  1. I don't have any joint sponsor and was hoping that I don't have to use any with my income more than sufficient to satisfy their income requirement. Do you think I should do joint sponsor?

I-130 doesn't require any tax information. I am talking about submitting I-864 (affidavit of support) to NVC.

No I understand what you're saying. I'm just confused because I myself did the I-130. I had to submit my tax info with my I-864 Affidavit of Support when I sent my petition to USCIS. That's why I said the same tax info you sent them you suppose to send to NVC. The affidavit of support goes along with the petition that's how they learn if you can sponsor your spouse on your own without a co-sponsor or not. If you make enough money to sponsor your wife on your own you don't need a joint sponsor or Co-sponsor.
  2. I never sent I-864 to USCIS as it's not a requirement and hence never submitted tax returns or transcripts to USCIS. My query is related to Part 5 in I-864 EZ.

I never sent I-864 to USCIS as it's not a requirement and hence never submitted tax returns or transcripts to USCIS. My query is related to Part 5 in I-864 EZ.

I'm lost and confused on how you didn't have to submit any tax info at all.

  3. Can someone help me with I-864 query? I-864 asks for last 3 years of tax returns, but I only have last 2 years of tax return and my current income is more than sufficient to sponsor my wife. The reason for not having 3rd year's tax return is that I didn't earn any income and my parents claimed me as a dependent. So is this going to be an issue? do I need to submit any additional documents? And for the questions where it asked if I filed tax return for 3 years, should I put yes or no?

Everything you sent the first time when you filed is the same thing you send to NVC. Do not change anything up. If you sent 2013,2014 to USCIS then send the EXACT thing to NVC plus 2015.

  4. Hi all,

My husband is currently living in India. Our I-130 petition was received by the USCIS on May 9th and we are still waiting on NVC 2.

We are planning to celebrate our anniversary in Feb together. So my husband would have to apply for a tourist visa to visit me here in States while we are still waiting for our case approval. Do you think it's possible for him to obtain a tourist visa while our I-130 is still in process?

No I don't think he'll be able to. But I wouldn't even try to if I was him. Because he may have his regular visa by then. Oct will be yall 5 mos then on to NVC. So If everything goes well and smooth. He maybe here by yall anniversary.

  5. Yes, some February filers have had their interviews already, or have dates already. I hope to get my interview appointment at the end of this month or the beginning of the next (interview will likely be in November).

Don't forget that the DCF filers here show Texas service centre in their timelines because they have no service centre so the system automatically shows Texas service centre.

I'm a Dec filer and I'm still waiting to receive my interview date. Hopefully we'll get a Oct date.

  6. What a relief for you all! Congratulations! Hopefully we will be right behind you soon. My husband's medical is on the 8th and his interview on the 22nd. We must be the last ones from this group lol. It has been a LONG journey, for sure. Congrats again!

No Blanche sorry to say you're not lol. There's a few of us still hanging around waiting to have a interview. My husband still has his medical and interview left to do. But almost to the end just waiting on Jamaica to give us his interview date.

  7. I understand that. But she is planning to come to India as soon as this end of month and we will be submitting the packages from here then. So the case right now is about to reach NVC and will take 4-6 weeks as stated by them in the call. So there are two possiblities for her that either the company will give her leave for the time she asks for or she will get work from home and the salary will continue. So in that case we can mention the income as current and if she is on leave then can we state her income and the employer as well ?

It's not going to take 4 to 6 weeks for NVC to receive your paperwork. But how fast they get the packets from yall is up to y'all. Now after they get your packets it will take 4 to 6 weeks for your case to become complete. So after you send in the packets everything after that want matter if she does a leave or wrk from home. My co-sponsor changed jobs right after I sent my packets in to NVC. It doesn't affect our process at all because the employment letters went along with the I-864 for 2015. The only way it would matter is if we had a report tax info next yr for 2016 which isn't over yet.

  8. Yeah i get your point. We are not going to change anything. We will file I-864 for her too . I just wanted to know if we need to mention her income there as she gets leave from the job or she get work from home.

I just looked at your timeline and you're through with the hard part. Everything you sent USCIS for the AOS sent it to NVC (THE EXACT SAME WAY). The only thing extra you are going to need to send is Employment Letters for everyone that did the Affidavits. If your wife is still working now then she should get a employment letter from her employer right now stating is she still works there. Also, the letter should say how much her annual gross is at the moment. Cause the letter goes along with the I-864 she will submit. Cause if she's coming to India after the papers are sent there's no reason to put her income as "0". But if she's going to still be working for the company but from home base. Then I think she'll be fine on that end cause they are looking at right now vs a few month from now.

  9. Yeah she does have her job. She will be applying for a leave for the time she comes here or she will be getting work from home basis from her company while she travels to my home country.

If she has a job now and she is the one petitioning for you shw needs to do a I-864. This visa stuff is tricky believe me and they want the I-864 from 2015 for her and the parents plus the dependents. Plz don't change up anything on your visa when it comes to your support part because it might delay your process.

  10. Yeah, I guess we already have everything except for my police clearances. Will be working on it this week. I just hope the embassy will grant me a letter that I could present to apply for a police clearance here in Kuwait using the NOA2.

If you don't mind me asking but. Are you from Kuwait are some where else. Cause the reason I ask is because you should be able to just get one from the local police department in the town your in if your the applicant. The petitioners don't have to send in a PR. Im just enquiring so I can help your process to be a lil easier.
  11. Sucks big time when you can see that other people get a confirmation that their cases were received 2 weeks from approval.

Been calling the NVC twice a week. :(

Hey guys I'm already in the NVC process so I truly understand y'all frustration about no response from NVC yet. But the best information I can give yall is to go ahead and get your stuff together that your going to have to send them (Birth certificates, I-864's, employment letters, marriage certificate, PR, etc....). Cause once you get the email with the case number and invoice number you can pay the fee's online. Once you pay it online you can call them immediately and they will document that you paid them. Then you will get several emails back to back with instructions. But you will at least be on top on the process and can start sending your paperwork in the NVC via Email, fax, or regular mail depending on the country. I hope this comment will help yall feel a lil bit and more in control of your case. Gud luck

  12. To be honest these day I'm feeling a bit down and out that my petition hasn't been approved yet or even having a transfer. It is a bit hard when I find others who's dates are past mine and are being approved. My PD is April 7. But I keep telling myself this process is long anyways, not point in crying over something I can not control. Next week if I do not get any sort of notification, I am planning on calling them and seeing if I can get any information on my petition other than the generic answer I have so far, "Case Received".

Hope the best for you, and hope that you get a quick approval.

To be honest as well you are still in the 5 month mark. So just give it a few more days then call If you don't here anything by the 7the of September. After that date you can call them back and do a enquiry on your case. Bless of luck

  13. Oh that's good to know. The other reason, I was worried about is because of if NVC doesn't receive the file than I thought I would need the approval letter. Anyways if that's the case than I would sit tight and see if I receive in 30 days if not than I will ask them to send it again and hopefully by that time Nebraska send my case to NVC and the next process can being soon.

Thank you again now I am much relaxed.

You got approved on the 11th of this month. NVC should have already received your case. If you have the USCIS app it will tell you if they have or not. The NOA2 will take a second to come in the mail.

  14. As I said before, it took us an additional 34 days after they received the checklist items. And even though the case was complete in July, there were people whose case was complete in June still waiting for an interview appt. so we didn't make the September round. Hoping for October as well. Not really sure how all that works. Think they will start scheduling again the last week in Aug. Maybe one of the more experienced persons on here can offer advice. Best of luck to you!

No I know that it will take 30days for them to redo our case. This wasn't posted as a question. I already know how long its going to take us in this process. We're just hoping for his interview to be around my bday in Oct so he can come home. But thank you for the insiteful comment anyway.

  15. When did you receive your checklist? When is your priority date? What visa category is it?

We received our chklst on the 28th of July. Which was a day after our initial 30days of them having our I-864 packet. My priority date for USCIS is Dec 11, 2015. We got approved on May 9th and NVC got our paperwork on the 12th of May. We sent off our I-864 in the June 21St and they received it on june 27th.
