  1. To add insult to heartbreak, my job SUCKS, the people I work for are completely immoral, disgusting and cruel. being all by myself without my beloved is terrible. I was waiting so patiently for him to come..... :cry: I feel so weak in the opposition of the mean big world out there sometimes. UGH, I need a new job, anyone know of one in New York?

    I had everhthing prepared to leave after my canceled interview on June 6th. My mistake, I know, but how couldn´t I be excited about it?

    My father died 3 months ago, and 2 days after, my fiancée had to return to United States. I haven´t seen her since then.

    I love her so much. I too feel weak compared to the whole world she has in NY.

    I can´t help but feeling very depressed.

    Yeah I think i know how you feel. When I cry to my baby on the phone he cant hear it, he says its like I am his little girl and he wants to do everything possible to comfort me, but he can do absolutely nothing from there to help me, and so it breaks his heart and he feels a bit guilty. ohhhh the heartache its causing for all of us...

    something else i read on the uscis website was that on some applications (not I-129 F), they will have you come in to one of their fingerprinting centers for the background check. I have no idea if this will apply here.

    I think so too, they are all CIS.

    If they sent it to USCIS, there would be in Washington too.

    I´m afraid my petition will get lost with all these trips...

    :lol: dont be silly, as far as I know they do not use regular mail for these documents, they use Fedex or DHL. I think this should be the LAST worry on your mind.

    I understand, I'm trying to just stay positive. it really doesnt help if you start to fall apart now. You need to try and be strong for each other. I am convinced that Vermont is working on the recalled petitions, why else would they switch the date back to March 6? The point is, dont let it get you down and continue to push on, we'll all get there eventually :thumbs:

  5. If Vermont is on March 6th then I think if they are reviewing old application...mine should be coming up soon(March 8)

    :P , at least I can only hope. If this is the case then we are rolling somewhat again....but the status on USCIS has not changed for me, it gives the same message......perhaps the message is not going to change? I'm going to call my congressman's office again today to see whats news.

    I just e-mailed my senator from Michigan. I just needed someone to complain to! I told her all about how peoples petitions are being recalled, and interviews being cancelled, petition approvals being delayed, and how badly we want some answers, and accountability from our government agencies. Who knows if it will help, but at least it's a voice heard (maybe!).

    When you get that "hate mail" email address, let me know what is it... :)

    I think we should get the address at the white house and email BUSH in big black bold letters: "We knew you weren't the smartest of them all.....but really did you bother to read this law or at least inform your subordinates on how to properly implement it damn it!!" :protest:

    If I understand this right EVERYONE that has a NOA1 after March 5 will get returned. :(

    Only if your visa has been issued will you escape the return and RFE.

  9. I've been checking my receipt number online as well and the message has not changed so far..."you have been approved on...blah blah blah"

    Now when I called NVC last week I received the same answer from them, that they simply forward the recalled petitions from the consulate abroad to USCIS. They have nothing to do with the decision to recall and neither does the embassy abroad. They simple received intructions from the USCIS to send back all petitions dated March 6 and after. The way I see it, USCIS will not be doing background checks on everyone, just on those that fall under this new law I believe. The other ones I think they will look over and see that they're OKAY and send back. But the reason they have to recall all of them is because they no longer know which is which. I AM NOT sure, just an educated guess.

    As I mentioned in my previous post, I contacted my congressman, and already signed their permission slip to have them investigate. I called today to follow up, they have started an investigation and will let me know once they hear something. I hope its soon. I will keep you posted. :thumbs:

  10. I would just like to add.....that I have no more TO add. I 've been reading the posts all along, but I think I am completely helpless at this point. I called, and I called, I contacted my congressman, and now all I can do is wait. The system sucks :(

    If I hear anything soon I will for sure let you guys know. I really hope that once they receive my petition back and notice that I should not be affected by this new law they will return it quickly to the embassy for a new interview date. I can only hope :wacko: I will however be calling my congressmans office tomorrow and asking if they had a chance to look into my case yet, since I've signed the waiver and allowed them to inquire on my behalf end of last week.

    I wish the best of luck to all of you who are waiting in complete and utter disbelief and confusion (L)

  11. It is all well and good to post timelines- but it doesn't fix the IMBRA, and bigger picture, USCIS problems.

    Please, call your congressmen. Ask to speak to the immigration specialist on staff. If you live reasonably close, go visit them. Express your rage at the entire application process not only being stopped, but REVERSED! (interviews canceled, approvals reversed)

    This is insane.

    It drives me crazy to read posters say- Just wait. Be patient. Be a quiet sheep. That is #######- our rights as citizens to pursue happiness and love where and how we chose to was trampled by the IMBRA law.

    There is no earthly reason a fiancee visa should take more than a couple months from application to approved visa. There is no excuse. People must be held accountable for this not happening.

    Today I made my 4th call to my Congressman's office and I will continue to call them until somebody fixes USCIS.

    The squeaky wheel gets the grease. Don't be a sheep! Make some noise!

    I posted this to a different thread but the message needs to be communicated far and wide.

    I think this is good advice. Now that I know how things work, it seems we'd all be better off getting our fiances air tickets to Mexico. Then it's simple, you drive down to Mexico, drive back into the US with the one you love. No waiting no, hassle. In a couple of years congress will make them citizens ahead of the people who did the right thing and went through this bullsh*t process.

  12. We found out about the recall on the 11th also...but I have not received a letter in the mail as of yet :(

    What does the letter say? Any information?

    Here's a copy of the text:

    The U.S. Consulate General in Montreal has received a request from officials of the U.S. Citizenship and Immigration Service (USCIS) stating that the I-129F petition you filed on behalf of your fiancé(e) must be returned to USCIS because of new procedures required by law. The new procedures provide that USCIS must collect additional information from petitioners. Therefore, as per USCIS instructions, we have returned the petition referenced above to USCIS.

    At this time, the petition is not considered to be valid. USCIS officials will be in contact with you concerning the additional information required to validate the petition.

    This Consulate has no authority in the petition validation/approval process. That authority rests solely with USCIS. We have no further details as to what information will be required by USCIS, or how long it may take in order for USCIS to validate the above referenced petition.

    We regret that neither this Consulate nor the National Visa Center has any additional information regarding your petition. Any inquiries concerning the status of the petition should be addressed to the USCIS, telephone number 800-375-5283.

  13. We first found out last week when my fiance emailed the Montreal Consulate to ask if our case was likely to be affected. They responded by emailing him a copy of the letter they'd sent us about the recall. He just received the actual letter yesterday.

    We found out about the recall on the 11th also...but I have not received a letter in the mail as of yet :(

    What does the letter say? Any information?

  14. Okay....this is the biggest ####### I have ever seen!!!! There is no possible humanity to cancelling the issuance of the Visa AFTER the appointment and AFTER the approval. Especially since this is someones life they are playing with. She quit her job, probably purchased plane tickets and now this..................UNBELIEVABLE!!!

    Wendy...your fiance, the USC..needs to walk into his local congressman's office tomorrow and request some answers and help!!!!

    I really feel for you, since my fiances interview was cancelled too, 3 days before the interview itself.

  15. I sent my 129f on March 10 to VSC, received NOA2 on March 24. NVC has already completed processing and my financee already received her packet from the Moscow Embassy. Her interview is set for June 13.

    I was after the March 6 date completely, and it moved fast for me.

    My only concern is that USCIS will re-assess their approvals made after March 6 in order to conduct the criminal investigation and such. I have not heard any word about people getting their approvals "revoked" yet, but would be interested to know if anyone else has heard such a thing.

    I highly doubt that the USG has the energy to revoke the approvals made after that time...they are probably still trying to figure out what to do with the ones coming in.

    2006-05-19 - Suppose to pick up my VISA and passport

    :o oh my god, thats really someting!!! I cant believe they recalled it when you already received your approval and was about to pick up your visa! WOW what craziness :no:

  16. For those of you who have perhaps read the other posts already know my situation with the cancelled interview and a dead end response every time I contact anyone. The embassy still has not answered my email, I wonder if its okay to write another one, a more persistent one stating to them that they are making a HUGE mistake? Apparently they ignored the first one...or will this piss them off and make it worse for me?

    I must have called the NVC, USCIS, and the embassy abroad a dozen times today!!!!!! They all seem to be pointing the fingure at each other. And finally I just told the very nice gentlemen on the phone at the USCIS

    I WANT TO SPEAK TO THE PERSON WHO IS INTERPRETING THIS LAW!!!!!

    I would really like to! He was a very nice man so I didnt feel right to hang it all on him, but really I think some bozo just picked up my file and said, "oh so they met on a russian website, well then we should check it , it must be what they mean in this new law!"

    I am so frustrated with no one ever READING!

    When I told the woman at the embassy that if our cancellation was due to this new law, they have made a mistake because it does not apply to me. she was taken aback, and asked why not? I told her because I did not meet my fiance through a Marriage Broker, she seemed surprised and later just said it makes no difference it has to do with the date of your petiton. She wasnt very nice to me AT ALL!!!!!!! :devil:

    Like I said, I want to talk to the person who is interpreting this law and causing all the delays!! I have a hunch its at the embassy, but I will never know for sure, this is the sad part!

  18. i emailed the embassy telling them our situation. i dont think it is anything i did. i think they realized the mistake and fixed it A.S.A.P. =) gotta tell my congressman not to follow up on my case now. :lol:

    NVC could not help me, they said it is solely in the hands of the embassy, and they have not heard of any petitions being sent back to them. She said try calling the embassy again. I did, and I think I got the woman I had the fisrt time, who refuses to help or answer my questions! :angry:

    I had to squeeze the information out of her and she would only admit to what I said. Then I said that this new law should not apply to me, and she said why not? It applies to all visas after a certain date, regardless of us meeting through a marriage broker or not. I"m pissed!!!!!!!!!!!! This is so wrong!!!!

    plus she said to me again that the checks are going to be done by the NVC, the idiot! after I said I called them and they had nothing to do with the petition! I hope my congressman can help!

  19. Well calling the embassy does not help. It seems that they have just put our case on hold untill they hear more news from the NVC. The assistant just said to contact them gave me their number and she could not give any news about anything else and was not aware of a law when I did mention it. So there you go, I'll call NVC shortly, as soon as they open. Let you guys know how it goes.

  20. The I-767C has two dates on it:

    The Receipt Date

    and

    The Notice Date.

    I have yet to find someone who can say beyond the shadow of a doubt which date is the date the USCIS keys on.

    Someone responded that it's the date and time they stamp the Petition package with.

    That helps ... absolutely for nothing.

    We don't know what the date-time stamp is they stamped the petition package with.

    I wonder if anyone knows which date the IMBRA is keying on.

    The reason I keep asking is my Receipt Date is 3/1; the Notice Date is 3/7.

    One is before the cutoff and the other is after.

    Please yourself...I gave you the information as to what the receipt date on your NOA1 was.......I guess I need to explain further.

    The receipt date on the NOA is the day the service center physical received your petition which is the date-time stamp on the petition. The NOA Notice Date is the date it was entered into the system and a NOA generated. Anything to do with your process including guaging whether your case is overdue is taken from the receipt date (the date it was phsically received at the service center)..not the NOA notice date. The NOA2 has nothing to do with whether you will or may be affected by the IMBRA. Any petition received after March 6 (the date stamped on your petition which is the receipt date on your NOA1) are the ones affected by the IMBRA. As your reciept date is 3/1 then you filed before the Act came into effect and should not come under the IMBRA.

    wow... ok aussie... I have a strange case... I recieved an RFE for not sending them the check (duh)...

    I'm looking at my I-797C and it has a "Recieved Date" of 2-13-06 and a Notice date of 3-10-06....

    So when you say "receipt" date you really mean "recieved date" ?

    I'm not sure which date to put as my NOA1 date in my timeline!

    Maybe I'm just nuts...

    Ok.. I just realized when I was looking at the timeline it says "Receipt date" next to NOA1... duh. ok i'm updated now..

    ok... updating my timeline didn't do anything to change my estimated noa2 date... so .. either way it doesnt matter... but I guess since my receipt date is 2-13 I shouldnt be subject to imbra.. but who knows what they're doing these days

    I had the same situation, and they sent the whole package back to me with my incorrect check, so I had to resend the package to them with the CORRECT check, I dont think the receipt date counted the first time around, your case may be different though since you didnt say that they sent the whole thing back to you

    Any approvals of people with NOA1's after March 6th?

    Any word on how this will affect those of us with NOA1s after March 6th? All I can find is "if you are before March 6, don't worry. If you're after March 6, you're screwed." Probably true but not very specific.

    Not screwed.....the ones affected are those that have met through a marriage broker and/or have filed multiple petitons etc. If you havent already....have a read of the act in various threads pertaining to the IMBRA. Right now I think there is a settling in stage which may have slowed things at the various service centers including NBC.

    I am wondering, particularly now, how important it is going to be to write more then a few words when it comes to Q18 on the I-129F as to how one met especially if one has met over the internet. Whilst meeting online itself, in various chat rooms, groups etc do not seem to come under this act.....how are they to know if one leaves too much to the imagination. My advice is to perhaps go into a lot more detail under these circumstances to safeguard against being caught up in it. Any thoughts?????

    The thing is........some interviews have been cancelled and petitions sent back. Only time will tell just how much of an affect this is going to have on approved petitions that are waiting or have an interview already.

    I have to agree here. I have a gut feeling in my stomach that they are just more cautious about you if you met online. How can they know which site is a mariage broker or not? I did not specify this in my answer to question #18. I NEVER thought it could effect me so much!!!

    I think this is why I got caught up in this :crying:

    We met online on a free Russian site, so I think they just panicked because Russia has a tendency to utilize the mail-order bride routine. This is just a hunch......I dunno :huh:

    I hope I get to hear something from them tomorrow :unsure:
