    If you  fail to do this your parents run the risk of being denied entry, or down the road having their LPR status revoked. 
     

    Given the language barrier issue it appears to me that you will be traveling with them to the USA.  
     

     

    I am in the military so I think it won't be an issue, my address overseas is still US. Thank you.

    IR5 entry is very easy. Dont even think that we were asked any questions .. they should hand over the new address for their GC mailing  written down for ease and to avoid confusion

  3. Hi! My parents got their visa and they have to leave the Philippines before November. I am currently overseas because of work and won't be back in the states until next year. On their application and during interview, we told the embassy that they will be staying in GA. With our family situation, it might be best for them to stay with my aunt in California. Will it be an issue if point of entry is different? Anyone here can lay out the process once they arrive in the airport as far as immigration is concerned? They can barely speak English so I would like to give them a rough rundown of what's gonna happen before they leave the airport upon arrival in the US. Thank you!

    Hi @HRQX! Yeah! I put my sister's name on it but I didn't say that they will come here too during the time I filled it out

    When I petitioned my parents, I can only support 2 more dependents. Now that I am married, me and my spouse can now afford to add my sister. My parents' IR5 has just been approved (no interview date yet). but when I filled out the papers (initially), I did not include my sister due to my income. Should I just wait for my parents to petition her when they get here? Or there is still a chance she can go with them?  She is 13. What does the process look like?

  7. Hi! I already submitted all the paperwork for my parents. Per the email, they said that they will get a letter as to when will they have their interview? My mom also did not receive the first welcome letter notifying her that hers was approved and my dad received his. Is that letter as significant as the letter that contains the interview date? How can we request for the first letter my mom did not get? Thank you. 

  8. You are going to need the 2014 tax return for someone that is self-employed. They will base whether or not they meet the requirement by looking at line 22 of the 1040. You need them to file now so you can provide the most recent complete return, or find another joint sponsor. They are not going to accept them without having the most recent return filed yet. Self-employed prove their personal income through tax returns.

  9. hi! I'd like to ask for your help. I'm done with biometrics last week for EAD and i485. Arrived here in US using k1 visa, got married and filed AOS papers last March. Received RFE on Saturday. My brother in law is our co-sponsor, he filed his tax jointly with his wife because they own a business (Self employed) . In our AOS packet, we included his tax returns for years 2011,2012 and 2013. We were't able to include 2014 because they requested for tax filing extension for their business so we weren't able to include it at that time. On the income line, we put their income listed at line 31 from the Schedule C, which is 6 figures. Household size is 3 (my bro-in-law,sis-in-law and me)

    1) Should we use line 22, total income, of the 1040 instead?

    2)We also didn't include i864a but they didn't require that on the RFE.

    3) Will they delay sending my work permit because we received an rfe for i485? (we filed EAD/AP and i485 altogether)

    4) Should we send the whole thing (i485,i864s) or only what they are asking for?

    5) Anybody in hawaii who resorted in consulting agencies who can be of help? (last option)

  11. I’m currently processing my ces-cgfns for hawaii.. I’m in u.s so i’ll just ask my friend to process it for me. Question: how much did you pay sa prc for them to mail the docu sa cgfns? Anything else that my friend should bring? i applied using my married name, should i also give them (prc) a copy of my marriage license coz my license has not been updated to my married name yet? Do i need to send her anything like certified true copy of my license (active), certification of passing, board rating etc? or she should just bring the form downloaded at cgfns site?

    is there anything else that i need to request from my school like tor?

  12. For self-employed you would use the total income, line 22 of your 1040 tax return, as your income.

    Im confused if we should use line 22 of 1040 as income (for self employed) or line 37 of adjusted gross income or line 7, part 1, schedule c of form 1040?

    coz our co-sponsor is self employed and he filed his income tax jointly with his wife. should we also include i864a?

  13. 1. An estimation of annual income but without proofs (employer salary statements, W2s, pay stubs...) will cause RFE. He needs to gather recent pay stubs, employer's letter stating his current income to include with his I-864. I-864 is kind of routine paperwork, once you receive your greencard, they hardly bring this matter on again.

    2. If your bro-in-laws has all of his 1040 or 1099, pay stubs in his name, and it is enough of 125% poverty guideline, you don't have to separate his income from household total income. Include those documents with his I-864.

    3. You might have RFE for your brother-in-law in come, because self-employed income is flexible. Tax time is coming, so you should look into 2014 tax already.

    3) have no idea with tax filing here in the U.S. When is the deadline of the filing? what is the turnaround time of getting that paperwork?

  14. 1) He needs to figure his current annual income and list that. Is his current job also self-employment? If not, his hourly rate times hours worked per week and then multiplied by 52. Provide letter from employer and/or recent pay stubs to prove that amount.

    If he was legally required to file taxes for the money earned in 2014(or any other previous years he did not), then he needs to file first. If he was not legally required to file, then he needs to provide a statement as to why he was not legally required to file for any of the last 3 years he did not.

    2) Since it is not the filing deadline yet, you might be able to get by without 2014, but because he is self-employed they may want the 2014 taxes. Self-employed use line 22 of their most recent 1040 as their income amount and tax returns as proof of income.

    He should provide a complete copy of his most return with all forms, attachments, schedules, and 1099s. That should show his individual income amount. His wife can also provide an I-864A to go along with his I-864.

    He will also need proof of being a USC or LPR.

    3) You can get an RFE for anything. The most common RFEs are those for the I-864. People not proving all required documentation or enough proof of income, mistakes on filling out the forms, etc.

    1) Apart from his hourly pay rate on his regular job, we can also include pay stubs from his part time job right? and just add it altogether to compute for his annual.. as long as we have documents to prove it right?

    2)We are planning to submit the i864 maybe next week, i guess we just take the risk and just send it if they need it. We have their 1040s but they filed jointly.. so i don't know how to figure out how much they earned separately. yet to ask them if they have 1099s

  15. me and my husband is currently working on i864 paper for my adjustment of status from a k1 visa. Met my husband in Philippines where he stayed for 2 years and went back here in U.S on August of last year. That being said, he wasn't able to file income tax. He started working as self employed since August last year (He worked for his brother's company) and was recently hired January 2015 for another job. We are currently living in the same household with his brother (who hired him last year) and He is willing to be our co-sponsor. Question:

    1) We should file 2 separate i864s right? For my husband's i864, current annual income is just an estimate of his income for this year? We only have pay stubs from his current job and a general excise tax certificate. Since we have no proof of his income in the last 2 years, will there be a problem in the future (citizenship) if he wasn't able to meet the estimated amount of income he declared in i864? Any possible implications?

    2) my brother in law is also self employed and what we have are forms 1040 for year 2011,2012 and 2013. Will that be sufficient? Do we need 1040 for 2014? he filed his tax with his wife (married filing jointly). How can we estimate his annual income that is separate from his wife? or should we just include both of their income and just ask for i864a from his wife since they filed their tax together?

    3) What are possible RFEs we might get? We don't want to receive any RFEs so i hope anyone who might have the same experience can enlighten us.
