Luisa (The mother) has never applied to renew her J1.
Luis (The son) would apply for just a student visa? Would he be able to do a work study through the university under a Student Visa?
Hugo (The fiancé) was denied due to too many immigration attempts. His ex wife and daughter who were under his J1 visa stayed in the US, his ex wife married an American and went through the process and is now an American citizen as is his daughter. His last immigration attempt was 4 years ago with the embassy. He was given a verbal denial with no paperwork to explain a reason.

Hello,
I have a family friend who was in the US on a J1 Visa working as a Spanish Teacher. She did not renew her visa and left willingly. She is a citizen of Venezuela but currently residing in Peru as a Temporary Resident.
Her son (under 18 at the time) was under her visa as well. He is a citizen of Venezuela residing as a temporary resident in Peru. He is now 19 and wants to return to the US as well. He did ROTC in high school here in the US and is currently interested in applying to College in the US.
Her fiancé was also on a J1 visa as a Spanish teacher. He is a citizen of Peru. He has applied and been denied twice for renewal of the J1 visa.
What are their best shots at returning to live/work in the US?

Hello, my husband recently was approved for permanent residence status. We want to travel to Mexico to visit family. What documentation does he need? I am an American citizen, what documentation do I need? Our son is 16 months old and an American citizen, what documents does he need? Anytips?

You don't get a new ssn you keep the same one from daca your just changing your status not your number
DACA ST cards have a big red line that says "Valid for work authorization only" Once adjusted to PR status you get one that does not have this. One cannot join the military until one has the new card. I called and spoke with a SO officer and was told we must wait until the GC arrives and then go and order the new ST card.

I'm not sure I understand your question. We did advance parole separate from AOS. We did AP last summer, and waited a year for AOS.
Karmenta, congrats on your interview I hope you'll get approved anytime soon.
Question:
Since you are DACA, there was no problem getting AP and coming back from Mexico due your illegal presence of more than the years they say? I'm talking about the 10 year ban and also allowance to Adjust Status.

Interviewer-So how did you two meet?
Us- through mutual friends.
I- when was that?
U- 2011
I- when did you start dating?
U- immediately
I- when was it serious?
U- after a few months.
Interviewer paused and looked through papers.
I- (speaking to me, I had a different hair color in photos) is this actually you in the photos submitted?
Me- yes, I stopped dying my hair.
I- can you verify your name, ssn, address, date of birth, date of marriage, and phone number?
Me- I verified all info.
Husband- verified his same info.
I- (TO HUSBAND) have you ever been arrested?
Husband- yes.
Me- (jumping in before she could say anytning) we have here the citation report, dismissal report, and a letter from chief deputy stating there is no police report.
I- good I'm glad you were honest because I have already seen all of this and was going to deny if you tried to hide it.
Us-*nervous smiles*
I- do you have any more information to submit?
*gives her joint bank statement, rent agreement, rent receipt, electric statement, post office box registered to both of us*
I- good. Thanks.
I- I need to check a few things, it may take a few minutes.

Thank heavens. Her name was Buckley and she was terrifyingly serious the whole time. I really wasn't sure what the outcome would be.
My advice,
Be truthful.
Make sure all copies of everything are official stamped/originals.

Hey all!
Are there still a lot of people with no updates (other than EAD) in terms of interview dates? I'm not sure if I should be calling USCIS and checking in or if it's normal that I'm still waiting.
Also, how much notice do they give you for your interview? I'm booking vacation but have no idea how early I should book my flight in case I suddenly get the call to show up!

It's actually 10 years. However even if you only do a minimum time I would think that would help immensely in filing for renewal/naturalization.my husband plans on signing up as soon as he is approved. With the way immigration laws change so quickly we don't want to risk him being denied and deported in the future.
I heard they give citizenship after serving one year. How easy is this? Is it worth it?

Spoke with the immigration lawyer. She said I have more than enough for the interview. Said she was really I pressed by my competence with the process. Offered me a job. LOL less than 2 weeks until the interview.she also gave us a lot of information about the Raleigh NC office. Said they typically approve same day. Xxxxx

I would think you would need the bc. Are you a spousal petition? On our interview notice it says bring bc if it's a spousal petition.
BC and proof of US Citizenship is for US Citizens born abroad that applied N400.
You just need the BC.
I just posted a question about if do I really need to bring USC Birth certificate or just Passport will be enough.

On our interview notice it says "all documentation establishing eligibility for Lawful permanent resident status" any suggestions as to what to I n clue for this?
"Petitioners birth certificate and proof of US citizenship." As I was born in the US, wouldn't my BC be proof of citizenship?

As you can see from my signature timeline, i am adjusting from DACA. I have a bit of confusion on I-512 vs I-94. What is the difference? When traveling to Mexico I only had the I-94. Also, what is it that I am adjusting to? Permanent resident status? I was advised to file the I-130 and I-485 by a lawyer so that I may join the military.

We brought the petitioners U.S. birth certificate just in case, it's better to have more information because you never know what the IO will ask for. Our IO didn't ask us for anything, no marriage certificate, birth certificates, or supporting evidence. She just asked for our passports at the beginning and at the end wanted to know if we wanted to add anything else to the file. We thought this was strange, but every IO is different.
Yes, I am not a permanent resident, I am just awaiting my actual card. It was only a month after our interview, so it wasn't too bad, but it sure made me nervous.

Congratulations! So this means you now will have resident status? Our interview is on July 19th. My husbands DACA expires in september so we just filed the renewal out of fear that he will have a wait like this!
Hello Everyone,
After a month of waiting after the interview (May 19th), I received my approval letter in the mail. There are still no updates on the USCIS website and still says the interview was scheduled for May 19th. I was getting really nervous as the IO said she would make her decision within 3 weeks and we were on week four. I am happy for it all to be done, for now. So for anyone out there waiting, please be patient. I know it's hard, but keep your head up.
I wish we were approved on the spot like others on the forum, but it happens in all ways. I wish everyone luck, and don't worry, it will all work out.
