  1. Thanks for all the responses. I seem to discover a new thing to stress about every month! I will order all details of the potential record and simply explain that I did not believe anything was even on it. I have heard people have been denied because of misinterpretation, however it doesn't say what crime they committed and I am sure it was something abit more serious than mine that someone wouldn't simply forget. I also believe that if I was to AOS that this would be more of an issue. So this definitely isn't an option for me anymore, of course we considered it like everyone else and so lucky that we didn't do it now!

  2. You still need the regular police certificate. Order it. That is quick. Subject access takes a little longer. If you are worried that a caution will keep you from getting the visa, it won't. I thought your concern was misrepresentation on the J1 which I said I don't think will be the focus of your visa interview. Lots and lots of UK people have had "no live trace" police reports because of incidents, some even CIMT and drug/alcohol related. The US does want you to declare them on your DS-260 and London will ask for a Subject Access Report detailing any record if one exists.

    Speaking of London, your timeline says your consulate is Armenia. Might want to fix that.

    You are correct, my concern is about potentially being claimed of misinterpretation on both J1 and VWP if my police record does not come back clear.

We were arrested, but i am not sure.. it was almost 10 years ago, our parents just came to the police station to pick us up, no charges or court or anything, we were banned from the store for a year i think. I just found this 'caution for theft would be deemed exceptionable under the petty offence ruling, where only one crime has been committed and the maximum penalty does not exceed 1 years' imprisonment or a sentence of six months' confinement.' So hope it can be applied to my case.

  4. I have never seen anyone approved with a serious criminal history, do you have links for these people with so called serious criminal histories who were approved? However, I have seen people with misdemeanors while they were minors approved.

    I can't think of the other names. I have been reading UK forum for seven years and can't remember every user name. I did an advanced search on "traffic+cone" because I knew that was in many posts. I couldn't think of Chris's user name at first. You can do an advanced search with him as author, no key words, if you want to find other discussion by him.

    My personal advice to Chris was don't go in waving a flag saying "I misused VWP". Go in and interview for a visa. Don't bring up topics you are not asked about by the interviewing officer.

    Thank you so much, you have calmed me down a little. I just applied for the subject access report. Hopefully it won't take too long!

  6. A UK police certificate says "no trace" if there is no record. If it says "no live trace", the record is hidden but exists.

    Others here on VJ in the UK forum have had the same worry as you. Nobody went back into their VWP record questioning their answers on ESTA. The interview was about the current visa qualification and not an inquest into previous use of VWP.

    Please could you send me some of these threads of possible? I cannot find any!

  7. also, when i travelled on the vwp i hadn't actually applied and the security did it for me at the order in one minute, didn't ask me anything apart from my address. i just noticed on the esta application, it states

    2) Have you ever been arrested or convicted for a crime that resulted in serious damage to property, or serious harm to another person or government authority? *

    Yes No

    3) Have you ever violated any law related to possessing, using, or distributing illegal drugs? *

    so i would of put no anyway...

So, when i was 14 a group of friends i was with shoplifted make up in a store, and we all got taken back to the police station and arrested for 'group theft' despite not stealing anything i was with the wrong people at the wrong time. Anyway i have never thought much about it as it happened when i was a child and it was so...minor

    Now... i have been on a j1 visa for 1 year and also on VWP a few times. i can't remember exactly, but most likely i didn't say i had a criminal record on the j1 visa. surely they do background checks so i would of got denied if it was on there? I am bit confused...

    i haven't actually applied for a police cert yet, so i am not 100% it is even on there, but reading over posts i believe it is.

    Now, will the 'crime' won't be an issue itself as i was a minor and my only time being in trouble, but now that i may have lied i am bit worried...

    please any advice would be appreciated!

  9. i have the same problem....told them, they said they will fix it, they haven't...... still waiting

    I feel like it's been over a month now.. we called and got told that it is a glitch and will be fixed within a month :( what does yours say? mine is;

  10. Oh, it was "how long are you staying?"

    To be fair, they were expecting 1700 people in the queues about 10 minutes after she was there. She said they looked like they were just trying to get people through as quickly as possible to handle the tidal wave coming in. So a little luck was on our side this time.

  11. Hi guys. I want to share my experience. I hope it helps somebody.

    I flew to the US in December 2014 on a tourist visa to visit my husband for Christmas and New Year while waiting for our I-130 to be approved. I had prepared for my trip (letter from my employer with the statement that I was a current employee and was on vacation in that period, my property certificate, my car title documents+translations).

    I worried a lot not just because we started the immigration process but also because I had to renew my passport before my trip as I took my husband's last name and my old passport was going to expire in December. So, my tourist visa was issued on my maiden name and it was in the expired passport. As I found an info on the US Embassy site in that case you need to have with you both passports (old and new) and your marriage certificate (in case of your last name change). But Delta Airlines representative who was checking me in to the flight from Germany to the US didn't want to do that because my visa was issued on my maiden name. I was lucky to get an assistance of another Delta airlines security officer. He found the US Embassy representative right at the airport, who checked my documents and in 2 seconds said "OK". I didn't know that in big airports like Frankfurt they have Embassy representatives who can resolve problems like mine.

    I was very nervious during my 9 hours trip to the US. But once I was at the Point of entry in Chicago the CBP officer asked me:

    1) What is your purpose of visit? I said I was visiting my husband.

    2) Where does your husband live? I said in the US

    3) Where do you live? I said in Russia. Then he just noticed "Oh, it must be hard to have a long distance relationship". I answered "Yes, it is. We are travelling back and forth to see each other".

    4) How long will you stay in the US? I said "Untill January 31".

    I noticed I could show him my marriage certificate cause my current last name didn't match my visa info? He just waved (meaning he didn't need it) and told me "Welcome to the US"

    That was it!

    wow, that has put my mind at ease! hopefully my trip is as easy and welcoming as yours in 2 weeks!! enjoy the time with your husband :)

  12. Hi everyone,

    I've been to this site so many times since I started my journey and it has been invaluable and I once again thank everyone for their support.

    To make a very long story short,,,after a lengthy and sometimes painful 15 months spent to get my fiance here, i was shocked and saddened to hear her confess that she was unfaithful and fell in love with another man in the Phils. I'll spare you the gory details but suffice to say there was a great deal of lies and deceit involved. What made it even sadder is we had finally crossed the finish line. She had finally received her visa and just needed CFO sticker and get on the plane. I caught wind of the affair about a month before her last trip to manila to get the visa. I could tell she had lost interest and the love was gone, she was just going through the motions..,maybe in case it didn't work out with her new bf, I'm not sure. So...a year and half of total devotion of my life to this relationship and bringing her here all down the drain, just like that. Not to mention a few hard earned dollars burned as well.

    Before I ask my next questions...a word of advice to potential suitors of a foreigner: I stumbled into a skype conversation between my fiance and another visa applicant she met at the embassy one day. This woman went on to coach my fiance on the fact that even if she had her boyfriend there, she should still come to the states, and once she got here and got her green card, she could leave me and bring her bf here. She even went on to tell her she could chat with him while I was at work. Just tell him to be patient and wait for her. Nice huh? I feel really bad for the poor guy that petitioned the visa for that monster...SO, JUST BE CAREFUL.

    OK..enough of that, My heart is strong and I'm moving on, searching for true love. My question today is, I've met someone I am very interested in, from the same vicinity as my x-fiance. If things go well and after some time we get serious enough, what are my chances of petitioning for another k-1 visa. It would be my third, My x-wife (married for 7 years), my x-fiance (never used the visa), and my new love. I hate to get too involved if there is no chance. Also, would it maybe be easier to marry in the Philippines..then bring her here eventually? I also thought if I should maybe contact the embassy and explained what happened to this last one, to avoid maybe having to explain it in the future if the need arises.

    Damn... I am sorry to hear this. At least you found out now rather than marrying her and finding out later though, right?

  13. Does anyone know my chances of visiting for one month, under vwp whilst i130 pending since january. no huge ties apart from a return flight and letter of my graduation for college. Fairly confident but if it is a must i can find a job quickly to prove i have one to go home too.. :l
