  1. Hi everyone. Congrats on the approvals and good luck to anyone awaiting an interview.

I need your opinions about something. I recently lost my job and my fiance's interview is scheduled for December 18. I was hoping I would find something by now but no luck yet. I have some strong leads that might pan out to something this week(feeling hopeful). I going to have my brother be a joint sponsor. He meets all the requirements. I have read that there some disadvantages to using a joint sponsor for the k1 visa process. "Both the advantage and the disadvantage of the Form I-134 Affidavit of Support is that it is not considered to have much legal weight. In other words, although a U.S. government agency could take a sponsor to court to enforce it, they never seem to do so. Perhaps they realize they wouldn't win. That’s an advantage because makes it easier to persuade someone to sign the form, without endangering that person's financial future. It’s also a disadvantage: Because the consular officials know that the affidavit is hardly worth the paper it’s written on, they may disregard the joint sponsor. For this reason, if you go the joint sponsor route, you might want to supplement the person’s affidavit with a letter or a sworn statement expressing his or her deep commitment to supporting the visa applicant."

Based on what I read I am planning of sending an affidavit of support from both me and my brother and a notarized statement expressing his commitment to supporting my fiance. I will also send my income tax info and W2 from previous years. I will also send copies of my undergraduate and graduate diplomas to show that I am highly educated and that the unemployment is a temporary phase.

Has any of you experienced a similar situation? Please feel free to give me your ideas and opinions

    Thanks everyone

    Fabienne

  2. Hi in the packet 3 all they ask my fiance to send is his birth certificate original and copy. I am also including the certified birth certificate translation. I am doing the translation here in the US. I am wondering do I have to mail the original translated copy to my fiance or can I scan him the copy. There all still some documents that I am still waiting on to send to him when he goes on the interview but he needs the translation now to submit to "Haiti Messager" as requested in packet 3. I was trying to avoid paying 56 dollars to send just one piece of paper if I can scan it. So scan copy or mail original copy?

  3. May I suggest that you look at the website for the US Embassy where your Fiancé lives. Look for the information contained under the fiancé Visa section. Packet 3 and 4 instructions letters are shown in the section. (They are shown in the USA Embassy in Bangkok Thailand).

    Good luck. ..

Thanks, I was just wondering what everyone got. In my packet 3 letters it gives me a step by step instruction to fill the DS-160 and how to make the payment. It also gives instructions on how and where to get the medical exam done. Once he does the medical exam, he will receive a sealed envelope to bring to the interview. The only documents It requested are : six passport pictures and my fiance birth certificate(original and copy) and 2 documentation submission page. I just talked to someone there, they said that whatever it says to bring , that is all I need to bring and any other needed documents he will bring to the interview. I was thinking that they were going to require more documents such as the affidavit of support, proof o relationship... I guess I will have him bring these documents to interview.

  4. If that's all they require you to bring to the medical appointment (passport and vaccination records) I would say you should go ahead and take care of that now. He may also need to bring a couple of passport photos, but he may want to call ahead just to be sure. Just keep in mind that the medical is valid for 6 months and has to be valid by the time he enters the US. I'm sure he'll enter the US before it expires but just keep that in mind.

Thank you. I will have him do it sometimes next week and also bring passport pics just in case.

  5. Hi everyone. I have a question. Can my fiance go ahead and the medical exam now that we have a case number and that the US embassy should have our file by now? Do we have to wait for them to send us something? I went on the us embassy website for info. it did not say anything about having to wait for the embassy to contact my fiance or to wait for packet 3. ( On the day of your appointment with the physician, bring your passport as proof of identity and any vaccination records that you have available.) and then my fiance will get a sealed envelope to bring to the interview. So should I wait to do the medical exam?

  6. The k-1 is weird. You fill out the ds-160, but on the ceac website you select immigrant visa. So on the one hand, it is an immigrant visa, but on the other hand it isn't?

I am assuming in the k1 visa process the fiance coming to the US fall under both immigrant and non immigrant. The fiance is still considered non immigrant for the 90 days after entry in US. Once married within the given 90 days they fall under the immigrant status when the petitioner apply for the adjustment of status. If it was just a tourist non immigrant visa, all the person would have to do is to fill the DS-160 and bring some form. The I-129f petition that had to be approved I guess is part of the "immigrant" process. At least that is how I understand it.

  7. Hi everyone. I got approved on September 24th. After 30 minutes of waiting this morning, someone from NVC told me the case was not in their system yet and that I should give it a few more weeks. This fact is kind of a blessing in disguise. I lost my full time job last month and I have been job searching since. I was wondering how six months to a year contract jobs, temp to permanent hire jobs look in the affidavit of support? Before I lost my job, I met all the qualification needed for financial support. Also will being healthy, young and having a Master's degree show them that I have potential and that I won't rely on the government for assistance?

Thanks in advance or any help and suggestion provided

  9. USCIS will not notify you when NVC has received your approval. NVC notifies you by regular mail. You can also call NVC to ask if they've received it yet. The best time to call NVC is 7 AM ET M-Friday. Calling them at other times of the day you will a) have more difficulty getting through to them b) be on hold for a long time when you do get through.

Thank you very much I will call them tomorrow. it will be three weeks tomorrow since my petition got approved

  10. Now that your petition is approved it should be making its way to the NVC - National Visa Center in New Hampshire. From the NVC it gets sent to the Consulate in Haiti, but it may take some time. I have been reading that it can take anywhere from 2 weeks to 1 month to get to the Consulate from the NVC. It's been a little more than 2 weeks since my approval and my petition has not arrived at the NVC yet. In the meantime you and your fiance can start putting together documents and preparing the things that he/she will need when it comes time for the interview. The information each country requires may be somewhat different, but you can take a look at the Embassy info page for Haiti to get a better understanding of what's required.

I also found this Visa Faqs page to be helpful - what to expect after the I-29F approval.

Thank you for your help I will definitely check them out. Good luck on yours. I hope yours gets to NVC soon

  11. well my friends I was right... all that are remaining are receiving the dreaded RFE's... mine just came in!! lol someone touched my freaking petition!!!! can't wait for that letter to move the process

I have not been able to post since I joined until today. I have been following this forum religiously and I really appreciated the support given. I am scared now that I am going to get the dreaded RFE; my NOA1 was on April 17th too. This process has really shown me how to wait patiently and try to stay positive and optimistic. Still waiting to hear from them. Hopefully it's an approval. Stay positive everyone
