Hi everyone. My wife is filling out the N400 and needs to give evidence that I am a US citizen. I doesn't have a certified copy of my birth certificate on hand, and my current passport expired in February of this year. Does my passport need to be valid, or is sending a picture of my expired passport okay? I am going to renew it either way, but it's going to take a while because of Covid.

Okay thanks. Regardless, there is no way she will be forced to leave the country or lose status due to delays, correct? And I honestly wouldn't be surprised if it took them past the 18 mint extension to complete...

We haven’t filed for citizenship yet but many people in my ROC group did it online and has positive feedback. Apparently you get notification faster and don’t have to worry about “did it get there yet”.
I suggest following the guides for N400 and not skimping in this last part of the immigration process 🙂 I agree much of the entire process is redundant but we’ve never gotten an RFE or had an interview for AOS or ROC part of what I feel was because of our strong evidence submitted, legitimacy of relationship and straightforwardness of the relationship.
She already got an extension letter for the 18 months, but that will expire in about 4 months. It's not our fault that they are behind, but what do we do if it is about to expire? Will they send us another one extending it even further past the 18 months?

My wife is eligible to file for citizenship. She has held her Green Card for more than three years since we've been married. We have already filed for RoC (last year, no RFE's), but it is still processing. They gave her an extension on her green card expiration date for that reason. I have a few questions:
1. We want to go ahead and file the N-400. Is this a good / better idea since the I-751 (RoC) is still pending?
2. Is it better to do it online or mail it?
3. What happens if her expiration extension for her Green Card runs out before they approve the RoC? Does filing the N-400 let her stay here even if her green card "expires"?
4. Do we really need to load the N-400 application with lots of evidence, as seen on the checklist here, or is just the required documents listed on the application enough? At this point, with so much evidence font-loaded in the I-751, it just seems redundant.

My wife came to the states from Spain in October 2015. Until April 2016, we lived with my parents while we were trying to save money. We have no real evidence of bills or anything there, as we didn't pay rent or utilities (my parents were a huge help to us). Overall, we have an underwhelming amount of evidence of us living together. Here is what we do have, and what we don't have. After reading, if you have kindly taken the time, please list what you may think we could possibly use. Again, we can't use what we don't have, sadly.
Do have:
- Jointly filed tax return transcripts from 2015 and 2016
- W2 forms for both us at our address that we moved to in April 2016
- Pay stubs from my wife's job
- Monthly bank transactions with both our names on the account (my mother's name is also on the account, our bank made it easier to do it this way)
- Several scans of checks of rent payment at the new place with both my wife's name and mine on the check with our new address
- Written and signed agreement between my parents, me and my wife stating we would pay back any living expenses for living with them after becoming more financially stable
- Lease agreements for the place we moved to in April 2016, and another for the one we just moved to
- Utility bill for many months with both our names on it (I have others, but they only show my name)
- Scans of blank check with that address and both our names
- Scans of our debit cards
- Scans of our driver's license with our even newer address (we moved around 60 days ago)
- Car insurance that shows me as the policy holder for both cars, but her name listed as one of the drivers on the policy
- Screenshot from Verizon's app showing my wife as part of my family plan
- Itinerary and boarding passes and passport stamps to our trip to Spain last year for Christmas
- Hotel reservation (only my name is on this) for trip to DC earlier this year
- Lots and lots of pictures of us together and with family and friends (which are the "best" ones to include?)
- We can easily get affidavits, but from who? Are relatives allowed? Also, the example I found on the site for the affidavit seemed to be in super legal jargon and didn't seem "heartfelt" at all. Is there another way to write this?
Don't have:
- Health insurance together. I am on ACA and she doesn't have health insurance (this is more a personal choice than any complication that arose)
- Joint car titles (both are in my name, we worried this may raise our insurance cost here in NC to put two names)
- Joint credit cards
- Many other things I can't think of right now.
Honestly, I'm not super worried (very odd of me given how meticulous I was with our other petitions) I front loaded our I-485 like crazy, and we actually got the interview waived. She directly got her green card before she even received her Employment Authorization or Advance Parole, which was wonderful. I'm not sure if this will really help us at all though, as a different officer will be looking at this one.
Any tips on how to milk the evidence we do have would be great. I'm sorry for the long post, and any help would be greatly appreciated.

Okay. So basically, once she gets her passport here, she can stay out of the country indefinitely in theory? I'm not trying to abuse the system, just want freedom of travel without repercussions after all we've gone through haha. Also, I've read that she can have dual citizenship but I never could *technically* as Spain says I must renounce my US citizenship to become a Spanish citizen, but people say they have done it without problems... It's all confusing haha.

Hi, I have two questions, and I'm not sure if they belong in this board or not. This is for a couple years from now, but I would just like some clarification if possible.
1. After my wife from Spain receives US citizenship (she can file in 2019) and gets her US passport, can she travel and stay outside of the US for as long as she wants (aka to Spain for more than one year, which is not really allowed with her Green Card) and not risk affecting her status here when she returns? The reason for this is explained in question number two.
2. We might eventually both want to move to Spain and live for more than a few years. This is why I would like to know if she would have any troubles traveling outside the US for more than a year once she has her US passport and nationality. Also, being married to her (as she would still be a Spanish citizen) what would I have to do in the future to stay in Spain? Would it be any easier for me to get permanent residency there, being married to a EU citizen? Or would I still have to get a work visa or something of the sort?

My question as well is why you went the K1 route? Your current plans contradict the purpose of receiving a K1. What were your plans before filing for the K1?

No AOS interview or EAD or AP, just received the 2 year green card. Is this the same as the 10 year green card with the only difference being removing conditions within 90 days if it's expiration? Am I considered a conditional permanent resident (the green card puts permanent resident)?
AKA can I work, travel (up to a certain amount of months, etc.) without the EAD and AP? Basically I'm asking if this entitles me to everything a 10 year would have except that I have to remove conditions?

We were approved on the same day, and no interview here either. On March 2,status changed to *Card was mailed. Just waiting for it now. Hope all is well!

Thanks =). I am near Charlotte but I have no idea if it were routed through there or not. I feel really lucky right now. I have an app that notifies me if the status on the uscis site changes, and I got notified. I didn't believe it at first so I went to their website and sure enough, it was approved. They just changed it again, slightly. They changed the approval date from the 26th to the 29th (makes sense)

What are the next steps? How long to get the green card after this? Will she even need her EAD and AP? Until she gets her green what can she do to show she has permanent residency?

My wife and I sent the AOS package with petition for EAD and Advance Parole, and tracking number says it was delivered on Dec 18 No response yet, and what worries me is that the check hasn't even been cashed yet. Is this normal, especially with the holidays?

Okay, thanks! What we did for the K1 joint-sponsor, she just sent in the last 3 tax returns (not transcripts) with W2s, letter from employer stating her hire date and current salary and position (which is sufficient) and it was accepted. I'm assuming that everything should be fine if we do it the same way.

So I would put 2 for mine and my mother would put 3? She is married. Also, I didn't file in 2013 and in 2012 because I was studying. Is explaining that sufficient? Thanks again.

Hey everyone!
So, after finally finishing the K1 process and getting married, we're ready to file the AOS and other documents. Straight to the point.
My mother is going to be our joint sponsor. I currently have no income.
1. With my mother being a joint sponsor, what is considered valid evidence of her being a US national that we have to include in the packet?
2. On part 5, how will I fill it out? I am sponsoring 1 person, 1 for NOT sponsoring my self, BUT what about 5.3? The person I am sponsoring IS my spouse, so I have no idea. Also, how would my mother fill this part out.
3. I only have one tax return and W2 to send in (2014) (my mother is doing the last three). How would I fill out 18.a and all of 19? 18.a asks if I have filed for all of the last three tax years, which I haven't, but it seems weird to put no. And 19 asks for info for the last three. For the second and third, would I just put n/a?

The thing here is that we have only ONE document showing what vaccines she has, and it is in Catalan (not Spanish)
I'm not sure how to use this document to show a CS which vaccines she needs. It's mostly the same as in English, but I don't know. Pretty upset that in Spain a DS-3025 wasn't filled out just so we could have it on record...seems pretty stupid to me.

Why would you have gotten an RFE for proof of relationship? Had you already done your interview? I was under the impression that NO evidence for the was required to go along with the AOS packet.
Also, I just confirmed with the US Embassy in Spain that they do NOT include DS-3025 forms. It would have been nice...now we get to do this vaccine stuff.
Are you sure we only need the vaccines and not a full medical?

I think I only sent my passport pics during the process when it wasn't expired. It's been a long long time though so I can't remember haha.
