  1. You will most definitely receive a RFE.

    The I-485 requires 2 passport style photos. The I-765 requires 2 passport style photos. The I-131 requires 2 passport style photos. They are filed together but the applications are processed separately, so you should have provided the required 2 for each, a total of 6.

    We did provide passport photo, what I meant was i didn't send any photos for as proof of marriage. But i sent our marriage certificate and medical report of my pregnancy so I hope I won't get RFE.

  2. I was wondering the same thing. I think if the two of the talked about the different steps, read the instructions together, their perspective would help them through these questions that are being asked.

    We talked about this and agreed to follow what's on the USCIS instruction but i also get reply that we don't need to put 00/100 as it don't matter. So i thought i asked you guys as you were helping so many VJ members in decades.

  3. Why do you need to put a reason on the CHECK ? Just make sure to spell out the payee.

    I went to USCIS website for check

    And it says on number 5 to Write a brief description of the purpose of your payment. In this example, it is "N-400 application fee." Plus pur check has option for that too.

    Just before you sign the check there's option line where you have to indicate the reason for check so i though I'd ask you guys.

  4. I'm saying this to you very gingerly.... your worrying way too much. Your making something that is simple to complex. He has nothing that can prove that he was in school like, school ID, school transcripts? Semester grades. They don't have to be official official as I don't think they will even care. I really think you will have no problems because you meet the parameters for the poverty levels for 2014. The worse thing that can happen is that you get an RFE and you need to submit additional documents BUT I don't think that will happen.

    Relax, finish your packet and send it in. Let's get this done!

  5. If I'm on your case, I will give a photocopy of his ID as well and written explanation that he is a full time student that time. :) Did he have any other evidence? To me, I think what's more important is the 2014 income tax. You can also give a copy of his 2011 income tax but it's optional. Add his W2s and recent paystubs as well when submitting your AOS.

    This is what I'm thinking too. Everything is ready we just need more info about this.

    Also when filling up AOS, EAD and AP should i put my Married Name on 3 Forms or just for AOS Form only? And the rest 2 form will be my maiden name? I just wanna make sure I'm doing it right. If you choose the Filipino naming pattern, First, Maiden and Husbands Last then from this point forward that is what your going to use. If you use a different naming pattern then you will need to carry extra documentation to prove who you are to match whatever document your using.     And with Tax I-864 Affidavit of support I know I asked this already but i'm still confused

    My husband didn't file Tax for year 2013 as he was student and I understand i need to list his 3 Most recent Tax and put $0 for 2013 however as per I-864 instruction it says to provide explanation and evidence as to why he didn't file it. We were thinking to submit school transcript as evidence but We can't get his school transcript as he has balance from his previous school. So my question is do we still need to provide evidence and written explanation as to why he didn't file tax? Has anyone here has the same situation as me? If your husband makes more than the 125% of the poverty level you only need to show 2014 earnings for his income level evidenced by his 2014 Income tax.

    HOWEVER, if you read the form instructions carefully, it states that while they do NOT require additional financial information IF you have at least 125% of the poverty level, it says the USCIS can still ask for that information if they want. So in order to potentially avoid future questions, many people include financial information, including bank letter, letter from stockbroker, letter regarding mortgages, copy of deeds to a property, and any other financial assets... etc. It is far better to include too much information rather than not enough. If you choose to enter an amount for 2013 and 2012 you will be fine but attached your documentation.. For "no income" for 2013 attach a letter of explanation.

    We have the written explanation ready, but Do we really need to submit evidence that he went to school fulltime? We can't get his school transcript as he has balance. So This is what I'm worrying about.

    Okay sure no problem. :) Based from what I read, yes it is true we need to list down our husband's 3 most recent tax year ( 2012- 2014 ). I know we had to declare it as per instruction on USCIS but they would definitely want to see the recent one which is more important. (2014). My husband actually had low income on the year 2012 so what we did is we provided a written explanation stating why he had low income because he is finishing too his last semester that time but we also attached his transcript. They received it and there's no problem with that as long as we have explanation for sure.

    Hope my explanation and experience helps. :) I think any evidence and written explanation will do. :)

    We were thinking of Sending his transcript too but we can't get it unless he pay his balance. He has ID but it doesn't have the year. So i don't know what else show as evidence.

    Yes, I used my married name for the AOS (Form I-485), EAD and AP application :)

    Oh ok. Then I have to update my forms then because Only put my married name on my AOS and Maiden name on EAD and AP.

    Also i don't know if you can answer this but i posted this question here already but let me ask you,

    With I-864 I understand I need to list down my husband 3 most recent Tax year, however my husband didn't file tax for 2013 as he was a full time student someone told me to just put $0 but the instruction says to provide written explanation and evidence as to why he didn't file tax, we called his school to obtain copy of his transcript and we couldn't get copy as he has balance so do we still need to provide written explanation and evidence?     These are my answers to your questions;

    1. A marriage license is a piece of paper that authorizes you to get married and a marriage certificate is a document that proves you are married. Like here in Arizona, before we got married, we went first at the Superior court and get our marriage license. This license is good for 12 months. During our marriage ceremony, the marriage certificate was signed by the judge (or a priest if it's in the Catholic Church) . We went there after a week to get a certified copy.

    2. K1s were advised to report our marriage within 90 days. - this is part of K1 visa. We need to get married within 90 days as per rule of USCIS but this is reported or included in all the AOS forms that will be sent at Chicago lockbox. You don't report it online.

    3. I reported my married name by using it in all my forms on AOS, EAD and AP. Since you will send a copy of your marriage certificate/license, that is proof for your name change.

    So with your AOS, EAD and AP you used your Married Name? Or just with the AOS (Form I-485)?

  11. if he filled taces for 2012, you put the amount shown in 1040 for that year, if he didn't file for 2012, put $0; also, for 2013, put the amount showed of the 1040 form, if not filed, put $0; in the end, for 2014, if he is above, like you said, put the amount shown on 1040 for 2014. You are only required to attach proof of income for most recent year, like 1040 form, 1099, w2s, bank statements, etc, depending of the situation.

    For the first box it says list the MOST RECENT TAX

    Second box says 2nd MOST RECENT TAX

    Third Box says 3rd MOST RECENT TAX

    So you're saying leave the 2nd box and 3rd box if we meet 125% poverty guidelines?

    Sorry if I keep repeating myself i just wanna make sure I got it correctly.

    Yeah he is Above the poverty guidelines

    We're only 2 in the household and as per poverty guidelines it's $19,912 for 2 people and his above this.

    There's three boxes on the form I-864 should I just list down tax details for 2014 and leave the other 2 boxes blank? No need to put details for 2012 and 2013?

  15. Well, if you filed for 2012, put the amount from the 1040 form, in 2013, if his income was not reported, put $0 (if he didnt have income), and 2014, put what it was from the 1040.

    It's mandatory to send copies of 1040 only for last year, 2014; the others are optional.

    So for 2013 i have to put $0? Will i not be questioned for doing that? He went to school fulltime back in 2013 that's why he didn't file TAX but i'm afraid if I put $0 and explain he was student back then i'm afraid to receive RFE and proof of his transcript as he doesn't have it.

    I just want to ask, on I-864 as I'm confuse on Part 6 question 13A it says MY TOTAL INCOME AS REPORTED ON MY FEDERAL TAX FOR THE MOST RECENT 3 years was...

    and down below it says Tax year and tax income

    So does this mean that my husband needs to list his income from year 2012-2014? And do we also need to submit all Tax copy from 2012-2014 or just the latest one which is the 2014?

    My husband didn't file tax for 2013 i hope we don't need to submit his previous Taxes.
