Someone mentioned in the forum that they were out of DS-5535 in 2023 but asked for passport this year because priority date was not current when cleared from DS-5535 so they had to wait one year for passport request.

    And yeah the Canada post clerk told us we need a QR code or to pay, so just paid. I guess AIS hasn't updated with a QR code or something, oh well.

    got it, yes I was a bit hesitant to send it today because of the address change, and was not able to get a hold of the AIS people for a while.  this helps me thanks!

    I have been in the DS5535 black hole for 17 months

     

    I was requested passport and pictures from the consulate, but after login into my AIS account, I noticed the address had changed to 

    100-1134 Rue Sainte-Catherine O, MONTRÉAL, QC Québec

    H3B 1H4, CA

     

    is that the new address where we send the docs?  It was in Sainte Catherine when I submitted additional documents last year.

    no youre not always supposed to get the auto answer, ive emailed them to request my passport last week, and didnt get an auto answer.  they emailed me back about 5 business days later.

    I got my NEXUS while in DS-5535. I did apply for NEXUS back in 2019 though and only started the petition for my CR1/IR1 in February 2021. There is such a massive backlog of everything you might as well start. It's incredibly ironic that all of us in here can visit the USA as tourists, be approved for NEXUS, all while we are languishing in the DS-5535 hole (as I type this from California on my third trip the USA since being put in the DS-5535 hole).

    Montreal does not have my passport and they technically "should" be working regardless of that.

    i was actually downtown montreal and stopped by the consulate to ask how long it would take to get my passport back after requesting it, and it was the security officer that told me that they "would stop working on your file, and it would put you in the back of the line if you request your passport back, so i hope this trip is important". 

     

    Definitely going to start my nexus application then since im already being vetted.

    You can't. The immi doctor won't do the medical until the consulate requests it again.

     

    That's up to you, but I wouldn't--because that's another chance they can mishandle something important and then you will have to clean up the mess.

    Go ahead and try--there is no rule that i know of against it, but wait times for NEXUS are lengthy, as far as I know. Just as an aside, I have a NEXUS card, and have used it uneventfully. One would think that would have prevented me from being placed in AP with DS-5535, since NEXUS is a security background vetted privilege, but no.

Because everything had gone so so well during the interview until the end when the officer handed him a 221 g refusal, telling him that his documents were fully complete and he wished he could approve my husband's visa today but he can't. This past Thursday, we received an email for his 15 year travel history, 15 year employment history, spouse's names, siblings names (i.e. the ds 5535). We responded the same day, but for some of the responses we just indicated that the information was already in the DS-260. We received a response on Friday asking us to provide all information including everything that was already within the DS-260. So we resent our email with all responses included. Now we are waiting.

     

    The kicker here is I, as the petitioner, had already request an expedite during the previous two stages because my father passed away last year and I needed my husband's emotional support to take care of my mother. And two days before the interview, one of my brother's passed away. So pretty much I have been struggling with my own emotions as well as trying to take care of my mother, I feel physically and emotionally exhausted and I really thought all we needed to do was get through this interview and I'd finally have my support system with me. My heart sank when I found out we were in AP and there was no timeline (supposedly 2-3 weeks according to the officer, but it doesn't sound like it). I feel dejected beyond words and I miss and need my husband. But I can do nothing about it, I do feel like it is inhumane to keep spouses apart for as long as spouses have to be apart during the immigration process and our immigration needs reform (AP or no AP).  

     

    Anyway, I'm happy I have some semblance of support here in these forums, but I pray for all of us to get through this quickly so we can get on with our halted lives.

    Very sorry to hear you're in this limbo, but this forum lets you understand you're not alone.  I've also answered some of the questions on the DS5535 with "information provided in DS-260" but they didn't tell me to include all the information as they did for your husband... just goes to show its like they are no clear rules to this...

  8. Hi all, ive also been a silent reader for a few months now, and it seems like the only way to get anything moving after the DS-5535 is to complete a WOM...?

     

    ive got the email back at the end of march, filled out everything and emailed the consulate back April 1st 2022.  They confirmed receiving the DS-5535 form by email April 6th (but i was still waiting on my police clearance), which they received on April 25th 2022.

     

    Since then my case went from Issued with admin processing (may 4th) to ready (may 10th) to refused (may 25th)... last update was may 31st.

     

    I know im still within the timeframes but i just want to start preparing for the next steps, and its seems like it would be the WOM... Ive also read something about a class action suit?

  9. Hi all I've been reading people's experiences here for awhile, while i was going thru my own immigrant visa trials and tribulations, and this website has been very helpful.

    To make a long story short, i have applied for a F2A visa, with my father as the petitioner. I'm a naturalized Canadian citizen, that was originally born in Cameroon, Africa. I had my interview last June 3rd 2014. I was given a refusal 221 G sheet. The officer explained that i needed to submit a few extra documentation. She also told me to include my passport when i sent everything in, and that the whole review should take 6 to 8 weeks, for them to give me an answer. Ive submitted everything June 11 2014, and i've been waiting since...

    This is a terrible frustrating process, I've emailed the Montreal consulate 4 times, thinking that maybe they hadn't receive my paperwork, or that they needed something else and havent contacted me, but nope! they told me they received everything and that they will contact me once the process is done.

    I have lots of family abroad and with the holidays approaching. i want to ask for my passport back. THE MAIN QUESTION I HAVE IS WILL ASKING FOR MY PASSPORT BACK AFFECT THE PROCESS IN ANY SORT OF WAY? CAN I TRAVEL TO THE US WHILE MY CASE IS IN REVIEW? ANYBODY HAS AN IDEA AS TO WHY ITS TAKING SO LONG?

    Any answer will be welcomed as to im a little lost right now.
