knew going into the fiance(e) visa process that you wouldn't have work authorization when you arrived in the US. No matter how long it has taken, you undertook to follow the rules and that's what you'll have to do.

    As somebody who makes a lot of promo material (videos, blog posts etc) I know they are time consuming to produce, and you always feel on the hook to produce new material with more frequency than really seems possible.

    If you're interested in producing videos, why not do all the work of making them - several of them - and don't post them right away -  get a few "in the bank," so to speak. Refine your brand. And when you get your EAD, you'll have a bunch of content that you can start releasing, and be a little bit ahead.

    I have 9k subscribers right now on my channel. Not paid a lot because I don't upload often but I'm paid in Canadian dollars. So I guess I would have to stop those payments?

  6. I've done some reasearch and found that there is a ''gray area'' when it comes to working for a foreign employer during the AOS process before you get the EAD.

    However, I haven't found anything about self employement. Is that allowed or is it still considered illegal under immigration laws? What about starting an online business or a youtube channel?

    Yes I got my diploma here in 2007 so it will be easy to get my reciprocity in NY (where we're moving once I get my EAD) but from what I'm seeing on the website it's way stricter in California. It's not even worth it for me to start getting into it if I'm not staying there...I'll see what happens but thank you!

    Volunteering in the true sense of the word is permitted - whereby you provide a charitable service with no expectation of anything in return. Animal shelters, church and community projects, for example. 

     

    Just a general remark, not necessarily aimed at the OP: we we see this question regularly and I wonder why, with all the information in the guides and on the official government websites that make it clear you cannot work as a K-1 until you have your EAD or green card, people still pursue the K-1 path when work is important to them. 

    Internship, volunteer, whatever they would want to call it. I was just asking because I wouldn't mind helping out at a salon without pay because I love my career that much.

     

    I started my process in Spring 2015 and at the time the K1 was the best option. We 've been through a lot and if we would have known we would have definitely gotten married before the process and etc but unfortunately things happen. Either way everything is already paid and luckily the consulate never cancelled the paperwork even if we had our initial interview a year ago so we're not about to cancel everything now to start over. Every situation is different...

    Thank you I'm only looking into reception work in a salon. I don't want to do any hair since I will be moving a couple of months afterwards across the country.

  10. I should get my K1 visa soon and I'm just getting prepared.

    From my understanding you cannot be employed until you get the EAD but what about if you intern?  I love what I do (I'm a hairdresser) and can't imagine not being in a salon environment for 3+ months. I was thinking of asking a salon in the Bay Area to be a receptionist with no pay just to give me something to do. I will be moving to California at first since my fiancé is there for work and then moving to NY in 2018. I should actually get my EAD by the time we're in NY.

     

    I know it's legal to volunteer but I've read some old posts here that said it isn't in your own field. Is it still true now? Or should I sign a paper with the salon saying it's just until my EAD?

    Yes, once you have your passport back with k1 in it, there is no problem with travelling anywhere other than the US. Obviously if you hit US shores, they are going to activate your k1 and you can't really leave without abandoning all you've worked for.

  13. Hello,

     

    They used to not stamp at all but they started stamping during the holidays. Not sure if that's everyone or if it has anything to do with my visa. I got stamped when I entered by air with USCBP both times I traveled so far but not with CBSA.

  15. If everything goes right I should have my K1 visa in hand around May or June the latest. But i'm not planning on moving officially until August. I wanted to visit one last time in June.

    Would that be possible with the visa in my passport? Should I mention it to the border patrol or wait until he asks me?

     

    If it's better not to try I'll just wait until I move..

    We thought the same thing! I sent multiples emails throughout the year to ensure it was still valid and they said yes to not worry about it each time surprinsingly.

    They asked me today to send in a new medical/police certificate, to update my DS160 (which expires this August) and evidence that we're still getting married. Once I send those in I'll have to go do another interview to get my visa.
