Just include a copy of the i130 NOA2 at the front and you'll be good
-
Good luck and let us know your decision!
-
Uh oh.. we got the RFE, still haven't received the paper yet but got the notification a week ago. How long does it normally take to receive? I came back to this thread because most likely it is because of my husbands income but we have nothing more to send apart from another pay slip or 2 I guess we should prepare the joint sponsor to be safe
-
My advice...RELAX It is not a disease that makes you inadmissible, be glad you found out and can now work on being healthy in the future with your husband!
-
We had the exact same problem! We mailed them the error with a copy of the birth certificate a week after realising.. didn't work, then called them 3 times in about 4 months and it still didn't change. Finally I decided to just do a online request and it got changed a week later! Don't know why i didn't do that first! Didn't slow down the process at all
-
Can you tell us what the RFE letter said, and what you sent please?
-
thank you so much! We included the joint sponsor just in case, but didn't expect an RFE given that's like our backup option.. Oh well, I think we will just send in the employment letter and pay stubs for now and see what happens. Good luck to you and please update us when your case is back in the process again!
Yah, I guess all we have is the employment letter and the 2 paystubs really...
No he was not making any money at all in the previous years. I remember one summer he did something but that was for 1k so well under the 12k a year line...
I will do! I think when they see the petitioner makes enough, they won't even look at the joint sponsors as they are unnecessary. Good luck

We have the excact same situation, haven'r received rfe or anything yet since we just sent it a week ago.
We had a consultation with a lawyer, and had a joint sponsor ready but he was reluctant to add it since my husband makes well over the poverty line, but has been a student the last three years so taxes say no income. He got us to include an employment letter with salary, and 2 pay stubs which is all we had at the time. The letter had to be officially signed, and included hours, date of employment and salary. he said it should be enough! Hope this helps
-
my husband has only been working one month when we sent ours, we included recent pay stub and a letter from employer, we included tax transcripts but he was a student at the time so don't help much. we had a joint sponsor but the lawyer told us it wasn't necessary, hoping it will be enough.
-
We went ahead and got a joint sponsor, just to be safe
-
We have only 2 pay stubs and a employment letter, stating the annual income. Do you think that will be ok? by the time of the interview we will have more too.
-
Oops I meant pay stubs lol. Thanks. I'll see what I can do, a cover letter should be ok?
-
I make well over the poverty limits however I only started working last month and was in England for six months before until the job started.
Is there any way we can explain this with the employment letter and a couple of pay checks or will we need my father to be a joint sponsor even though we don't need one? I'd prefer not to but if it will cause a rfe then I guess we will.
Thanks a lot!

4 credit cards; 1 repossesion of car; 1 from att. I got all this in credit karma.
damn, lol. I have been reading a lot about credit the past week, I recommend meeting with a credit specialist who can help you build a plan to rebuild your credit. On CK there is a section that says public charges, if there is nothing in there you are ok for USCIS
-
That's what I'm worried about. I'm already in the process of trying to work on my credit but i can't really pay everything in one year. I don't have anybody to Co sponsor with me. I don't have back taxes or anything. I read somewhere that there's a possibility of being denied if i can't 100% support him. When i filed for income tax this year, my annual salary was 30k and i just got a raise but it's still not really enough to pay my debt completely.
What kind of debt are you talking about? They care about public charges
-
I also just found out i have bad credit, i went onto credit karma and found i had 4 bills from two years ago that i didn't receive. I immediately called the collections, and the doctor paid it off and they disputed since they didn't even contact me once about it and i had no idea, and said they have removed it off my credit so hopefully it will be fixed. Welcome to USA!
-
Fraudulent? Lol. When he is going to pay for it, no it isn't. We just called and there is an option to add non-Us citizens so will be doing that to be safe. I also just realised my name wouldn't be the same anyway!

My husband is adding me to his health insurance while I am here. Mainly so I can get my wisdom teeth taking out! Anyway. It asks for my Ss number and I do have one from my j1 year but I don't know if I am allowed to use it? Any advice?
Oh and I am currently here just visiting. Whilst in process of cr1.

I am here in the US currently visiting my husband. I renewed by visa in September, one month after the i130 petition was filed. I have since visited 3 times for short business and tourism trips.
I called our lawyer to inform her that I was here and wanted to know if it would be ok to change my ticket from the initial departure (Jun 13) to a couple more months out since I was admitted until Nov.
She got it pretty bad that I was here and advised against extending my trip beyond the return date that I told to the officer at the POE.
This is her reply to my explaining that I have been coming and going to see my husband and for business purposes, and that I would only like to stay a couple of months this time:
Hi XXXXXX,
You are risking an inadmissibility determination when you go to your interview at Ciudad Juarez.
Clients who submit B2 visas or B2 renewals while their I-130 is processing are often deemed inadmissible for fraud. (WHAAAT?) Your case presents the added risk that fraud was committedwhen you entered the US and informed the CBP Officer of a departure date that was later switched. (This has not happened yet, I was considering changing the ticket from Jun 13 to end of Aug) If you're deemed inadmissible, your B2 will be revoked, you will have to prepare a waiver, and you would not be allowed into the U.S. while the waiver is processing. Waivers are arduous applications, there is no guarantee that it will be granted, and take over one year to prepare and process. You'd likely have to retain an attorney to assist you with the waiver.
Let me know if you have any questions.
This is pure BS in my opinion. But you guys tell me... should I stay or should I go?
UnaMexicana
two times i stayed longer than i planned.. i don't see how it is bad unless you overstay your visa? I had two lawyers and neither of them mentioned this an issue. oh and i missed my flight one time so stayed an extra two weeks. i was on the VWP though, so not sure if it is any different on the B2. When you think about all the people that do AOS they obviously change their mind and change the departure date, i don't see how it is bad to stay longer than planned within the legal time frame!!?

I'm glad I got approved today at Nebraska, my priority date is January 14th! For those still waiting I'll be praying for you!!!
congrats!

i guess this statement has nothing to do with my case you know why woulld they call her for interveiw
When you call tomorrow, ask to speak to a tier 2 supervisor - they are more knowledgable I think!
-
I think something is off here. The interview call is one of the last steps in this process. Call them again and confirm this bias with another employee working for USCIS. If another person gives the same statement, I am afraid your case is unique and I have no idea! ><
I agree! Call USCIS tomorrow - we all know a lot of them are unknowledgeable and they may have given you incorrect information thinking you were at a later stage etc.
-
Just looked at the document - and it is all type, only the supporting letter has a signature on it. If i get it mailed to me there will be absolutely no difference in the two documents? Unless they mail a different document but i can't imagine so! Thinking it will be enough, unless someone says otherwise!

Hi guys,
I requested my subject access on ACRO via email (i assumed it would take faster, it didn't!) - it has something minor when i was a child, a warning on it (phew) - some of you may know i was panicking about it a lot...
It basically has no details on it just the name of the incident, location, a date, school pupil and outcome etc. If i print out the document is it enough for the interview or do i need to apply for another copy via mail? and wait another 40 days :l
